초록

아동․청소년 정신건강 문제가 심각한 사회문제가 되어가고 있다. 아동․청소년의 정신건강 문제는 세계보건기구(WHO)가 진단하고 있는 것처럼 글로벌한 현상으로 나타나고 있으며. 특히 우리나라 아동․청소년의 1/5이 다양한 유형의 정신건강상 장애나 질환상태에 있는 것으로 보고되고 있는 실정이다. 오늘날 아동․청소년은 성장기에 과도한 입시와 취업 등 극심한 경쟁사회에 노출되고, 후기산업사회에 핵가족화, 맞벌이 가정, 한부모 가정, 조손가정, 다문화 가정 등 다양한 가족관계의 출현과 사회변동의 심화로 전반적인 정서적 불안 증가, 가정폭력과 학교폭력 등 각종 폭력의 증가 외 범람하는 매스미디어의 영향으로 성, 약물, 알코홀과 인터넷의 발달로 인한 게임중독 등 각종 유해환경에 노출되어 있다. 본 연구는 이러한 특히 아동․청소년 정신건강과 관련 법․제도의 현황과 개선방안에 관한 연구이다.
특히 아동청소년 정신건강문제에 있어 다양한 유해요인으로부터 아동․청소년을 예방적 차원에서 보호하고, 구체적인 치유를 필요로 하는 보호대상자에 대하여 적정한 치료와 재활 및 사회복구가 이루어질 수 있도록 법․제도가 구비되어야 한다. 우리나라에는「정신보건법」과 아동․청소년복지관련「아동복지법」,「청소년복지법」,「청소년보호법」,「청소년복지지원법」등 복지관련 법과 아동․청소년 정신건강 증진의 중요한 지점인 학교와 관련「교육기본법」,「학교보건법」,「초중등교육법」,「학교폭력 예방 및 지원에 관한 법」등 10여개의 직․간접적인 법이 존재한다. 그러나 관련 핵심법인 우리나라 정신보건법은 주로 중증질환자를 대상으로 하고 있는 반면, 아동․청소년 복지법이나 교육관련 법 등은 교육이나 복지증진 일반을 대상으로 하고 있거나 정신건강을 전문으로 하는 법체계를 구비하지 못하고 있다. 또한 관련 법의 중복․병립이나, 사각지대 문제가 구조적인 문제로 지적된다.
본 연구에서는 아동․청소년 정신건강 증진에 관한 필자 등의 선행 연구에 기반하여 주요 쟁점을 재구성하고 관련 주요 법제도 개선사항을 구체적으로 적시함과 동시에, 궁극적으로 법제도의 시너지효과를 높이고 효율성을 제고하기 위하여 미국이나 호주 등 주요 외국에서의 사례에 비추어 중장기적인 대안으로 가칭「아동․청소년 정신건강 증진을 위한 법」과 같은 ‘통합법’ 제정의 필요성을 제안하고자 한다.

영어초록

The mental health disorder or illness of children and youth people becomes more and more social problem. According to the official statistics of the organization concerned, it is reported that about 20% of the children and young people, today, are suffering from the mental health disorder or illness. This is a very much worried situation. On the one side, due to the high competition for the college entrance exam and taking a job, and due to the fundamental transformation in the social and family structure in the various forms of independent single mother or father, the grandparents and children, and multi-cultural family etc., the children and young people at the present are mentally getting uneasier. On the other side, due to the influence of flooding mass media, the children and youth people are today vulnerable to the various forms of harmful surroundings such as violence, sex, drug, alcohol and internet game addiction etc. The WHO has been warning the crisis in mental health of the children and youth people and recommending to make the proper national policy. Nowadays, many countries have been making the various policies, action plans and institutional arrangements. However, there are few standard laws for this issue only. This study reviews first the laws on the mental health of the children and youth people, and then it shows the limits of the present law and institutions, and finally suggests a proposal for the improvement of the present laws and institutions concerned.
The laws and institutions should be systematically and more coherently improved to protect the children and youth people from the various harmful surroundings, to offer the proper prevention and education, timely to take the practical cure and rehabilitation, to support the return of the protected children and youth people to the society etc. In Korea, there are mental health law and the related acts in the sphere of welfare of children and youth people(children welfare law, youth people welfare law, youth people protection law, youth people welfare supporting law etc.), and concerning the education welfare(basic education law, school health act, elementary and middle school law, the law of the prohibition of school violence and supporting etc.).
However, in Korea, the mental health law is mainly focused on the patients with severe status and the rigid accession to the usual patients for the consultation and cure, and in the other related welfare and education laws, the issues of the mental health of the children and young people lack of the concreteness or they are in the blind spot or some regulations are ineffectively and repeatedly defined. However, for the present mental health of the children and youth people the systematic management should be required from the prevention, education and cure, rehabilitation to the support to return to the society. This study reviews the results of previous research and it is trying to find out the improvement ways of the present mental health law and furthermore it hints ultimately the necessity to enact the so-called integrative "law of mental health improvement of the children and youth people" to secure the better implementation of law and to enhance the synergy effect of the related various laws.
