헌법상 국가-지방자치단체간재정권 비교 시론 (A Comparative Study on the Financial Rights between the Central-Local Government in Constitutional Arrangements)

초록

우리 헌법 제59조는 조세부과와 징수에 있어서 지켜야할 기본원칙으로서 조세의 종목과 세율을 법률로 정하도록 조세법률주의를 규정하고 있다. 조세법률주의를 엄격하게 해석하여 지방세의 종목과 세율까지도 국가가 입법 정책적으로 정하는 것으로 운영하고 있다. 이는 국가가 지방자치단체의 재정권까지도 중앙집권적인 체제로 관리하고 전국적․일률적으로 통제해 왔음을 의미한다.
현행법이 정하고 있는 조세법률주의를 엄격히 적용할 경우 법적으로는 과세자주권이 약화되는 상관관계가 제도적인 문제점으로 지적될 수 있다. 따라서 이러한 문제를 방지하기 위해 지방정부의 과세자주권을 공고히 할 수 있는 법체계의 마련이 필요하다고 할 것이다.
이를 위해 외국헌법 사례를 검토한 결과, 우리의 헌법상 지방재정권과 관련해서는 다음과 같은 개혁이 필요하다. 첫째, 조세의 가격기능을 회복하기 위하여 국세법률주의, 지방세조례주의를 헌법에 반영할 필요가 있다. 둘째, 헌법상 중앙정부와 지방자치단체 간 주요세원의 배분을 헌법에 정하여야 한다. 셋째, 지방자치단체가 필요한 소요재원을 헌법상 보장하여야 한다. 넷째, 재정력이 약한 자치단체에 대하여 국가 또는 다른 지방정부가 지원하도록 하는 재정조정제도를 고려해볼 수 있다. 마지막으로, 균형예산 원칙이 규정되어야 할 것이다.

영어초록

This study analyzed the financial provisions written in the Constitution by focusing on the financial rights between central and local government, compared to the other countries’ cases for the possible amendment of the Korean constitution on the matters.
According to the provision of the Constitution which stipulates “no taxation without representation principle”, it is strictly interpreted that local tax items and rates are decided uniquely and strictly on the ground of the legislation the National Assembly enacts in Korea. It means that the financial rights of local government depend in conseqence on the central government decisions derived from the national tax system.
To enhance political and financial decentralization in Korea, therefore, it will be absolutely necessary for local government itself to be given an autonomous legislative procedure in fixing the local tax items and rates for their own sake within the legal boundary permitted by the laws concerned and on the basis of the constitutional provisions.
But the situation mentioned above is not at present of the case in Korea. That is why this study proposes some points of reframing the actual legal system for increasing the local financial powers of local government. From the research results, here are some suggestions as follows: firstly, in order to restore the tax’s price adjusting power, the local tax items and rates should be determined by local government’s ordinance; secondly, it is in the constitution that the principle and procedures of the reallocation of the whole tax sources between central and local government should be prescribed. And, thirdly, the constitution should guarantee the independent financial discretion for local government. Fourthly, a inter-governmental fiscal adjustment and equalization among regions should be considered for the equitable distribution of national taxes. Finally, the principle of balanced budget system should be maintained and rather enacted in the provision of the Constitution.
