난민법상 인도적 체류허가 거부의 처분성 (Judicial Review of the Refusal to Issue a Humanitarian Stay Permit under the Refugee Act)

초록

인도적 체류허가는 한국 난민법이 실제로 제공하고 있는 보호의 상당 부분을 차지한다. 인도적 체류허가의 발급 여부는 별도의 절차에서 심사되는 것이 아니라 난민인정절차나 이의신청절차에서 난민신청이나 이의신청과 함께 판단한다. 위와 같은 절차 구조로 인해 최근 하급심에서는 인도적 체류허가 거부가 항고소송의 대상인 처분인지를 두고 판단이 엇갈리고 있다. 이 글에서는 인도적 체류허가 거부의 처분성이 인정되어야 한다는 주장을 전개하였다. 그 근거는 다음과 같다.
첫째, 난민법 입법과정에서 당초의 제정안을 변경하여 난민인정절차 내에서 인도적 체류허가 여부를 판단하도록 한 이유는 인도적 체류허가에 대한 신청권을 부정하기 위한 것이 아니라 신청자의 절차 선택의 위험을 줄이기 위한 것이었다. 그러므로 신청권을 부정하겠다는 입법자의 의사를 도출할 수 없고, 사법심사를 배제하고자 하는 의사 역시 찾아볼 수 없다. 여러 나라의 예에서 보듯이 단일절차에서도 보충적 보호에 대한 사법심사가 보장될 수 있고 보장되어야 한다.
둘째, 인도적 체류허가 제도는 국가의 시혜적인 입법재량에 기초하여 창설된 것이 아니라, 국제인권법상의 보호의무를 이행하기 위한 수단으로 입법된 것이다. 국제인권법상의 보호의무는 그 침해에 대한 효과적인 구제수단을 보장할 것까지 포함한다. 인도적 체류허가에 대한 신청권을 부정하여 사법통제에서 전면적으로 배제하는 것은 실질적으로 행정부의 무제한적인 재량을 인정하는 것으로서 국제인권협약상의 보호의무 및 이를 국내법으로 이행하고자 한 입법자의 의사에 배치된다.

영어초록

Humanitarian stay permits account for a significant part of the protection provided by the South Korean Refugee Act. Whether a humanitarian stay permit should be issued is not judged through a separate procedure, but through the refugee status determination or objection procedure together with the application for refugee status or objection. Due to the structure of the procedures described above, judgments on whether the refusal to issue humanitarian stay permits is a disposition, which is a subject of appeals suits, are in disagreement in lower instances. In this article, an argument that the refusal to issue humanitarian stay permits is a disposition was developed. The rationale is as follows.
First, the reason the original legislative proposal was changed to judge whether to issue humanitarian stay permits within the refugee status determination procedure in the process of legislating the Refugee Act was not to deny the right to apply for a humanitarian stay permit but to reduce the risk that applicants make the incorrect or unpreferred choice. Therefore, the legislator's intention to deny the right to apply cannot be derived from the legislative process, nor can any intention to exclude judicial review be found in it. Judicial review of complementary protection can and should be guaranteed even in a single procedure, as shown in the examples in many countries.
Second, the humanitarian stay permit system was not created based on the legislative discretion of the state but was legislated as a means to fulfill the obligation to protect under international human rights laws. The obligation to protect under international human rights laws also includes ensuring effective remedies for infringement. The denial of the right to apply for a humanitarian stay permit to exclude the right from judicial control is to recognize the unlimited discretion of the executive and is contrary to the obligation to protect under the CAT, ICCPR, etc. and the will of the legislator to implement the foregoing in domestic laws.
