압류・가처분 부동산의 표시・광고에 관한 연구 (A Study on the Indication and Advertisement of Seized and Enjoined Real Estate)

초록

「공인중개사법」제18조의2 제4항 각 호를 위반하여 부당한 표시・광고를 한 경우와 법 제18조의2 제1항 또는 제2항을 위반하여 중개대상물의 중개에 관한 표시・광고를 한 경우, 시행령과 국토교통부장관의 고시에서 각각 부당한 표시・광고의 유형과 명시할 사항을 열거하고 있다.
「부당한 중개대상물 표시·광고행위의 유형 및 기준」에 의하면, 부동산 중개대상물 표시·광고에 있어서 발생하기 쉬운 유형을 예시한 것에 불과하다(고시 제4조)고 하여, 이 고시에 의해 과태료 부과 위반행위가 확대될 가능성이 있다.
이 고시 제5조제2항 제3호에서는 ”압류 또는 처분금지가처분 등으로 처분이 제한되거나 관계 법령에 의해 거래할 수 없음이 명백한 중개대상물에 대한 표시·광고를 한 경우“를 규정하고 있다.
즉 압류 부동산과 가처분 부동산을 “중개대상물이 존재하지만 실제로 중개의 대상이 될 수 없는 중개대상물”의 대표적인 사례로 규정하고 있는 것이다. 그러나 경매 대상으로 압류된 부동산이나 가처분 부동산에 대해 관계 법령 어디에도 거래 자체를 금지하거나 소유자의 처분권한을 박탈하는 규정은 없다.
따라서 압류 부동산과 가처분 부동산은 거래가 금지되거나 처분권한이 절대적으로 제한되는 것이 아님에도 불구하고, 거래금지 및 처분 금지를 전제로 부당한 표시・광고의 유형으로 규정한 것은 법령상의 근거가 없고, 위임입법의 한계를 벗어난 것이다. 압류 부동산과 가처분 부동산의 중개거래는 표시・광고를 금지할 것이 아니라, 표시・광고를 허용하되 그에 관한 적시 내지 설명을 명시하도록 하고, 결국은 공인중개사의 확인․설명의무에 관한 사항으로 처리하여야 한다.

영어초록

The Enforcement Decree of the Licensed Real Estate Agents Act and the Minister of Land, Infrastructure, and Transport's Notice list the types of unjustice indication and advertisement and matters to be specified when unjustice indication and advertisement that violates Article 18-2 (Paragraph 4) of the Licensed Real Estate Agents Act is made or the brokerage of the brokerage object is displayed or advertised in violation of Article 18-2 (1) or (2) of the Licensed Real Estate Agents Act.
The "Types and Criteria for Unjustice Indication and Advertisement of Real Estate Brokerage Objects“ states that these are just a few examples of the most common types of real estate brokerage object indication and advertisement (Notice #4). This notice may expand the list of penaltyable offenses.
Article 5, Paragraph 2 (3) of the Notice stipulates that "the indication or advertisement of a brokerage object is made when its disposal is restricted due to seizing or injunction for the prohibition of disposal or it is clearly not allowed to be traded under relevant laws and regulations.“ In other words, seized and enjoined real estate are stipulated as typical examples of "brokerage objects that exist but cannot actually be the subject of brokerage". However, no provision in the relevant laws on seized real estate subject to being auctioned off or enjoined real estate prohibits the transaction or deprives the owner of the right to dispose of the property.
Therefore, stipulating seized or enjoined real estate as an unjustice indication and advertisement type on the premise of prohibition of transaction and disposal, although stipulating seized and enjoined real estate is not prohibited from being traded or the right to dispose of it is not absolutely restricted, has no basis in the law and is beyond the limits of delegated legislation. The indication and advertisement of the brokerage transactions of seized or enjoined real estate shall be allowed, not prohibited, and it shall be handled as a matter of disclosure, explanation, or confirmation and explanation obligations of a licensed real estate agent.
