초록

원격의료는 원거리에 있는 의료공급자와 의료수요자 사이에 정보통신기술을 이용하여 의료행위를 하는 것을 의미한다. 의학기술의 발전과 더불어 정보통신기술, 인공지능기술, 사물인터넷기술, 모바일기술 등 IT기술의 눈부신 발달로 인하여 미래의료서비스가 현실화 되고 있다. 의학기술과 IT기술을 융합한 개념으로 의사가 시간적･공간적 제약 없이 어디에서나 환자를 진료할 수 있는 원격의료산업이 전 세계적으로 성장하고 있다. 최근에는 코로나바이러스감염증-19 전염병으로 인하여 비대면진료에 기반 한 원격의료가 더욱더 주목받고 있으며, 도입의 필요성 또한 커지고 있다.
원격의료는 음성파일･동영상･전자파일 등 각종 정보통신 수단을 이용하여 의사가 환자를 직접 대면하지 않더라도 환자를 진료하고 치료하는 등의 의료행위를 하는 것으로, 일반 의료와 비교하여 비대면성과 원격기술의존성이라는 특수성이 있다. 원격의료의 도입을 반대하는 입장에서는 이러한 특수성으로 인하여 원격의료의 안전성에 문제가 있다고 주장한다. 그러나 진료과목의 특성상 대면하지 않더라도 의료행위가 가능한 영역에서부터, 안전성이 확보된 원격의료장비를 사용하는 방법으로 단계적으로 원격의료를 도입한다면, 원격의료행위의 특수성으로 인한 의료사고는 사전에 충분히 예방될 수 있을 것이다. 또한 이러한 과정에서 의료과오 사건이 발생한다 하더라도 기존의 의료과오책임의 법리 내에서 해결할 수 있을 것이므로, 법적공백의 문제도 발생하지 않을 것이다.
정부 등에서 발의한 의료법 개정안 또한 의학적 안전성과 원격의료기술의 안전성 양 측면을 모두 고려하여 단계적으로 원격의료를 도입하는 방안을 추진하고 있다. 다만 원격의료사고가 발생할 경우 책임소재를 명확히 하기 위하여, 의료법 개정안에 설명의무에 대한 규정이 보완되어야 할 것으로 보인다. 원격의료는 격지･오지환자, 만성질환자, 전염병으로 인한 긴급상황 등에서 필요성이 커지고 있으며, 미래의료서비스로서 전 세계적으로 각광을 받고 있다. 따라서 우리나라도 의료법을 개정하여 원격의료를 활성화 하여야 할 것이다.

영어초록

Telemedicine refers to the medical practice using information and communications technology between providers and demanders of medical care far away from each other. With the stricking development of information technologies including information and communications technology, artificial intelligence technology, Internet of things technology, mobile technology, etc. along with the development of medical technologies, future medical services are becoming a reality. Telemedicine industry, which enables doctors to give patients medical treatment without any constraints in time and space by embracing both medical and information technologies, is growing all over the world. The remote medical treatment based on non-confrontational medical treatment service is gaining more and more attention these days due to Coronavirus Disease 2019, with the necessity of its introduction increasing as well.
The remote medical treatment, which involves medical activities where doctors give patients medical examination and care without meeting the patients face to face using voice files, videos, electronic files, etc., features absence of confrontation and dependence on remote control techniques compared to normal medical care. Those against the introduction of telemedicine claim that such specificity poses problems on the safety of remote medical treatment. However, if such treatment is introduced step by step from the field which allows medical activities without confrontation using remote medical treatment devices with their safety guaranteed, medical accidents which arise from the specificity of remote medical treatment can definitely be prevented in advance. Besides, even though cases of medical malpractice occur in such process, they can be settled within the boundary of existing legal principles of liability for medical malpractice and thus will not raise any matter of a legal hiatus.
The revision of the Medical Law proposed by the authorities including the government also suggests the step-by-step introduction of remote medical treatment considering both aspects of medical safety and safety in remote medical technologies. However, in order to clarify where the responsibility lies in case of any accident during remote medical treatment, provisions on a duty of explanation should be included in the revision. The need for telemedicine is growing for the purpose of treatment of patients in distant or remote area and those with chronic illnesses or in emergency situations caused by infectious diseases. Moreover, it is highly favored all over the world as future medical service. In this regard, the activation of remote medical treatment based on the revision of the Medical Law is necessary in Korea as well.
