형사증거법상 진정성 입증(authentication)의 체계적 의미에 관한 연구 -형사소송법의 해석론과 관련하여- (A Study on the Authentication in Criminal Evidence)

초록

이 글은 미국 연방증거규칙(이하 “FRE”라 한다)상 진정성 입증(authentication)을 입법과 해석을 통해 형사소송법에 도입하고자 하는 논의에 대하여 다룬 것이다. 최근 형사소송법의 해석에서 증거의 진정성 내지 진정성 입증은 ‘증거법의 일반원칙’으로 불리며 주목받고 있다. 학설은 진정성 입증을 전문법칙의 예외인정 요건, 증거동의나 탄핵증거 등과 같은 증거법의 일반적인 문제에서부터 전자증거와 관련한 특수한 문제들까지 광범한 영역에 걸쳐 논하고 있다. 대법원도 전문예외 요건과 진정성 입증의 문제를 분리하고 있으며, 특히 2007년 일심회 판결과 2013년 왕재산 판결에서는 ‘전자증거’의 ‘동일성’내지 ‘무결성’을 전문예외 요건과는 다른 차원에서 다룬 바 있다. 여기에서 그 논의의 중심에 있는 것은 전문법칙의 예외인정을 위한 요건인 ‘성립의 진정’(형사소송법 제312조·제313조, 이하 “진정성립”이라 한다)과 진정성 입증의 관계이다. 특히 FRE의 진정성 입증은 그입증방법이 다양하고 자유롭기 때문에 형사소송법이 엄격하게 정하고 있는 전문예외 요건의 제한적 해석을 완화할 가능성이 있다는 점에서 주목되고 있다. 이 글에서는 진정성 입증과 관련된 국내 학설을 진정성립 요건을 중심으로 개관하고(Ⅱ), FRE의 진정성 입증을 검토하면서 관련되는 부분에서 국내 학설의 논의에 대해 비판적으로 검토하였다(Ⅲ). 진정성 입증은 어떤 증거방법이 증거제출자가 주장하는 바의 그것이라는 것, 곧 진정성(authenticity)을 입증하는 절차라는 점에서 진정성과 구별된다는 것을 논의의 출발점으로 삼았다. 또한 결론으로서 FRE의 진정성 입증과 분리된 독자적인 진정성 개념을 귀납적으로 발전시켜 나갈 필요가 있음을 강조하였다.

영어초록

This article deals with the ‘authentication’ in Section 901(a) of U. S. Federal Rules of Evidence (hereinafter “FRE”) and its relationship with the evidentiary process and system in the Korea Criminal Procedure Act (hereinafter “KCPA”). The Supreme Court of Korea has recently introduced the concepts of ‘identity’ and ‘integrity’ in the cases of digital evidence, as requirements for admissibility of evidence, apart from the hearsay exceptions. In the meanwhile, some scholars argue that, before adopting this concepts of ‘identity’ and ‘integrity’ of evidence by the Supreme Court, the requirements of ‘authentication’ should have already been introduced into the KCPA. Other scholars are also of opinion that the ‘authentication’ in FRE and the “authenticity in formation of the protocol“(art. 312, 313, hereinafter ”authenticity in formation“) of KCPA, as one of the hearsay exception requirements, be either the same or at least similar in their function, since the requirement of ”authenticity in formation“ must be established before it might be received into evidence. The main topic of these arguments is the ”authenticity in formation,“ which means that the protocol is written with the same correctness as the out-of-court-statement of the accused and without any omission therein. This research starts from the very idea that the ‘authenticiy,’ the genuineness of a item of evidence what it purports to be, and ‘authentication’, the process of examining the genuineness of evidence, are not one and the same. In conclusion the followings are emphasized: first, the “authenticity in formation” should be distinguished from the ‘authentication’; secondly, the court and scholars be careful not to overestimating the usefulness of introducing the ‘authentication’ into the interpretation of KCPA; and finally the ‘authenticity’ should be developed in a inductive manner from the experience in Korean criminal procedure.
