초록

2000년 이전의 교육과 관련된 헌법재판소의 판례는 대체로 소극적이고 보수적인 경향을 띠고 있다. 교육제도에 대한 국가의 간섭과 규제에 대해 교육의 공공성을 이유로 들어 그 합헌성을 주장하고 있으며, 대학의 자주성과 자율성은 국립과 사립대학의 구별 없이 모두 국가와 대학재단의 통제에 의해 그 의미를 잃고 있음을 알 수 있으며, 특히 교원의 지위와 권리는 학생의 수학권 보장을 이유로 축소되고, 교육의 공공성과 국민에 대한 봉사자의 지위에서 헌법상의 기본권이 제한되거나 금지되는 경향을 보여주고 있다.
반면에 2001년도 이후의 헌법재판소판례는 그 이전의 판례들보다 동일한 문제에 대해 진보적이고 적극적인 해석의 경향을 보이고 있다.

영어초록

Cases of the Constitutional Court relating to the previous year of 2000 is tinged largely passive and conservative tendencies. For the countries of interfering with the regulation of the education system, they argue constitutionality that contains reasons of the public nature of education and we can seen that all to lose its meaning of Independence and autonomy of the university without distinction of national and private universities by control of the state and the University Foundation.
In particular, the status and rights of teachers was reduced to guarantee by the reason of student's right to learn. The constitutional rights have been restricted and banned in the position of servants of the nation’s and public good in education.
Whereas the Constitutional Court's case since 2001 has been a progressive and aggressive interpretation of the same issues than those of previous precedents. For example, it describes a right of school participation and guarantee of local self-education of the parents positively in the interpretation of the provisions conference install mandatory on the private school in1999 and completely different from the previous time.
