인류공동의 유산’의 국제제도화 과정: 심해저 관리를 중심으로 (The Evolution of the Common Heritage of Mankind in the Management of International Seabed)

초록

이 글은 심해저 자원의 관리를 담당하는 국제해저기구(International Seabed Authority)의 형성 과정을 분석한다. 1967년 몰타는 심해저를 ‘인류공동의 유산’으로 정하고 국제기구를 통하여 관리하자는 안을 제출함으로써, 해양 선진국에게 유리한 ‘해양의 자유’ 국제제도에 도전했다. 선진국은 발달된 과학기술을 활용하여 심해저에서 광물자원을 채취할 수 있었기 때문에 ‘해양의 자유’가 심해저에도 적용되어야 한다는 입장을 고수했다. 반면, 개발도상국은 심해저 광물자원의 채취와 이로 인한 이익이 국제기구에 의하여 관리되어야 한다는 입장을 가졌다.
선진국은 심해저를 관리하는 국제해저기구의 의결구조를 선진국의 이해에 유리하도록 만들었다. 심해저 관리에서 실질적 결정을 담당하는 이사회에서 개발도상국이 압도적 다수를 차지하지만, 집중화된 이익을 가진 소수 국가가 사실상 거부권에 근접한 의결권을 가지고 있다. 외향적으로 국제해저기구가 인류의 이익을 반영하는 것처럼 보이지만, 실질적으로 심해저 광물자원의 생산, 소비, 투자에 직접적이고 집중적인 이해관계를 가진 소수 국가의 이익을 반영하고 있다.
이 사례연구는 새로운 생각과 개인 행위자가 국제제도의 형성 초반에 상대적으로 중요한 역할을 담당하는 반면, 국제제도가 공식적 기구 또는 성문화되는 단계에서는 이익이 중요한 역할을 담당함을 보인다. 이 연구결과는 국제제도의 형성과정을 설명하는 국제정치이론의 적실성이 시점에 따라 상이함을 보인다. 즉, 구성주의가 국제제도의 형성 초반을 설명하는데 장점을 가지는 반면, 제도주의와 현실주의는 국제제도가 공식화되는 단계를 설명하는데 장점을 가진다.

영어초록

This paper analyzes the process to create the International Seabed Authority (ISA), which controls all activities in the international seabed area beyond the limits of national jurisdiction. Malta's proposal in 1967, which designates the international seabed as a 'common heritage of mankind' and calls for an international organization to regulate mining activities and research in the deep sea, challenged "the regime of the ocean for millennia," 'freedom of sea.' Developed countries, which have technical capabilities to extract mineral materials from the deep sea, tried to keep 'freedom of sea' intact. Meanwhile, developing countries wanted to create international organization with a strong regulatory power.
Countries which have significant interests in deep sea mining have succeeded in projecting their interests into the ISA's decision-making structure. Even though developing countries form a super majority both in the General Assembly and the Council of ISA, major powers and those who largely produce or consume mineral materials or have invested much in deep mining, enjoy favorably weighted voting right in the Council. A small number of countries with significant interest in the deep sea mining defeated proposals favorable to developing countries.
This research implies that the explanatory power of international relations theories may depend on the temporal dimension of international institutions. Constructivism is good at describing the change of international institutions. International institutions, which do not effectively deal with abnormal challenges, are contested by new ones based on alternative ideas and norms. Meanwhile, Institutionalism has strengths in explaining the formalization of international institutions. Once they agree to formalize nascent international institutions, states try to project their national interests into the decision-making process of international organization.
