부동산 유치권 형사분쟁에 따른 유형별 경찰조치 방법 연구 (A Study on Police Action by Type of Criminal Disputes Related to Lien)

초록

최근 관내 상가건물에서 유치권1분쟁 발생에 따른 112신고가 잇따라 신고처리에 어려움을 겪었다. 유치권 분쟁은복잡한 민사적 쟁점이 얽혀있고 공권력을 이용하여 민사관계를 해결하려는 당사자들의 무리한 요구도 있어 사전지식과경험이 없다면 대응이 어렵다. 그러나 기존 논문은 유치권 제도 개선안에 대한 연구나 각 유치권 성립요건에 관한이론적인 연구에 치중되어 있다. 본 연구는 현장 경찰관의 시각에서 유치권 현장분쟁 대응에 필요한 민사법적 지식을정리하고 현장에서 발생하는 분쟁의 양상을 살펴본다. 각 분쟁 양상별 적절한 조치 방법도 모색한다. 유치권의적법성은 민사법원에서 판단할 사안이다. 다만 형사분쟁 발생시 유치권의 적법성에 대한 당사자의 인식 정도는 범죄의고의, 정당행위 여부, 양형참작 사유에 영향을 미친다. 특히 유치권의 성립요건 중 채권의 견련성, 점유의 적법성에대한 정확한 이해가 필요하다. 또한 유치권자의 점유 상실은 권리 상실로 이어지는 만큼 강제수사에 신중해야 한다.
출동시 공권력 발동의 법적근거 및 신고유형별 조치방법 등 현장에서 고민한 내용과 각 신고유형별 신고처리에 유용할만한 판례를 정리하였다. 다시 발생할 수 있는 사실관계를 포함하고 쟁점이 명확하여 초동조치시 민원대응과증거수집에 유용한 하급심 판례를 선정하여 분석하였다. 하급심에서 인용한 대법원 판례의 법리는 경찰대응시 신속한법적 쟁점 판단에 도움될 것이다.

영어초록

Recent real estate lien disputes in commercial building have led to difficulties in handling 112 emergency calls. Lien disputes are complex and interwined with both civil and criminal issues. There are also unreasonable demands from parties attempting to resolve civil disputes through the use of public authority. Without experience or knowledge related to lien, it is difficult for the police to response appropriately. However, existing studies primarily focus on institutional improvements related to lien.
This study aims to organize the legal principles required for police intervention in criminal dispute related to lien and examine the patterns of conflicts that arise in practice. It further seeks to suggest appropriated police action tailored to each conflict type.
The lien holder’s possession of the property serves as a means to pressure the debtor to repay the debt. Until the dispute arise, it is necessary to prepare for unexpected situations. A lien does not require public notice. The claim that a lien is invalid due to the absence of a filling of notice is not justified.
The legitimacy of a lien is a matter to be determined by the civil court. However, in the event of a criminal dispute, the parties’ awareness of the legitimacy of the lien affects the determination of criminal intent, the justification of the act, and the sentencing.
Arresting a lien holder must be approached with caution. The loss of possession by the lien holder leads to the loss of their rights. This study organize the legal basis for the exercise of public authority, police actions for different types of reports and practical considerations faced in the field.
Relevant lower court precedents, including potential on-site facts and clear issues, were selected and analyzed for effective complaint handling and evidence collection.
