현행 정신건강복지법에 관한 고찰 (Legislative Review on Act on the Improvement of Mental Health and the Support for Welfare Services for Mental Patients)

초록

최근 우리 사회에서 ‘묻지마 범죄’로 표현되는 범죄가 빈번하게 보도되면서 국민들은 이 범죄들이 정신질환과 관련되었다고 믿고 있다. 하지만 이러한 인식과 달리 피의자 중 정신적장애피의자의 비율은 2023년 기준 1.1%에 불과하다.
정신질환을 앓는 이들이 자신의 의지와는 상관없이 격리･강박의 관행적 현실에 직면하는 일들이 발생되고 있다. 우리나라는 아직까지도 정신질환에 대한 이해도가 상당히 낮고, 정신질환자 본인은 물론이고 사회적으로도 정신질환에 대한 시각이 상당히 부정적이어서 당사자 가족들조차도 세간에 노출되기를 꺼리는 실정이다.
이에 본고에서는 정신건강 및 정신질환에 대한 이해를 바탕으로 현행 「정신건강증진 및 정신질환자 복지서비스 지원에 관한 법률」의 문제점과 개선방안을 검토해 보았다.
첫째, 1995년 법제정 이후 30여년이 지났지만, 정신건강 서비스 체감도가 낮음을 지적하였다. 둘째, 정신질환 치료를 자의적으로 중단한 사람이 발생하지 않도록 국가가 관리하고, 지속적인 치료가 필요한 대상자의 치료지원이 필요함을 강조하였다. 셋째, 환자 본인의 의사와는 관계없이 강제적으로 입원을 하게 되는 비자의 입원 기준의 적절성과 과정의 중요성을 피력하였다. 넷째, 특별자치시장･특별자치도지사･시장･군수･구청장 등에 의한 입원과 입원 해제 시 환자별 다양성이 존재하기 때문에 종합적인 검토를 통한 적절한 기준 마련이 필요하되, 환자에 대한 개별화(individuation)의 필요성을 주장하였다. 다섯째, 자･타해 위험으로 비자의 입원을 한 적이 있는 자, 또는 자･타해 위험으로 입원 또는 외래치료 중 치료를 중단한 자 중에서 정신건강심사위원회를 통한 외래치료 지원 통지를 받은 대상자의 치료 유지를 위해 외래 치료비를 지원하고 있는데, 이용률을 높이기 위는 방안 마련이 필요함을 강조하였다. 여섯째, 격리시키거나 묶는 등의 신체적 제한과 관련하여 신체적 제한 사유와 해제 조건을 정신질환자와 보호의무자에게 의무적으로 고지하도록 하는 방안을 제안하였고, 현행 보건복지부의 「격리 및 강박 지침」을 보건복지부령으로 격상하여 규범력을 높일 필요가 있음을 피력하였다.

영어초록

In recent years, our society has seen a rise in the number of crimes described as "nonspecific motive crime", leading the public to believe that these crimes are related to mental illness. However, contrary to this perception, only 1.1 per cent of suspects are mentally ill as of 2023.
People with mental illness are being forced to face the reality of compulsory isolation against their will. In Korea, the understanding of mental illness is still very low, and the view of mental illness is still very negative, not only for the sufferers themselves, but also for society, so even their families are reluctant to expose them to the public.
Therefore, based on the understanding of mental health and mental illness, this article examines the problems of the current Act on the Promotion of Mental Health and Support for Welfare Services for the Mentally Ill and how to improve it.
Firstly, it noted that 30 years after the enactment of the 1995 Act, access to mental health services remains low. Secondly, it emphasised the need for the state to ensure that no one voluntarily discontinues treatment for mental illness and to support those in need of ongoing treatment.
Third, the importance of the appropriateness of the criteria and process of hospitalisation for visa holders who are forced to be hospitalised regardless of their will was expressed. Fourth, the need to establish appropriate criteria through a comprehensive review is necessary due to the diversity of patients when admitted and discharged from hospital by the mayor, governor, mayor, county governor, or mayor of a special autonomous region, and the need for individuation of patients.
Fifth, outpatient treatment costs are supported for people who have been hospitalised unwillingly due to behaviour that harms themselves or others, or for people who have stopped treatment while receiving inpatient or outpatient treatment, and it was stressed that measures should be taken to increase the uptake of this system.
Sixth, in relation to physical restrictions such as isolation or restraint, it was proposed that the reasons for physical restrictions and the conditions for lifting them should be mandatorily notified to the mentally ill and their guardians, and that the current "Guidelines for Isolation and Compulsion" of the Ministry of Health and Welfare should be upgraded to a Ministry of Health and Welfare Ordinance to increase its normative power.
