초록

인터넷은 항상 곁에 있는 일상생활의 일부분처럼 느껴진다. 이러한 인터넷사용자의 폭발적인 증가는 법환경도 크게 바꾸고 있다. 특히 방대한 자료를 가지고 인터넷에서 접속자들을 유지 및 관리하는 인터넷서비스제공자들은 저작권분야에 민감하다. 인터넷에서 명예훼손, 사기 등의 범죄가 발생하기도 하지만 대부분은 저작권침해이다. 인터넷서비스제공자에게 저작권침해는 동전의 양면과 같다. 더 많은 접속자를 유치하기 위해 양질의 콘텐츠를 저렴한 비용으로 제공하는 것이 사업의 중요한 무기이자 자신들을 옥죄는 쇠사슬이 되고 있는 것이다. 인터넷사용자들이 저작권을 스스로 보호하고 정당한 저작권료를 지불하겠다는 생각이 있으면 간단히 해결되지만 현실은 정반대로 가고 있다. 특히 청소년들의 저작권침해는 심각한 사회문제를 야기하고 있다.
범죄를 저지르면 처벌받는 것이 당연하지만 인터넷환경에서 저작권침해는 대부분 젊은세대 특히 청소년이나 대학생들이 많은 부분을 차지하는 현실에서 법적용의 묘미를 살려야한다. 인터넷에서 저작권을 침해하는 사용자들은 죄책감이 거의 없다. 그래서 저작권관련기관의 홍보와 계도는 실효성을 얻기 어렵다. 경찰이 저작권교육에 참여하여 범죄라는 것을 적극적으로 알린다면 청소년의 저작권침해는 크게 감소할 것으로 예상된다. 또한 저작권관련기관, 청소년단체, 온라인서비스제공자, 경찰의 유기적인 협력을 통해 해결방안을 모색할 필요가 있다. 기존에는 경찰이 적극적인 참여를 하지 않았다. 앞으로는 인터넷홍보 등에 경찰이 직접 참여할 필요성도 있다.
일부 저작권자들의 과도한 합의금요구에 일부 경찰이 활용하고 있는 즉심제도로 대응하는 것도 현실적인 어려움이 없는 것은 아니지만 실효성이 있다. 지나친 합의금의 요구로 극단적인 선택을 하는 어린세대에게 경찰이 범죄라는 사실을 알리고 처벌은 하되 일종의 보호막이 되어줄 수 있는 효과적인 방안이다.

On the internet today, copyright protection issues are increasingly taking center stage while the legal systems scramble to keep up with the ever changing face of the web. The average net users are not likely to know or understand the basic tenets of copyright law, and there seems to be a consensus amongst many that anything found on the internet falls under the ‘public domain' category.
Intellectual property rights and the web are newsworthy topics. Service providers and suppliers take firm stance against infringers and counterfeiters, yet they tend to be indulgent or lenient about its security countermeasures. Fear of loss — losing potential customers, losing ground to competition, losing multiple simultaneous logins - plays a greater motivating factor. Arguably, copyright Infringement is often considered a “two-sided coin". It probably is the best proven business marketing strategy, which does not necessarily equal profit.
Typically -- and unfortunately --, the group most directly and adversely affected by piracy on the internet are the ‘tech-high' younger generation. There are no guilt, no morality in belief, no remorse, no crime in their mind when it comes to the internet.
So, what might be a desirable course of action for deterring ‘piracysm'? As we have seen, the ‘anti-internet piracy campaign' delivered by copyright owners group had little or no effect, since the targeted groups - the ‘Pirate Party' - would simply deny illegal acts in which they are involved.
Some anti-piracy content identification and filtering technologies may play a useful role in deterring piracy in some limited cases. Imposition of broad anti-piracy content identification and filtering technological requirements by administrative fiat might also be very soothing, but they are not a ‘silver bullet' solution to piracy. Rather, addressing piracy effectively requires ongoing inter-organizational collaborative efforts: ‘copyright holders,' ‘youth groups,' ‘web service providers' and ‘the police.' The law enforcement agency, which were reluctant to take more effective action, must assume bigger role in public relations campaign. To effectively deter illicit ‘downloading' and more importantly, ‘uploading,' all responses must be able to find representation in the collective unit circle.
