병(兵)의 징계제도 개선에 관한 소고 (A Study on the Improvement of the Military Disciplinary System for the Enlisted Soldiers)

초록

‘영창제도’는 1896년 칙령 제11호 ‘육군징벌령’을 그 시초로 하며, 1962년 군인사법 제정 시에도 규정되었다. 도입 후 영창제도에 대해서는 지속적인 문제제기가 있었으며, 군은 이를 개선하기 위한 여러 제도를 도입하였다. 영창제도에 대한 문제는 2020년 2월 4일 군인사법 개정으로 영창제도가 폐지됨으로써 해소되었다. 2020년 개정으로 영창제도의 문제점을 해소되었으나 병의 징계제도에 대한 한계점과 효과성에 대한 의문은 여전히 남아있다. 본 논문에서는 병의 징계제도에 대한 한계점과 효과성에 대한 개선을 위하여 병의 징계제도에 대한 개선방안을 제시하였다. 이를 위해 우리나라 병의 징계제도의 역사적 발전 과정을 살펴본 후, 현행 제도의 내용과 징계처분 상의 문제점을 고찰하고 운영현황을 검토하여 병 징계의 효과성을 확보할 수 있는 개선방안을 제시하였다. 먼저, 1896년 육군징벌령 제정을 시작으로 병(兵) 징계제도의 역사적 발전 과정을 분석하고, 현행 제도의 기원과 변화 과정을 고찰하였다. 이어서, 영창제도의 폐지와 군기교육, 감봉, 견책의 신설 등을 포함한 2020년 군인사법 개정 이후의 현행 병사 징계제도를 살펴보았다. 이를 토대로 병 징계에 대한 각종 징계현황과 자료를 기초로 징계 종류의 다양화, 징계의 효과성 및 인권 보호 강화를 위한 방안, 복무일수 가산, 중근신과 경근신의 구분 도입, 감봉 금액의 조정, 휴가단축 처분의 명확화, 인권담당 군법무관에 의한 적법성 심사의 확대 등의 방안과 강등 처분의 활용 및 확대, 감봉제도의 효과성 저하 문제와 개선방안, 휴가단축 처분의 불명확성, 적법성 심사의 한계 등에 대한 개선 방안을 제시하였다. 국방의 의무를 다하는 병사들에게 공정하고 인권을 존중하는 징계 환경을 조성하기 위해 병의 징계제도는 지속적인 연구와 개선을 통해 인권을 보호하고 징계의 효과성을 확보할 필요가 있다.

The disciplinary system for soldiers in the military, known as the ‘record system,’ has its origins in the Royal Decree No. 11 of 1896, titled ‘Army Punishment Decree’. This system was formally established with the enactment of the Military Personnel Management Act in 1962. Since then, there have been ongoing challenges and criticisms related to the military service system, leading to several reforms aimed at improvement. A significant change occurred on February 4, 2020, with the revision of the Military Personnel Management Act, which notably included the abolition of the military honors system. This revision addressed longstanding issues with the military honor system but also raised questions about the limitations and effectiveness of the disciplinary system for soldiers. The primary goal of this paper is to review the current disciplinary system within the military and suggest measures for its improvement, focusing on enhancing both its limitations and effectiveness. The paper approaches this goal by examining the historical development of South Korea’s military disciplinary system, assessing the content and issues of the current system, and proposing plans to ensure the effectiveness of disciplinary actions for soldiers. The paper first analyzes the historical development of the military disciplinary system. It begins with the Army Punishment Ordinance of 1896, exploring the origins and evolution of the current system. This historical perspective serves as a foundation for understanding and proposing the diversification of disciplinary measures. The current state of the soldier disciplinary system, following the 2020 revision of the Military Justice Act, is examined. This revision marked the abolition of the military service system and introduced new measures like military discipline training, salary reductions, and reprimands. Despite these changes aligning with contemporary needs and human rights considerations, limitations persist in the types and procedures of disciplinary actions. Based on various data and the current status of disciplinary actions for soldiers, directions for improving the disciplinary system are proposed. These include measures to diversify types of disciplinary actions, enhance their effectiveness, and protect human rights. Notable suggestions include adding service days, differentiating between medium and light service, adjusting the amount of pay reduction, clarifying the shortening of vacations, and expanding the legal review by military legal officers specializing in human rights. Additionally, the paper presents improvement plans for the utilization and expansion of demotion penalties, addressing the reduced effectiveness of the salary reduction system, measures for clarity in vacation shortening, and addressing limitations in legal reviews. The disciplinary system for soldiers must continuously evolve to protect human rights and ensure the effectiveness of disciplinary actions. This is imperative to establish a disciplinary environment that is fair and respects the human rights of soldiers, who carry out their national defense duties.
