북한의 행정위법행위와 행정처벌법 (Illegal Administrative Conduct and Administrative Punishment Law in North Korea)

초록

북한은 사회주의 법을 국가 관리의 기본 수단으로 사용하고 있다. 북한의 사회주의 법은 자본주의 법과는 다르게 강한 강제성과 권력성을 지니고 있다는 점에 특징이 있다. 북한은 법의 준수를 사람들의 의지나 자율에 맡기지 않는다. 법을 무조건적으로 지킬 것을 권력적으로 요구하고 있다. 국가의 법질서를 세워 나가는 것이 바로 인민정권의 권력적 활동의 목적이라는 것이다.
그렇다면 북한은 국가 관리를 어떻게 하는가. 즉, 행정활동을 어떤 기준으로 통제하는가. 국가 관리의 기준인 법과 규정 등에 어긋나는 행위를 행한 경우 어떻게 처벌하고, 제재하는가. 북한에서는 ‘행정위법행위’라는 기준을 설정하고, 이에 대해 제재와 처벌을 가한다. 물론 북한에서도 행정위법행위에 대한 행정처벌과 범죄에 대한 형사적 처벌을 구별하고 있다. 그러나 그 경계가 모호하다. 특히 남한과 달리 북한에서는 행정처벌이 사상적 혹은 심리적 차원에서 실시되고 있기 때문이다. 위법행위에 대한 법적 차원의 제재를 표명하고 있지만 교양적 처벌이라는 형식을 이용하여 사상적 차원의 처벌 등을 행하고 있다.
본고에서는 북한의 행정법 내용 가운데 행정위법행위와 행정처벌에 대해 검토하고자 한다. 동시에 북한의 행정위법행위와 행정처벌이 남한의 행정법과 관련하여 볼 때 어떤 점에서 유사하고, 어떤 점에서 차이가 있는가를 살펴보고자 한다. 다만, 남한의 관련 행정법이론이 방대하다는 점을 감안하여, 북한 행정법의 내용과 직접 관련되는 내용만을 1차적인 비교의 대상으로 삼고자 한다. 이러한 검토를 통해 북한 행정법의 특성을 밝히고, 남한의 행정법과의 유사점과 차이점을 규명하고자 한다.
본고에서는 북한의 행정법은 질서유지가 우선이고, 그것이 사회주의국가체제의 수호 방식이라는 점을 밝히고자 한다. 행정적 제재 수단으로서 형사적 수단이 사용되는 것도 같은 차원이다. 행정처벌이나 법적 제재가 사회주의국가체제의 유지의 수단으로 실시되고 있다. 북한의 행정처벌법은 사상과 심리적 통제 수단을 사용하여, 위법행위를 교양을 통해 교정할 수 있다고 한다. 하지만 그것은 법치행정이나 인간의 존엄성은 물론 신체의 자유 그리고 정신적 자유 등을 침해하는 것이다.

영어초록

North Korea uses socialist law as the basic means of managing the country. Socialist law is different from capitalist law in South Korea. In particular, the North's administrative law features strong coercion and power. North Korea does not entrust compliance with the law to people's will or autonomous actions. It is calling for the compulsory observance of the law powerfully. The goal of the people's government is to establish the law and order of the nation.
Then, how does North Korea manage its state? On what basis do residents' administrative activities be controlled? How do you punish a person for committing an illegal act? In North Korea, it sets a standard of illegal administrative activities. And if they violate it, they will be punished. In North Korea, it also distinguishes between administrative punishment for administrative misconduct and criminal punishment for crimes. But the boundary is not clear. In particular, administrative punishment is being carried out in North Korea on an ideological or psychological level. In other words, they are punishing them for administrative misconduct with a level of ideological control. North Korea has various penalties for illegal administrative activities.
In this study, I want to review the illegal administrative activities and administrative punishments among the contents of the North's administrative law. At the same time, we would like to examine what points the North's illegal administrative conduct and administrative punishment are similar in relation to the South's administrative law, and what makes the difference. However, only those directly related to the contents of the North Korean administrative law will be subject to the primary comparison.
Through this review, I want to reveal the characteristics of the North Korean administrative law and identify similarities and differences with the South's administrative law. In this study, I want to explain that maintaining order is the priority of the North Korean administrative law. It is the same way that criminal means are used in administrative sanctions. In North Korea, administrative punishment or legal sanctions are being enforced as a means of maintaining the socialist state system. The North's administrative punishment law uses the means of thought and psychological control. But it violates the rule of law or human dignity, as well as the human freedom and spiritual freedom.
