비례대표제도의 운영상의 한계와 개선방안 - 헌법상 민주적 정당성의 한계와 대표성 문제를 중심으로 - (Methods of Improvement to Overcome The Operational Limitations of The Proportional Representation System)

초록

한국의 선거제도는 소선구제에 기반한 다수대표제와 정당득표에 기반한 비례대표제를 기본원칙으로 발전해왔다. 우리의 소선구제에 기반한 다수대표제의 경우 선거에서 다수의 후보자가 입후보하여 난립할 경우에 1위의 후보자만 당선되는 승자독식의 선거결과로 이어져 상당한 사표의 문제를 발생시켜왔다. 이러한 다수대표제의 사표의 문제와 단점을 보완하기 위해서 각 정당 득표율에 비례하여 사표를 방지하기 위한 비례대표제로의 발전과정을 거쳐왔다.
비례대표제 운영의 비효율성과 국민의 회의적 시각은 비례대표의원의 공천과정에서 국민의 의사를 배제한 정당의 특정 지배세력의 이익에 부합하는 밀실공천 문제, 직능대표제의 합리적 분배의 실패, 선거인과 국민대표의 괴리현상 등 제대로 된 국민의사 반영의 불충분 등에 기인하고 있다고 볼 수 있다. 국민다수는 비례대표제도의 운영에 있어서 상당히 회의적 시각을 가지고 있다.
비례대표제도의 운영상의 효율성 달성을 위해서는 첫째, 민주적 정당성의 한계극복을 위한 권역별 비례대표제의 도입, 둘째, 지역구 다수대표의 전문성의 확대를 위한 공천심사의 투명성 확보와 비례대표의 전문성의 확대를 위한 직능대표제도의 도입, 셋째, 부실공천의 방지를 위한 국민참여공천제의 도입, 넷째, 표의 가치의 최대화를 위한 독일식 연동형 대표제의 도입시 우리의 정치문화에 부합하는 제도로의 변화가 필요하다.
본 논문에서는 우리 한국에서의 비례대표제의 민주적 정당성의 한계와 문제점을 도출하고 해외국가에서의 비례대표제 운용상의 시사점을 분석하여 향후 한국 선거제도 운영상 비례대표제의 민주적 정당성의 한계극복과 대표성 확보를 위한 개선방안을 제시하고자 한다.

영어초록

Various efforts have been made to efficiently operate the proportional representation system due to operational problems to improve the proportional Korea's election system has developed a majority representation system based on small constituency and a proportional representation system based on party votes as basic principles. In the case of the majority representation system based on our small constituency, if a large number of candidates run and run in the election, only the first candidate is elected, resulting in a considerable problem of resignation. In order to compensate for the problems and shortcomings of the majority representation system, it has undergone a development process to prevent resignation in proportion to the percentage of votes from each party.
It can be attributed to the lack of proper reflection of the will of the people, such as the secret nomination problem that excludes the will of the people in the process of choosing proportional representatives and is in the interests of certain ruling parties. The majority of the people are quite skeptical about the operation of the proportional representation system.
To achieve the operational efficiency of the proportional representation system, first, the introduction of a regional proportional representation system to overcome the limitations of democratic legitimacy, and second, the introduction of a vocational representation system to expand the expertise of majority representatives and proportional representation, Third, in order to secure the expertise of representatives, the introduction of the civic participation nomination system and fourth, to maximize the value of votes, the German-style linked representation system needs to be changed to a system consistent with our political culture.
This paper presents the limitations and problems of the democratic legitimacy of the proportional representation system in Korea, analyzes the implications of the operation of the proportional representation system in overseas countries, and suggests improvement measures to overcome the limitations of the democratic legitimacy and representation in the operation of the Korean election system.
