규제심판제도의 정책적 의미와 탐색적 평가:「기계설비법」의 기계설비 유지관리제도를 중심으로 (Policy Meaning and Exploratory Evaluation of Regulatory Trial System: Focusing on the Case of Trial to the Mechanical Equipment Act)

초록

본 연구는 2022년 8월 첫 시행된 새로운 형태의 규제혁신 제도인 「규제심판」제도를 평가하고 제도적 발전 가능성을 탐색하는 데 목적을 두었다. 이를 위해 본 연구는 ‘기계설비법 유지관리기준 및 적용 범위’ 규제에 관한 심판사례를 선정하여 그 진행과 결정 과정을 중심으로 분석하였다. 사례연구를 위한 분석틀은 규제형성 과정을 중심으로 규제혁신에 영향을 주는 요소들을 도출하여 구성하였다. 우선 국내 규제 환경을 주는 국제규범환경과 규제 이해관계자 중 규제심판 요구자와 주관부처를 중심으로 논쟁 흐름을 따라가는 연구 설계를 하였다. 여기에 「규제심판」제도의 특징 중 하나인 국민참여(의견)을 중요 변수로 추가하였고, 이를 심판하는 「규제심판」플랫폼을 그 중심에 설정하고 분석하였다.
연구 결과를 통해 규제심판의 역할을 확인 할 수 있었다. 그 결과 기계설비법의 법목적성을 침해하지 않는 선에서 규제 적용의 유예를 판결함으로써 피규제기관은 규제수용을 위한 준비 시간을 확보하고, 규제기관은 국민경제 부담을 완화할 수 있는 규제유예안을 제시 함으로써, 실질적인 국민경제 부담 완화가 발생할 수 있는 정책 변화를 이끌었다. 이와 같이 우리나라에서 첫 시도되는 「규제심판」제도는 그 운용에 있어 그 성과를 낼수 있는 규제혁신 제도로 평가할 수 있다. 특히 그동안 정부 중심으로 진행된 규제혁신이 아닌 민간 중심의 규제혁신 방안이라는 점과 국민이 직접 규제혁신을 요구하고 그 과정에 참여할 수 있는 제도라는 점에서 분명 그 특징과 장점이 있다고 본다. 특히 정부에서 추진하고 있는 열린 정부 플랫폼 정부의 기조에도 부합하는 규제혁신 방안이라는 점에서 점차 활성화해야 할 제도로 평가할 수 있다.

영어초록

The purpose of this study is to evaluate the 「Regulatory Trial」 system, a new type of regulatory innovation system that was first implemented in August 2022, and to explore the possibility of institutional development. To this end, this study selected the case of judgment on the regulation of the 'Machine Facility Act Maintenance Standards and Scope of Application' and analyzed its progress and decision process. The analysis framework for case studies was constructed by deriving factors that influence regulatory innovation, focusing on the regulatory formation process. First of all, the research design that follows the flow of controversy was focused on the international normative environment that gives the domestic regulatory environment and the regulatory stakeholders, centering on the regulatory trial requestor and the competent ministries. To this, public participation (opinion), one of the characteristics of the 「Regulatory Trial」 system, was added as an important variable, and the 「Regulatory Trial」 platform to judge it was set at the center and analyzed.
The research results confirmed the role of the regulatory trial. As a result, by ruling the suspension of the application of regulations without infringing on the legal purpose of the Machinery and Equipment Act, the regulated institution secured time to prepare for regulatory acceptance, and the regulatory agency presented a regulatory deferral plan to ease the burden on the national economy, leading to policy changes that could lead to substantial easing of the national economic burden. As such, the Regulatory Trial system, which is first attempted in Korea, can be evaluated as a regulatory innovation system that can achieve results in its operation. In particular, it has its characteristics and advantages in that it is a private-centered regulatory innovation plan rather than a government-centered regulatory innovation that has been conducted so far, and that it is a system that allows the people to directly demand regulatory innovation and participate in the process. It can be a system that should be gradually activated in that it is a regulatory innovation plan that is consistent with the government's open government platform.
