변호사시험 출제절차의 문제점과 개선방안— 변호사시험의 출제위탁을 중심으로 — (Problems and Improvement of Question-Making Procedure in Korean Bar Examination — Focusing on the Establishment of an Independent Institution —)

초록

법학전문대학원 제도가 도입된 후 한동안 사법시험 존치에 대한 방어에 치중하느라 올바른 법전원제도의 정착에는 소홀한 측면이 있었다. 현재 법학전문대학원과 관련해서 학생 선발, 학사일정, 커리큘럼, 학생 평가방법, 졸업시험, 변호사시험 등 여러 사항에 대해 문제가 제기되고 있다. 특히 낮은 변호사시험 합격률로 인해 대부분 법전원이 변호사시험 준비에 매진하느라 국민의 다양한 기대와 요청에 부응하고 건전한 직업윤리관를 갖는 법조인의 양성이라는 법학전문대학원 본연의 역할에는 소홀했고 변호사시험의 합격에 도움이 되지 않는 국제화 및 특성화, 리걸클리닉 등은 점차 형해화되고 있다. 그동안 변호사시험에 대한 다양한 문제제기와 개선방안이 제시되었지만 주로 변호사시험의 내용과 형식에 대한 것들이었다. 시험과목의 타당성, 선택형, 사례형, 기록형 등 문제유형의 타당성 등 다양한 문제제기와 검토가 있었고 필자도 이에 전적으로 공감한다. 다만 그동안 변호사시험의 출제절차에 대한 문제점에 대한 논의는 상대적으로 적었기 때문에 본 논문에서는 변호사시험의 출제과정과 절차의 문제점과 개선방안에 대하여 살펴보고 특히 위탁출제의 가능성과 방법에 대하여 중점을 두고 살펴보고자 하였다. 현재 대다수 논문에서 제시하는 변호사시험의 개선방안은 크게 새로운 것은 아니고 법학전문대학원 출범 당시의 초심으로 돌아가자는 것이다. 변호사시험이 본래의 구상에 부합하는 방향에서 출제되어야 한다는 것이다. 이러한 개선방향은 대다수가 공감하면서도 변화를 위한 움직임은 더디기만 하다. 이 상황에서 하나의 돌파구를 마련해 보려는 취지에서 필자는 변호사시험 출제절차의 문제점과 개선방안에 대하여 언급하였다. 변호사시험의 출제를 더 이상 행정관료와 출제위원의 양식에 맡겨 놓을 수 없다는 생각에서 출제절차의 개선방안에 대하여 살펴보았다. 구체적으로 문제은행 관리, 출제위원 위촉, 출제의 전문화 등을 제시했지만 이 또한 실현되기에 여러 어려움이 있는 상황에서 필자는 전문출제기관에 대한 출제위탁에서 돌파구를 찾고자 하였다.

After the law school system was introduced, for a while, the focus was on the defense of the bar exam, so there was a neglect of the establishment of a proper law school system. Currently, several issues are being raised regarding student selection, academic calendar, curriculum, student evaluation methods, graduation exams, and bar exams related to the Law School. In particular, due to the low passing rate of the bar exam, most of the law schools were focused on preparing for the bar exam, so they neglected the original role of the law school of cultivating lawyers with sound professional ethics and meeting the various expectations and requests of the public. Internationalization, specialization, and legal clinics that do not help to pass the bar exam are gradually becoming more common. In the meantime, various problems have been raised and improvement plans have been proposed for the bar exam, but mainly the content and format of the bar exam. There were various questions raised and reviewed, such as the validity of test subjects and the validity of question types, and I fully agree with them.
However, there has been relatively little discussion about the problems with the bar exam questioning procedure. Therefore, in this thesis, the problems and improvement methods of the bar exam questioning process and procedure are examined, and in particular, the possibility and method of the commissioned examination are to be examined. Currently, the improvement plan for the bar exam suggested in most of the papers is not very new, and it is to return to the original intention at the time of the establishment of the Law School. The bar exam should be presented in a direction consistent with the original idea. Although most people agree with this improvement direction, the movement for change is only slow. In order to make a breakthrough in this situation, I mentioned the problems of the bar exam questioning procedure and ways to improve it. Since the questions of the bar exam can no longer be left to the forms of administrative officials and exam committee members, I looked at ways to improve the exam procedure. In detail, it is necessary to manage the question bank, appoint a member of the question paper, and to specialize the questions, but the way to fundamentally solve the problem at this time is to entrust the questioning to a specialized institution.
