초록

우리나라는 정부수립이후 현재까지 중앙정부에서 경찰의 주체가 되는 국가경찰제도를 취하고 있다. 그러나 그 동안 많은 시간이 흐르면서 사회환경과 국민의식은 변화되었고, 이제 자치경찰제도를 도입하자는 의견이 주를 이룬다.
이러한 상황에서 현 문재인정부는 노무현 참여정부를 계승한다고 표방하는데, 참여정부와 같이 자치경찰제 도입에 관해서도 강한 의지를 갖고 있기에 적극적으로 자치경찰제 도입을 추진하고 있는데, 이 연구에서는 자치경찰제와 관련되어 논의되고 있는 주요한 쟁점사항들을 살펴본다. 특히 현 정부에서 계승하고자 하는 참여정부에서의 정부법률안과 현 정부에서의 도입안 중 주요쟁점 사항을 심층 비교분석하고, 나아가 바람직한 제도도입이 될 수 있도록 제언을 첨언한다.
주요쟁점사항으로 자치경찰의 도입단위와 사무범위를 제시하였는데, 먼저 참여정부 당시 정부에서 발의한 법률안에서는 도입단위를 기초자치단체수준으로 하고, 사무범위는 생활안전·지역교통 및 지역경비에 관한 사무와 지방자치단체 소관 특별사법경찰관리의 직무를 수행하도록 하여 주민생활과 밀접한 사무로 한정하였다.
문재인정부에서는 도입단위를 광역자치단체수준으로 하고, 주민의 생활과 직접적인 관련이 있는 생활관련 치안, 지역교통 및 지역경비와 함께 지방 전문행정과 관련된 특별사법경찰업무를 기본적으로 수행하면서, 일부 수사권한을 부여받게 되었는데, 학교폭력·가정폭력·성폭력 범죄 등 일반범죄와 공무집행방해 범죄, 음주운전 사건. 그리고 납치·유괴 등의 강력범죄가 의심되지 않는 실종자·미귀가자 관련 사건과 동물 안전 관리와 관련한 동물보호법 사건도 담당하며, 「도로교통법」이나 「경범죄 처벌법」 위반자에 대한 즉결심판 청구권도 포함한다.
이를 살펴보면, 현 정부의 도입안이 참여정부의 법률안보다 자치경찰의 실질적인 업무 수행 면에서 진일보하였다고 평가된다.
그러나 더욱더 실질적으로 자치와 지방분권 이념에 충실한 자치경찰체제를 구축하는 것이 필요할 것인데, 이는 현재 국가경찰조직의 지방경찰청 및 그 산하 경찰관서가 원칙적으로 광역시·도지사 소속의 자치경찰로 전환되는 것을 의미한다. 그리고 국가경찰에 남는 것은 현재의 경찰청 조직 수준일 것이며, 경우에 따라서는 광역단위 지역에 범죄수사본부를 두어 국가경찰의 광역수사체계를 구축하는 정도일 것이다. 따라서 현행 지방경찰청 단위의 경찰조직이 그대로 자치경찰로 전환되는 것이므로 자치경찰은 현행 지방경찰청에서 수행하는 권한과 기능을 그대로 수행하게 되고, 국가경찰은 자치경찰을 지원하거나 자치경찰간 업무를 조정하고, 협력을 담당하며, 나아가 보안, 외사, 광역수사 및 광역적인 경호경비 등과 같은 자치경찰을 넘어서는 분야를 담당하게 하는 것이다.

영어초록

Korea has been taking the national police system since the establishment of the government. However, the social environment and public consciousness have changed over the years, and now the idea of introducing the municipal police system is in the air.
Under these circumstances, the government is now claiming to succeed Roh Moo-hyun government and as the participatory government has a strong will to introduce the autonomous police system, it is actively promoting the introduction of the municipal police system.
This study examines the major issues discussed in relation to the autonomous police system. In particular, it will analyze and analyze in detail the major issues of the government bill in the participatory government and the introduction of the current government in the current government. In addition, the proposal suggests the introduction of a desirable system.
The main issue is the introduction of the autonomous police unit and the scope of office.
First, the bill introduced by the government at the time of the Roh Moo-hyun administration is based on the level of the local self-governing body. The scope of the office is to carry out the duties of public safety, local traffic and local expenses, It was confined to work close to life.
Next, Moon Jae-in allowed the introduction unit to be at the level of metropolitan municipalities and basically carried out the special judicial police affairs related to the local special administration together with the life related security, the local traffic and the local expense directly related to the life of the residents. In the meantime, I was granted some investigative powers, including general crimes such as school violence, domestic violence, sexual violence crime, crime of obstruction of government execution, drunken driving. It is also responsible for cases involving missing persons who are suspected of violent crimes such as kidnapping or kidnapping, marijuana-related cases, and animal protection laws related to animal safety management. It also includes the right to appeal for summary judgment against violators of the Road Traffic Act or the Minor Pandemic Act.
It is estimated that the introduction of the current government is more advanced than the legislation of the participating government in terms of the actual work of the autonomous police.
However, it is more and more necessary to build an autonomous police system that is faithful to the autonomy and decentralization ideology. This means that the local police department of the national police organization and its affiliated police officers are, in principle, converted into autonomous police officers belonging to the provincial governors. And it would be the level of the present police department to remain in the state police, and in some cases it would be to establish a broad investigation system of the state police by placing a criminal investigation headquarters.
Therefore, since the police organization of the current local police department is transformed into autonomous police, the autonomous police will carry out the functions and functions performed by the current local police agency. And the state police are supposed to support the autonomous police, coordinate the work between the autonomous police, take charge of the cooperation, and also take over the autonomous police such as security, foreign affairs, broad investigation and wide area security
