이주민 시민권으로서의 다문화주의 시민권의 한계와 대안: 벤하비브의 시민권 정치를 중심으로 (Multicultural Citizenship and Benhabib s Theory of Political Membership)

초록

킴리카(W. Kymlicka)의 다문화주의 시민권은 영토적 경계를 넘어서는 정치적, 문화적 시민권의 문제에 해답을 제공할 것이라는 기대와는 달리 과도한 수용국 중심의 시민권을 옹호함으로써 이주민 시민권으로서 한계를 지닌다. 이는 다문화주의 시민권이 민족-국가를 최종적인 정치적 해결의 장소로 전제하고, 이주에 대한 소극적이고 부정적인 관점을 지니고있기 때문에 나타나는 문제라고 할 수 있다. 이 점에서 이 논문은 다문화주의 시민권이 이주민 시민권으로서 지니는 한계와 그 원인을 살펴보고, 하나의 대안으로 벤하비브(S. Benhabib)의 시민권 정치를 검토한다. 벤하비브는 이주민들이 갖는 보편적 권리와 개별 민족-국가의 주권 사이에 존재하는 정당성의 역설을 통해 국제적 이주가 제기하는 근대 자유민주주의의 갱신 가능성에 주목한다. 이러한 이론적 접근은 공동체 성원으로서의 권리를 부인당하는 이주민들의 권리에 정당성을 부여할 수 있을 뿐 아니라, 수용국의 자기-결정권의 정당성도 고려함으로써 이주와 관련된 다양한 주체들의 정의(justice) 문제를 다룰 수 있는 가능성을 제공할 것으로 기대된다.

영어초록

The main purpose of this study is to point out the limitations of Kymlicka’s theory of multicultural citizenship and examine Benhabib’s political theory of citizenship as an alterative to overcome those limitations. Many have expected that Kymlicka’s theory of multicultural citizenship can provide solutions for problems related with political and cultural citizenship. On the other hand, the limits and shortfalls of that theory also have been pointed out. Particularly, criticism over it has been focused on the passive and negative perspective he supposes about immigration. This article examines the limitations of multicultural citizenship as the theory of citizenship in the era of multiculturalism and also investigates Benhabib’s citizenship theory as an alternative for it. Her approach is expected not only to provide legitimacy to the rights of immigrants whose rights are denied as a member of a community but also to provide possibility to deal with the justice issues of various subjects associated with immigration considering the legitimacy of sovereignty in the state that accepts immigration. The perspective of Benhabib dealing with international immigration issues emphasizes each individual’s basic rights regarding immigration more than Kymlicka’s multicultural citizenship and furthermore interprets immigration as a more positive political opportunity. Immigration provides a chance to reevaluate the origin and legitimacy of modern democracy. The immigrant’s citizenship issue is hard to be dealt with and needs to be approached carefully. The complex aspects surrounding immigrant citizenship embrace great possibility to be the new cause of political anxiety and violence. In order not to realize those pessimistic prospects, it is necessary to take prudent approaches to the issues concerning citizenship and immigration.
