한국 헌정이념사 연구서설 (A Prolegomenon to the Study of History of the Idea of Constitutionalism in Korea)

초록

이 논문의 목적은 현재 한국 헌정주의의 문제를 그 근원에서 해명하기 해서는 한국 헌정이념의 역사적 기원 및 변화·발전 과정에 대한 연구가 필요하다는 설명과 아울러 그러한 연구의 기본 방향 및 개요를 제시하는데 있다. 이를 위해 먼저 헌법의 근본 성격으로 간주되는 기본법의 본질에 대한 해명이 바로 기본법 개념 자체에 대한 분석을 통해 시도된다. 기본법의 형식이나 내용은 각 국가가 처한 역사적 상황이나 정신사적 전통의 성격에 따라 무한한 변용을 가질 수 있다는 것, 근대 헌법의 핵심은 조문화나 성문화라는 특정한 형식의 존재 또는 인권이나 권력분립 등 특정한 이념이나 제도의 존재가 아니라 헌법으로 표상되는 국가체제는 신이 아닌 인간의 피조물이라는 사고방식의 전환에 있다는 것, 이 두 가지가 그 해명의 핵심이다. 이러한 관점에서 한국 헌정이념사에 대한 개관이 이루어진다.
이에 따라 정도전의 <조선경국전>은 성리학적 이데올로기를 기반으로 국가를 새롭게 건설한다는 관념이 명시적으로 나타나 있으므로 한국헌정사에서 근대 헌법의 맹아로 해석된다. 그런데 <조선경국전>에 내포된 근대 헌법의 맹아는 <경국대전>에서 다시 전통주의적 왕권이념으로 회귀함에 따라 사라진다. 그러한 헌정사적 상황은 황제주권 형태로 최초의 주권 개념이 도입되고 전통적인 화이질서를 벗어나 근대 국제법 질서로의 편입이 명시된 <대한국 국제>의 선포 이전까지 이어진다. 그와 같은 헌정사적 연속과 단절의 바탕에 있는 이념적 문제는 정치사상사 및 정치철학적 연구 대상이다. 아울러 임시정부 헌법의 제정이나 제헌헌법의 제정이 <경국대전> 체제의 근간인 성리학 이념이나 <대한국 국제>의 황제 주권론에 대한 비판적 검토 작업이나 자유권, 평등권, 소유권 등의 이념들에 대한 깊은 천착 없이 이루어졌다는 사실 등에 내포된 정치사상사 및 정치철학적 문제들에 대한 해명 또한 한국헌정사 연구가 새롭게 수행해야 할 과제이다.

영어초록

The purpose of this paper is twofold. It is first to demonstrate that in order to get at the root of the present constitutional issues in Korea the study of history of the idea of constitutionalism in Korea is needed, and then to provide a basic research orientation for the study. For this purpose a conceptual analysis of the very notion of supreme law is attempted. The results of the analysis are: that the form and contents of supreme law may take infinite variety according to the historical situation and the ideational tradition into which a country finds itself; and that the basic character of modern constitution lies not in such forms as documentation or codification nor in such ideas as human rights or separation of powers but in the reorientation of thinking that a political system as represented by constitution is not something divinely imposed on men but men's creature. Korean constitutional history is briefly surveyed from this perspective.
Chung Dojon's 'Administrative Code of Choson(Chosonkyunggukjon)' is thus interpreted as a germ of modern constitutionalism in that there appeared in it an explicit idea of building a new political system on the basis of the neo-confucian ideology. But the germ of the modern constitutionalism dwindled away as Grand Code of Managing the Nation(Kyunggukdaejon) had returned to the traditional idea of the divinity of kingship. Such a state of constitutionalism had continued to exist until the appearance of Constitution of the Korean Empire(Daehangukgukje) wherein emperor sovereignty was first established and modern international law system in place of the traditional Sino-centric order was first proclaimed. The ideational issues residing in the continuity and discontinuity of such Korean constitutional history are objects of the study. The study should also aim at explication of the ideational issues associated with the fact that the constitution makings by many provisional Korean governments during the period of the Japanese colonial rule, and along with the fact that even the constitution making by the Constituent Assembly was undertaken barely without in-depth examinations of neo-confucian ideology, of the idea of emperor sovereignty, of those modern ideas of liberty, equality, property etc.
