미국 국토안보부의 대테러리즘 활동: 임무, 조직 운영체계 및 전략 (U.S. Department of Homeland Security's Counterterrorism Activities: Missions, Organizational Management System, and Strategy)

초록

미국은 본토에 대한 2001년 9/11 테러 이후 국내에서의 테러리즘 예방과 효과적인 대응을 위해 대테러리즘 관련 22개 기관을 통합하여 2003년 3월 국토안보부(DHS)를 창설하였다. 이를 통해 국내 대테러리즘 전반에 관한 업무를 국토안보부에 전담하게 하고 테러리즘 예방과 안전보장 증진, 국경 안보와 관리, 이민법 집행과 관리, 사이버공간 보호와 안전 및 재난 대비·복구 등 5가지 분야에서 본토의 안보를 강화하고 있다. 특히 첫 번째 임무인 테러리즘 예방과 안전보장 증진을 위해 테러리스트 공격예방, 화생방·핵물질(CBRN)의 불법적 취득과 사용 예방 및 핵심기반시설, 주요 지도자 및 중요행사의 위험관리를 핵심목표로 설정하여 통합적인 대응체계를 구축하였다.
그러나 한국에서는 아직도 테러방지 관련 법안이 부재한 가운데, 국내 테러리즘에 대한 대응은 테러 유형별로 유관 부처가 독립적으로 담당하는 분산된 대응체계를 유지하고 있다. 미국 국토안보부의 통합된 대테러리즘 활동체계가 한국의 대테러활동 체계에 주는 시사점은 다음과 같다. 첫째, 한국정부는 대테러리즘 관련법안 제정을 통해 대테러리즘 활동을 총괄 기획·조정할 수 있는 상설화된 국가대테러센터를 설립하여 유형별 주관부서와의 대테러리즘 협력·조정체계를 확립해야할 것이다. 둘째, 생화학테러에 대한 관련법령을 제정하고 일반 행정부처가 아닌 전문기관인 생화학안전위원회의 설치 검토와 함께 대테러활동지침에 생화학테러 관련 내용을 강화하여 법·제도적인 대응체계를 정비해야할 것이다. 셋째, 국가중요시설에 대한 민간경비 인력 중심의 방호대책을 개선하여 경비·보안·방호 임무를 담당하는 국가기관을 설치하는 방안을 검토할 필요가 있다. 넷째, 국가중요행사의 경호·경비에 관한 통합적 법령체계 구축과 함께 국가중요행사에 관한 유형별 주관부서의 지정 등을 고려할 필요가 있다.

영어초록

Since 9/11 terror attacks against U.S. homeland in 2001, the Department of Homeland Security(DHS) has been established through integration of 22 terrorism-related institutions for terrorism prevention and effective response. The Department of Homeland Security has dedicated to work on all aspects of domestic counterterrorism and terrorism prevention. There are five homeland security missions as follows: preventing terrorism and enhancing security, securing and managing borders, enforcing and administering immigration laws, safeguarding and securing cyberspace, ensuring resilience to disasters. In particular, as for preventing terrorism and enhancing security, the DHS defined its goals as follows: prevent terrorist attacks, prevent the unauthorized acquisition or use of chemical, biological, radiological and nuclear materials, and manage risks to critical infrastructure, key leadership and events.
However, while Korea still lacks counterterrorism legislation, it maintains distributed system of domestic counterterrorism to respond independently by related ministries based on terrorism types. Implications of integrated counterterrorism activities of the U.S. DHS system for Korea are as follows. First, Korean government must enact counterterrorism legislation and establish the National Counterterrorism Center to plan and coordinate of counterterrorism activities within the related departments. Second, it has to enact laws and regulations of biological and chemical terrorism and establish specialized the Biochemistry Safety and Security Commission. Moreover, articles on biological and chemical terrorism should be strengthened in the National Counterterrorism Activities Guideline. Third, it has to improve missions of private security personnel for protection of national critical infrastructure and consider to install the national agency responsible for the protection of critical infrastructure. Fourth, Korea needs to enact integrated legislation of security of national important events and consider to specify department in charge of national important events based on types of events.
