연안여객선 안전공영제 도입을 위한 정책적 제언 (A Study on Policy Measures for the Introduction of Safety Public Service System of Coastal Passenger Ships)

초록

세월호 참사 이후 연안여객선 안전증진을 위하여 관련 법령의 정비, 운항관리자 제도 혁신 등 다양한 물적 인적 규제의 강화와 재정적 지원제도가 마련되었다. 그러나 이러한 많은 제도적 개선과 재정적 지원 결정에도 불구하고 연안여객선의 안전운항은 보장되지 않고 있다. 이 연구는 연안여객선의 안전운항을 보장하기 위한 하나의 유력한 방안을 모색하기 위하여 수행하였다. 연구의 결과 “연안여객선 안전공영제 도입의 필요성은 있다.”라는 결론을 도출하였다.
이 연구에서 제안하는 안전공영제는 연안여객선을 이용하는 ‘국민의 안전을 증진’하고 ‘국민의 이동권을 증진’하기 위하여 국가가 그 비용의 일부 또는 전부를 부담 또는 지원하는 제도이다.
안전공영제를 위해서는 별도의 특별법을 제정하는 것이 필요하다. 그 이유는 첫째, 개별법령들을 조금씩 고쳐 근거 규정을 만드는 경우 입법목적이 정확하게 드러나지 못하고 결국 현실에서는 제대로 작동하지 못할 가능성이 크다. 특별법을 통해 ‘안전공영제’의 입법 취지와 목적을 분명하게 선언하는 과정이 필요하다.
둘째, ‘안전공영제’는 정확한 정의가 필요한 개념이 많다. ‘안전’, ‘안전공영제’, ‘안전비용’ 등의 개념은 사회학적으로 그 의미가 설명될 수 있지만, 법률적으로는 정확한 개념의 정의가 필요한 용어이다. 따라서, 기존 해운법, 항만법 등에서 별도의 용어 정리를 하지 않는 이상 개별 조문에 갑작스럽게 등장하게 되면 제대로 해석되지 못하거나, 시행령이나 시행규칙에서 협소하게 축소될 위험도 크다. 특히, 예산을 수반하는 항목의 경우에는 법에서 그 대상 범위를 분명하게 정하지 않으면 사실상 무의미한 개념이 될 가능성이 크다. 별도의 특별법에서 개념 정의를 분명하게 할 필요가 있다.
셋째, 4.16 세월호 참사에 대한 진지한 성찰과 개인의 안전할 권리를 보장하는 국가의 헌법상 의무가 강조된 최근 헌법 개정 논의의 연장선에서, 국가의 구성요소인 국회와 정부가 국민의 안전보장 의지를 대내외적으로 분명하게 선언하고, 나아가 안전한 사회를 위한 국가의 책임을 충실하게 이행한다는 것을 보다 분명하게 한다는 관점에서도 개별법 개정보다는 연안여객선 ‘안전공영제’ 도입을 위한 특별법 제정이 타당한 방안이라고 생각한다.
이 제도를 시행하는데 소요되는 예산은 연간 약 241억 원이다. 안전한 연안여객운송 체계를 만들어 단 한 건의 대형 연안여객선 참사를 막을 수 있다면 그만한 충분한 가치가 있다는 점에서 연안여객선 안전공영제 등은 반드시 추진되고 실천되어야 할 과제이다.
오늘날 국민의 안전권을 확보하는 일은 국가의 책무 중에서도 가장 우선되어야 할 위치에 있는 역할로서 인식되고 있는 만큼, 연안여객선의 안전운항 증진을 위한 연안여객선의 안전공영제 도입과 그 시행을 위하여 소요되는 국가의 재정적 지원은 세월호 참사에 대한 국가의 책무를 이행한다는 측면에서 그 의의가 있다고 생각한다.

영어초록

After the Sewol Ferry disaster, various physical and human regulatory framework such as revision of related laws and regulations and innovation of operation manager system have been strengthened and financial support system were prepared to improve the safety of coastal passenger ships. However, despite many of these institutional improvements and financial support decisions, the safe operation of coastal passenger ships is not guaranteed. This study was carried out to find one promising way to ensure the safe operation of coastal passenger ships. As a result of the study, it was concluded that “there is a need for the introduction of Safety Public Service System of Coastal Passenger Ships.” The Safety Public Service System proposed in this study is a system in which the government bears or supports some or all of the costs in order to ‘promote the safety of the people’ and ‘promote the people’s right to move’ using coastal passenger ships.
Thus, it is thought that there is a need to enact a separate special law for the Safety Public Service System. The reason for this is first, where relevant individual laws and regulations are revised little by little to make the legal base, there could be a great possibility that the legislative purpose would not clearly come out and it would not work properly in reality. Therefore the process of clearly declaring the legislative purpose and the purpose of the ‘Safety Public Service System’ through enacting a special law is necessary.
Second, there are many concepts needing an accurate definition thereof in the ‘Safety Public Service System’. Concepts such as 'safety', 'safety public service system', 'safety cost', etc. can be sociologically explained, but legally, these are terms requiring precise definition. Therefore, unless relevant terminologies are separately arranged in the existing Marine Transportation Act and Harbor Act, etc., when they suddenly appear in individual articles, there is a great risk that they may not be properly interpreted or narrowly reduced in the enforcement decree or ordinance.
In particular, in the case of items accompanying the budget, and the scope of the subject is not clearly defined in the law, it is highly likely to become meaningless concept in reality. Thus, it is necessary to clarify the definition of the concept in a separate special law.
Third, in the extension of the recent discussion on constitutional amendments, which emphasized the state's constitutional obligations to ensure individuals' right to safety, the National Assembly and the government, which are components of the state, should clearly declare their willingness to ensure safety of the people internally and externally.
Furthermore, from the point of view of making it clear that the State is faithfully fulfilling its responsibility for a safe society, it is thought that enacting a special law for the introduction of the ‘Safety Public Service System’ of coastal passenger ships rather than revising individual laws is a more reasonable way.
The budget required to implement this system is approximately KRW 24.1 billion per year. By creating the Safety Public Service System it is worth implementing and enforcing in the viewpoint of a single large-scale coastal passenger ship disaster can be prevented.
Today, securing the people's right to safety is recognized as a role that should be given the highest priority among the national responsibilities.
Therefore, it is thought that the introduction of the Safety Public Service System to promote the safe operation of coastal passenger ships and the national financial support required for its implementation are meaningful in terms of fulfilling the national responsibility for the Sewol Ferry disaster.
