공유부동산의 분할사례와 담보책임에 대한 연구 (A Study on the Responsibility for Security and Division Case of Joint-Owned Real Estate)

초록

공유부동산이란 하나의 부동산을 2인 이상이 공동으로 소유하는 형태를 말하는데 각 지분권자의 인적결합이 ‘약’(weak)하기 때문에 각 지분권자에게 공유물분할 청구를 자유롭게 인정하고 있다. 그리고 공유부동산의 분할방법은 원칙적으로 협의에 의하여 하여야 하나 협의분할을 할 수 없는 경우에는 법원에 그 분할을 청구할 수 있다(민법 제269조). 그리고 법원은 현물로 분할 할 수 없거나 현물로 분할을 하게 되면 현저히 가액이 감손될 염려가 있는 때에 비로소 부동산의 경매를 통하여 대금분할을 할 수 있도록 하고 있다.
그런데 이러한 공유부동산의 분할에 있어서 다른 지분권자에게 설정된 저당권이나 가압류권 등이 분할 하고자 하는 지분권자의 단독소유권에게 미치게 되므로서 막대한 손해를 당하게 하는 문제가 발생하게 된다.
그래서 우리 민법 제270조는 “공유자는 다른 공유자가 분할로 인하여 취득한 물건에 대하여 그 지분의 비율로 매도인과 동일한 담보책임이 있다”고 규정하여 보호하고 있다. 그러나 공유부동산의 재판상 협의분할에 따른 해제에 대해서는 민법 제270조에 따른 매도인의 담보책임을 부정하고 있어 저당권 등 권리의 제한을 받지 않았던 지분권자가 분할로 단독소유권을 취득하는 경우 보호를 받지 못하는 문제가 발생하게 된다.
따라서 본고에서는 이러한 문제 등을 해결하기 위하여 우선 공유부동산의 분할 사례유형에 대한 문제점을 검토하고 이어서 공유부동산의 분할에 따른 해석론적인 개선방안을 연구함으로써 분할로 단독소유권을 취득한 자와 거래의 안전을 기하고자 한다.

영어초록

A Joint-owned Real Estate is a form in which two or more people own a real estate jointly, but since the personal combination of the equity holders is 'weak', it is free to accept the request for the division of Joint-owned Real Estate.
And in principle, the method of Joint-owned Real Estate shall be done by consultation, and if the shared real estate can not be divided by the consultation division, the court may request the division of the Joint-owned Real Estate(Article 269 of the Civil Act).
In addition, in principle, the division by the court is divided into spots, and it is not possible to divide into spots, or if the division into spots is concerned, the auction of real estate can be ordered only when there is a possibility that the value will be significantly reduced.
However, this division of the shared property results in a problem that results in huge losses because the mortgage or provisional seizure rights set up for other equity holders would be affected by the sole ownership of the equity interests they wish to split.
Therefore, Article 270 of the Civil Code protects by providing that the “equity holder has the same security liability as the seller in the proportion of its division of the goods acquired by the other equity holder”. However, the cancellation of the Joint-owned Real Estate due to the negotiating division of the Joint-owned Real Estate denies the seller's responsibility for security under Article 270 of the Civil Code, which results in a problem that causes a lot of damage to the person who acquires the sole ownership.
Therefore, in order to solve these problems, this present study first examines the problems of the Joint-owned Real Estate division case type, and then to study the analytical improvement plan as a protection measure for the division of the Joint-owned Real Estate to ensure the safety of the transaction with the person who acquired the sole ownership in the division.
