특허의 선사용권제도 개선방안에 관한 고찰 (A Consideration of the Improvements of Patent’s Prior User Rights Institution)

초록

특허발명과 동일한 발명을 그 특허출원 전부터 타인이 선의로 실시 등을 하고 있는 경우, 그 실시자에게 일정한 범위 내에서 특허발명을 무상으로 실시할 수 있게 하는 통상실시권이 인정되는데 이를 선사용에 의한 통상실시권이라고 한다. 이러한 선사용권제도는 선출원제도를 채택하고 있는 현행 특허제도하에서 가장 빠른 출원에 특허권을 부여한다는 형식상의 결함을 보완하기 위한 취지에서 도입되었다.
선사용권 제도는 선출원주의에 의한 선발명자의 손해를 감소시켜 공평의 원칙에 부합하고, 방어출원의 남용을 줄일 수 있으며, 새로운 기술분야에 대한 연구개발의 투자를 높일 수 있는 장점이 있다. 그러나 발명의 공개를 통한 산업발전을 목적으로 하는 특허제도의 기본질서를 저해시킬 수 있고, 특허출원에 의해 특허권이 등록되어도 선사용권에 따른 제한이 따르기 때문에 특허가치가 감소할 수 있다.
선사용권에 관한 주요 국가의 입법례와 경향을 살펴보면 일본은 선사용권의 이용이 매우 활발하며, 미국은 2011년 특허법 개정을 통하여 선사용권을 주장할 수 있는 발명의 범위를 전 기술범위로 확장하였다. 또한 유럽 대다수의 국가들은 선출원주의의 단점을 보완하기 위해 오랜 전부터 특허에 대한 선사용권제도를 마련하였다. 즉, 세계 선진국의 선사용권제도에 대한 관점은 긍정적이며, 선사용권의 장점이 부각되고, 재조명되고 있는 추세이다.
세계 선진국의 선사용권에 대한 긍정적인 관점과 비교법적 균형을 맞추기 위해 우리나라의 현행 선사용권제도의 개선이 필요하다. 특허법 제103조에 의해 선사용권을 주장하기 위해서는 국내에서 ‘사업의 실시 또는 준비’를 요구하고 있는데, 개선방안으로는 이러한 선사용권의 성립요건을 완화시키는 방법이 있다. 특허법 제103조에 규정되어 있는 ‘사업의 준비’를 넓게 해석하여 그 발명의 내용을 실시하기 위해 계획하는 직･간접적 준비행위를 포함하는 것으로 해석을 한다면, 유럽의 일부국가에서 선발명만으로 선사용권이 인정되는 경우와 비슷한 효과를 나타낼 것으로 예상된다.
선사용권의 성립요건을 완화시키기 위한 다른 방안으로는 특허법 제103조에서 규정하고 있는‘사업의 실시 또는 준비’요건을 삭제하는 방법도 있다. ‘사업의 실시 또는 준비’요건을 삭제한다면 사실상 선발명자에게 선사용권을 인정하는 것이 되기 때문에 선사용권이 인정될 여지가 매우 넓어지게 된다. 선사용권의 성립요건을 완화시킨다면 선사용권을 확보하기 위한 불필요한 형식적인 사업의 준비를 할 필요가 없고, 사업의 준비를 확인하기 위한 입증의 노력과 비용도 절감할 수 있다.
즉, 선사용권제도의 개선방안으로 선사용권의 성립요건인 ‘사업의 준비’를 넓게 해석하거나 ‘사업의 실시 또는 준비’요건을 삭제한다면 국내 기업들의 경쟁력을 높이고 산업발전을 이룰 수 있는 계기가 될 것으로 생각한다.

영어초록

If the invention same as patent is conducted by other’s good will before the patent application, non-exclusive license that lets the conductor conduct patent invention for free within a certain range is recognized and it is called as non-exclusive license institution by prior use. The prior user rights institution was introduced to supplement flaws of the form providing patent rights to the rapidest application under the current patent institution adopting prior application institution.
The prior user rights institution reduces loss of prior inventor by prior application institution, accords with the principle of equity, reduces abuse of preventive application, and improves investment of research and development to new technological field. However it may deteriorate basic order of patent institution purposed to development the industry through publicity of invention and has limits by prior user rights although patent rights are registered by the application, so the value of patent may be reduced.
If examining the legislation cases and tendency of main countries by prior user rights, Japan uses prior user rights very actively and America expands the range of invention to insist prior user rights to the whole technological range through the revision of patent law in 2011. In addition, prior user rights institution for patent has been prepared so as to supplement weaknesses of prior user rights in lots of European countries for a long time. In other words, the viewpoint of advanced countries toward prior user rights institution is positive and the strengths of prior user rights tend to be focused and reviewed.
For comparative balance with positive viewpoint toward prior user rights of advanced countries, it’s necessary to improve current prior user rights institution of our country. To insist prior user rights in accordance with Article 13 of patent law, it’s required to ‘fulfill’ or ‘prepare business’ in Korea. For the improvement, there is a method to relieve requirements for establishing prior user rights. If including direct･indirect preparations planned for the interpretation to fulfill the contents of the invention by interpreting ‘business preparation’ regulated in Article 103 of patent law widely, it’s expected to show similar effects with the cases recognizing prior user rights with only prior invention in some European countries.
For another method to relieve the requisitions for establishment of prior user rights, it’s to delete requisitions of ’business fulfillment and preparation’ regulated in Article 103 of patent law. If deleting requisitions of ‘business fulfillment or preparation’, it means actual recognition of prior user rights to prior inventors, so possibilities to recognize prior user rights are widened so much. If relieving requisitions of the establishment of prior user rights, it is not necessary to prepare unnecessary preparation of formative business so as to secure prior user rights and reduces efforts and costs of the verification to confirm business preparation.
In other words, as the improvements of prior user rights institution, if interpreting ‘business preparation’, the requisitions of the establishment of prior user rights, widely, or deleting requisitions of ‘business fulfillment or preparation’, it should be an opportunity to improve competitiveness of domestic companies and achieve industrial development.
