대학 연구실 안전 강화를 위한 법제 개선방안 (A study on the Legal Improvement of Safety Management in University Laboratory)

초록

우리나라 연구실의 안전관리는 2005년 3월 제정된 연구실 안전환경 조성에 관한 법률을 중심으로 관리되고 있다. 그러나 대학교 연구실에서 발생하는 안전사고의 비율은 2011년 이후84%로 타 연구기관과 기업부설 연구기관과 비교했을 때 높은 비중을 차지하고 있다. 대부분의 대학교 연구실은 학부생과 석사생으로 구성되어 있어 전문성이 떨어지므로 안전사고의 위험성에 많이 노출되어 있는 실정이다. 이렇게 대학교 연구실 안전사고가 꾸준히 발생하기 때문에 연구실 안전사고 방지를 위한 노력은 필수적이다.
이는 연구실안전법의 중요성을 반증하는 것이다. 이 법은 대학이나 연구기관 등에 설치된 과학기술분야 연구실의 안전을 확보함과 동시에 연구실 사고로 인한 피해를 적절하게 보상받을 수 있도록 함으로써 연구자원을 효율적으로 관리하고 나아가 과학기술 연구ㆍ개발활동 활성화에 기여함을 목적으로 한다.
이러한 목적달성을 위하여 내용상, 운영상, 그리고 근본적인 개선방안을 모색하고자 한다.
내용상 개선방안에 있어 동법의 적용대상 확대 등을 고려하여야 한다. 최근 문 ‧ 이과 융합학문 및 과정 활성화로 인해 대학 연구실험실 안전은 과학기술계열 뿐만 아니라 예체능 및 인문사회계열 실험 실습실을 모두 포함한 안전관리 체계 구축의 필요성이 증대되고 있다. 그러므로 대학 연구실 사고는 예체능 계열을 포함한 모든 실험실에 적용되어야 하나 현재 연구실 안전법은 이공계에 한정되어 있다. 따라서 연구실안전법의 적용 대상을 대학이나 연구기관 등에 설치된 과학기술분야 연구실로 한정함에 따라 발생하는 법률상의 문제점과 학교 내 안전 사각지대 해소를 위해 연구실안전법의 법률 적용대상 확대가 절실하다. 이는 연구실 정의 규정의 확장을 통하여 달성할 수 있을 것이다.
‘연구활동종사자’는 대학ㆍ연구기관 등에서 과학기술분야 연구개발활동에 종사하는 연구원ㆍ대학생ㆍ대학원생 및 연구보조원 등을 의미하는데, 이에 대해서도 연구활동종사자의 개념 범주가 불명확하고 연구개발활동의 범위가 모호하기에 과학기술분야와 관련된 법률에서 명시적으로 정의하는 용어를 인용하여 직접적으로 규정함이 동법의 목적달성에 더 부합한다 할 것이다.
적용범위에 있어 대학ㆍ연구기관 등이 연구개발활동을 수행하기 위하여 설치한 연구실에 관하여 적용하며, 산업안전보건법의 적용대상 근로자에 대해서는 산업안전보건법이 정하는 바에 따르는 것으로 규정하고 있다. 그러나 이는 적용범위와 다른 법률과의 관계를 한 조문 안에 두고 있는 것으로 체계정당성의 불일치이다. 그러므로 적용범위에 관한 규정과 다른 법률과의 관계 규정은 별개의 독립조항으로 개정함이 타당하다 하겠다.
운영상 개선측면에서 과학기술분야 연구실만을 과학기술정보통신부에서 별도 관리함에 따라 안전사각지대의 발생 및 체계적인 안전관리가 이루어지지 않고 있는 실정이다. 이에 따라 학교 및 연구기관 안전 관련법에 대한 통합 관리 및 협업체계를 구축·운영하는 방향 검토가 필요하다. 따라서, 강력한 컨트롤 타워를 통해 대학교 및 연구기관들에 대한 안전관리가 수행될 필 요성이 있으며, 부처 간 협의체 구성이 하나의 대안이 될 수 있다. 그리고, 지금까지 연구실의 안전에만 치중해 왔던 안전관리를 사람과 환경으로 확대하는 포괄적 관리체계 구축과 운영 또한 필요하다근본적인 개선방안으로 헌법상 안전권의 명문화를 들 수 있다. 안전권은 ‘위험으로부터 헌법상 보장된 자신의 법익을 온전히 보존할 수 있는 권리’를 의미하는데, 개헌논의에 비추어 조속한 명문화가 절실하다 할 것이다.

The safety management of research laboratories in Korea is mainly managed by the "Act on the Establishment of Safety Environment in Laboratory" enacted in March 2005, but the proportion of safety accidents in university laboratories is 84 percent since 2011, which is a high percentage compared to other research institutes and business-affiliated research institutes. Since most university labs are composed of undergraduate and master's students, their expertise is reduced, and thus they are highly exposed to the risk of safety accidents. Efforts to prevent safety accidents in the laboratory are essential because of the steady occurrence of safety accidents in the university laboratory. This is to disprove the importance of the Act on the Establishment of Safety Environment in Laboratory.42) The purpose of Act on the Establishment of Safety Environment in Laboratory is to efficiently manage research resources and thereby to contribute to the revitalization of scientific and technical research and development activities by ensuring the safety of laboratories in the fields of science and technology established in a university, research institute, etc. and ensuring proper compensation for damage caused by a laboratory accident.
In order to achieve this purpose, we seek to improve the contents, operation and fundamental improvement.
Improvements in contents include expansion of the scope of application. Recently, due to the revitalization of literature and science convergence studies and courses, the necessity of establishing a safety management system for the safety of university research laboratories, including not only science and technology departments, but also arts and humanities and social studies laboratories, is increasing. university laboratory accidents should apply to all laboratories, including the arts and physical arts department, but current Act on the Establishment of Safety Environment in Laboratory are limited to science and engineering.
Therefore, it is urgent to expand the scope of application of the Law of Act on the Establishment of Safety Environment in Laboratory in order to solve the safety problems and legal problems caused by limiting the application of the Act on the Establishment of Safety Environment in Laboratory to the science and technology laboratory installed in universities and research institutes. This can be achieved through an extension of laboratory definition rules.
There is also problem that the concept category of person engaged in research activities is unclear, and the scope of research activities is ambiguous.
Directly quoting terms explicitly defined in laws related to science and technology is more consistent with the purpose of the law.
Act on the Establishment of Safety Environment in Laboratory Article 3(Scope of Application) However, this has a scope of coverage and relations with other laws in one article. This is a mismatch of system legitimacy. Therefore, the provisions on scope and relations with other laws will have to be revised as separate independent clauses.
In terms of operational improvement, only the science and technology field laboratories are separately managed. As a result, safety blind spots have occurred and systematic safety management has not been achieved. It is necessary to establish an integrated management and cooperation system for university and research institution safety related laws. Therefore, there is a need for safety management of universities and research institutes through powerful control towers.
Inter-ministerial council arrangement can be an alternative. In addition, it is also necessary to establish and operate a comprehensive management system that extends safety management to people and the environment, which has been focused only on the safety of the laboratory.
The fundamental improvement is the establishment of the right to constitutional security. The right to security means 'the right to fully preserve its constitutional interests from risk'. Prompt establishment of the right to constitutional security is urgent.
