프랑크푸르트시 도시경찰제와 서울시 자치경찰제 도입에 관한 실태분석 (The analysis of implementing the Frankfurt city’s city police system and Seoul city’s municipal police system)

초록

본 연구에서는 독일 프랑크푸르트시 도시경찰제의 운영현황과 법적토대, 직원의 기본교육 및 직무영역 등을 고찰하고 서울시가 향후 도입할 예정인 자치경찰제의 계획과 직무영역의 방향에 관한 실태를 분석해 보았다. 본 주제의 실태분석을 통해 확인된 내용들은 다음과 같다. 첫째, 프랑크푸르트시 도시경찰은 2004년 헤센주 경찰법의 개정에서 비롯되었는데, 자치단체의 질서공무원들이 점차 일반집행경찰에 가까운 직무를 수행하게 되면서 이들이 경찰의 명칭을 사용할 수 있도록 했다. 처음에 이들은 보조경찰, 질서경찰, 안전경찰, 질서공무원으로 불리어지다가 2007년부터 최종 도시경찰로 명명되었다. 도시경찰에게는 일반형사범죄의 예방과 수사업무가 불허되며, 공공의 안녕과 질서에 연계된 대부분의 직무를 수행한다. 즉 쓰레기 무단투기, 사행성 행위, 위생, 영업, 환경, 소음 업무 등 이른바 협의의 행정경찰사무가 핵심이다. 도시경찰 선발자는 약8개월간 900시간의 경찰기본교육도 받으며 집행경찰과 유사한 푸른제복과 순찰차, 오토바이 및 자전거로 순찰활동을 한다. 이들은 얼른보기에 서울시 민생사법(특별사법)경찰들과 거의 동일하다. 향후 서울시 자치경찰제 도입시에 법적인 토대만 마련된다면 현재 서울시 특별사법경찰들에게 제복을 착용시키고 현행 특별사법경찰 직무를 수행하도록 하는 것도 가능하다고 평가된다. 둘째, 서울시는 2017년 1단계로 공청회와 추진기구를 설치한 후 2019년 2단계로 조례제정과 시범실시를 거쳐 2020년 서울 광역자치경찰제를 도입 추진할 예정인데, 문제는 조례를 통해서도 가능한지 또는 단일 서울시 자치경찰법을 제정해서 시행해야 하는지 여부가 중요한 과제 중 하나다. 셋째, 단일 자치경찰법이든 조례이든 간에 시민들을 대상으로 한 공청회가 필요하고, 동시에 추진력을 얻기 위해 자치경찰전문가, 학계, 시민단체, 언론 등이 참여하는 세미나를 지속적으로 개최하면서 그 도입의 당위성과 필요성을 지속적으로 부각시켜 나갈 필요가 있다.
본 연구는 이러한 실태분석을 토대로 향후 서울시 광역자치경찰제 도입에 있어서 풀어 나가야 할 법적토대의 구축 등 일련의 과제들과 연구방향에 대해 제언하였다.

In this research, we will analyze the operation status of the Frankfurt city’s city police system , (Germany) and legal background, the basic education of the employee and the work field and further analyze on planning the municipal police system that Seoul city will try to implement and where the work field is heading toward. The status quo of this research is like the following. First of all, Frankfurt city’s city police system started from the amendment of the Hesse’s police law in 2004, and the self governing body’s civil servants steadily practiced the work of the police executive, so they were able to be so-called police officer. For the first time, they were called as auxiliary police, public order police, public order civil servant and by 2007 they were called city police. The city police is not able to practice the prevention of criminal law and investigation and most of the works aim for the security of the public. This means that the police officer’s work include cleaning up the illegally thrown away trash, hygiene, gambling action, sales, environment, loud noise related work. The people that are chosen as city police needs to spend 8months (900hours) of basic police education, wears the same blue uniform as the police officer, practice patrol activity such as looking out for motorcycle and bike. These people are very similar to the Seoul city’s special judicial police. In the future, if the seoul municipal police system is implemented, under the current law system, the seoul special judicial police needs to wear uniform and practice the special judical police work. Moreover, seoul city has established public hearing and promotion organization in 2017 as a first phase, and by establishing the ordinance and implementing the model in 2019 as a second phase, is likely to finally implement the seoul municipal police system in 2020. However, we are not sure if it is possible by ordinance or if the Seoul muncipal police law could be enacted and practiced in reality. Lastly, whether it is a municipal police law or the ordinance, the public hearing is needed for the citizen and in order to gain momentum of the local police professionalist, studies, civil organization, and the press needs to constantly host seminar to constantly convince the necessity of the system. In this research through the analysis of the current situation, we tried to give suggestion about the task and the direction of the research related to the legal establishment of the Seoul city’s municipal police system.
