과거사 청산 입법의 위헌성 (Unconstitutionality of Legislation to clear up Past history)

초록

헌법 제13조는 소급입법에 의한 형사처벌, 재산권 박탈, 참정권 박탈을 금지한다. 2004년 제정된 반민족규명법과 2005년 제정된 친일재산귀속법은 전형적인 소급입법이다. 1948년 건국 이후 우리 사회는 반민족행위처벌법에 의하여 반민족행위자에 대한 형사 처벌, 재산 몰수, 공무원 임명 제한 등의 조치를 취하였다. 반민족행위처벌법은 제헌헌법 제101조에 근거를 두고 소급적인 조치를 시행하였다. 반민족규명법과 친일재산귀속법은 1948년의 반민족행위처벌법에 의한 부역자 처리가 충분하지 못하였다는 판단에서 비롯된 것이다. 반민족규명법에 의한 명예형과 친일재산귀속법에 의한 재산 몰수는 헌법상의 근거가 없다. 그러함에도 헌법재판소는 헌법전문의 ‘3･1운동’ 정신 혹은 ‘임시정부의 법통’을 근거로 반민족규명법과 친일재산귀속법이 합헌이라고 판단하였다. 헌법전문에 과도한 규범력을 부여하고 헌법상의 기본권 규정을 무시하는 식의 이러한 판단은 헌법재판소에 부여된 헌법 해석 권한을 넘는 것이다. 대한민국은 일본과 사이의 교전국이 아니었다, 독일과 프랑스 등 교전국 사이의 과거사 처리와 비교하여 우리 사회의 과거사 처리가 부족하였다는 주장은 맥락에 맞지 않는다. 한편 교전 피해국의 경우에도 시간의 경과에 따라 넓게 사면이 이루어지고 있다. 우리 사회에서는 시간이 경과하면서 오히려 친일반민족행위자의 범위를 확대하는 위험한 사회적 징후마저 보인다. 헌법재판소는 반민족규명법과 친일재산귀속법을 전부 위헌 선언하여야 할 것이다,

영어초록

Article 13 of the Constitution prohibits criminal punishment, deprivation of property rights, and deprivation of political rights through retroactive legislation(ex post facto law). The Anti-National Behavior Investigation Act enacted in 2004 and the Pro-Japanese Property Forfeiture Act enacted in 2005 are typical retroactive legislations. Since the founding of the Republic of Korea in 1948, our society has taken measures such as criminal punishment, confiscation of property, and restrictions on the appointment of public officials against anti-national behaviors under the Anti-National Behavior Punishment Act, which was implemented retroactively based on Article 101 of the Founding Constitution. The Anti-National Behavior Investigation Act and the Pro-Japanese Property Forfeiture Act originated from the allegation that the dealings with the collaborators through punishment of Anti-National Behavior Punishment Act in 1948 was not sufficient. Honorary punishment under the Anti-National Behavior Investigation Act and confiscation of the property under the Pro-Japanese Property Forfeiture Act have no Constitutional basis. Despite this, the Constitutional Court ruled that both the Acts were constitutional based on the spirit of the ‘March 1st Movement’ or the ‘legal tradition of the Provisional Government’ in the preamble to the Constitution. Such a judgment, which grants excessive normative power to the preamble of the Constitution and ignores the fundamental rights provisions of the Constitution, exceeds the authority of the Constitutional Court in interpreting the Constitution. During Korea’s colonial era of 35 years under Japan, there were not any serious armed conflict between two countries. The allegation that Korea’s handling of past history was insufficient compared to that of France does not fit the context. On the other hand, even in the case of belligerent countries, amnesty is widely granted over time. In Korea, however, the scope of anti-national behaviors seems to be expanding over time. The Constitutional Court needs to declare the Anti-National Investigation Act and the Pro-Japanese Property Forfeiture Act unconstitutional.
