초록

보험계약의 법률관계를 다루는 보험계약법은 보험계약자나 피보험자의 이익을 보호해야 할 뿐만 아니라, 보험자의 불이익 역시 발생하지 말아야 하고, 양자의 이익조화를 꾀하는 입법태도를 견지해야 할 것이다. 이런 측면을 고려하여 다음과 같은 결론을 제시할 수있다.
첫째, 보험금액의 지급이 지연되는 경우 지연 일수에 대한 지연이자 지급의무를 규정해야 한다는 법안에 대하여 반대하지는 않지만, 보험계약자 측과 보험자 측의 형평성을 고려하여 보험계약자 측의 협조의무와 이에 대한 과실이 있는 경우 그 기간의 진행이 정지된다는 내용을 함께 규정해야 할 것이다.
둘째, 보험금청구권 소멸시효를 5년으로 연장하고, 보험계약자 측의 보험금청구에 대한 보험자의 확정적 회신을 받기 전까지는 보험금청구권 소멸시효가 정지된다는 내용의경우, 굳이 3년에서 5년으로 연장하는 것이 큰 의미가 있을지 의문이다. 자신의 재산상의 이득을 청구할 수 있는 자가 5년이나 기다리고 있다가 그 권리를 행사하는 경우는 그리 많지 않을 것이다. 오히려 보험계약자나 피보험자에게 보험금청구권을 행사할 수 있다는 점을 명백하게 인지시켜 주는 방안이 요구된다.
셋째, 보험설계사에게 보험계약 체결 대리권은 부여하는 방안은 바람직하지 않다고 본다. 보수나 직급 등의 체계가 완비되지 않은 상태에서 일률적으로 대리권을 부여하는 것은보험자으로 하여금 심각한 부담으로 작용할 가능성이 높고, 기존 보험설계사의 이직이나해임 등의 부작용이 발생할 수 있다. 다만, 고지의무의 수동화 방안에 대하여는 국제적 정합성 측면과 보험계약자와 보험자의 정보비대칭 격차의 해소되고 있다는 점을 고려하여 도입을 긍정한다.

영어초록

The insurance contract law, which deals with the legal relations of insurance contracts, should not only protect the interests of policyholders and insureds, but also should not cause disadvantages of theinsurers, and should maintain a legislative attitude to harmonize the interests of both parties. In consideration of this aspect, the following conclusions can be presented.
First, in case the payment of the insurance amount is delayed, we do not object to the bill that stipulates delay interest payment obligations for the number of the delay days. However, in consideration ofthe equality of the policyholder and the insurer, if there is a negligence of the policyholder’s obligation to cooperate, it should be stipulated that the progress of the period will be suspended.
Second, with extending the expiration of the right to claim insurance to 5 years, in the case of the content that the expiration of prescription rights for insurance claims will be suspended until a definitivereply from the insurer to the insurance claim by the policy holder, it is questionable whether extending it from 3 years to 5 years will be of great significance. It is unlikely that a person who can claim an advantage in his or her property will wait fiveyears before exercising that right. Rather, a plan is required to clearly recognize that it is possible to exercise the right to claim insurance against the policyholder or the insured.
Third, it is not desirable to give insurance agents the agency right to sign insurance contracts. In the absence of a system such as remuneration or rank, uniformly granting the right of proxy is likely tobe a serious burden on the insurer and the side effects such as turnover or dismissal of an existing insurance agent my occur. However, regarding the passivation of notification obligations, with the consideration on the international coherence aspect andon having been narrowing the gap of the information asymmetry between policyholder and insurer, we affirm its introduction.
