대한민국 헌법의 기원-동학농민혁명의 「폐정개혁안들」을 중심으로- (Origin of the Constitution of the Republic of Korea-Focusing on Reform Plans of DongHak Peasant Revolution-)

초록

「대한민국 헌법」의 기원을 찾는 작업은 우리 헌법에 대한 좀 더 깊은 이해를 담보하고, 우리나라의 정체성에 대해 더욱 명확한 규명을 할 수 있다는 점에서 매우 필요한 일이다.
「대한민국 헌법」의 기원이 되는 원시헌법문서의 후보로는 갑신정변의 「정강 14조」(1884), 동학농민혁명의 각종 「폐정개혁안들」(1894), 갑오개혁의 「홍범 14조」(1895), 만민공동회의 「헌의 6조」(1898), 대한제국의 「대한국국제」(1899)를 들 수 있다. 본 논문에서는 원시헌법문서의 다섯 가지 인정기준에 비춰볼 때 위 5개의 문서 중 「폐정개혁안들」과 「헌의 6조」가 원시헌법문서에 해당하고, 「폐정개혁안들」이 「헌의 6조」보다 시기적으로 4년이나 빠르므로 결국 「대한민국 헌법」의 기원은 「폐정개혁안들」에서 찾아야 한다고 본다.
하지만 「폐정개혁안들」 중 「폐정개혁안 12조」에 대해서는 역사적 실재성 여부가 문제되고, 「폐정개혁안들」 자체가 원시헌법문서로 인정될 수 있는지 여부에 대해서도 논란이 있다.
이에 본 논문에서는 우선, 「폐정개혁안들」의 전제가 되는 동학의 핵심 사상(시천주)과 동학농민혁명의 전개 과정에 대해 살펴보았다. 이어 「폐정개혁안 12조」의 역사적 실재성 여부에 대해서는 「폐정개혁안 12조」를 기술한 『동학사』의 사료적 가치를 인정할 수 있는 점, 「폐정개혁안 12조」는 집강소의 강령이었고 그 내용이 집강소의 폐정개혁 활동과 거의 부합한다는 점 등을 근거로 그 역사적 실재성이 충분히 인정될 수 있다고 보았다. 또한 동학농민혁명이 우리 민족 최초의 민중혁명이고, 집강소가 풀뿌리자치의 원형이므로 국민주권의 원리를 실제로 구현했다는 점, 경제･사회적 기본권 보장에 관한 내용이 담겨 있다는 점, 초보적 수준에서나마 권력분립을 지향했다는 점, 「폐정개혁안들」의 바탕을 이루는 시천주 사상은 인간 존엄성의 정수를 담고 있다는 점, 3･1운동 및 대한민국 임시정부와 연계성이 충분하다는 점 등을 근거로 「폐정개혁안들」은 「대한민국 헌법」의 기원이 되는 원시헌법문서로 인정될 수 있다고 보았다.

영어초록

Finding the origin of the Constitution of the Republic of Korea is very necessary in that it allows a deeper understanding of our constitution and a clearer understanding of the identity of our country.
Among the documents that are mentioned as candidates for the original constitutional document, Reform Plans of the DongHak Peasant Revolution and Article 6 of the Charter of the General People's Assembly can be recognized as the original constitutional document. Also, The former are 4 years ahead of the latter. In the end, the first original constitutional documents, which are the origin of the Constitution of the Republic of Korea, can be said to be Reform Plans.
However, among Reform Plans, there is a question as to whether Article 12 of the Reform Plan was historically real and whether Reform Plans themselves can be recognized as original constitutional documents.
First of all, the criteria for recognition of the original constitutional documents were clarified, and the core ideology of Donghak, which is the premise of Reform Plans, the Sicheonju ideology and the development process of the DongHak Peasant Revolution were examined.
And on the basis of the following points, the historical reality of Article 12 of the Reform Plan was recognized.
① The historical value of 『The History of Donghak』, which describes Article 12 of the Reform Plan, is recognized.
② Article 12 of the Reform Plan was the policy of the Jipgangso, and its contents are almost consistent with the reform activities of the Jipgangso.
Also, on the basis of the following points, it was recognized that Reform Plans are the original constitutional documents that are the origin of the Korean constitution.
① The DongHak Peasant Revolution was the first popular revolution of our nation, and the Jipgangso was the prototype of grassroots autonomy, so the principle of popular sovereignty was actually embodied.
② The Reform Plans include the guarantee of basic economic and social rights.
③ At the rudimentary level, the separation of powers was oriented.
④ Sicheonju ideology, which forms the basis of Reform Plans, contains the essence of human dignity.
⑤ There is sufficient connection with the March 1st Movement and the Provisional Government of the Republic of Korea.
