“행정학과 행정법학의 대화” 재조명 ― 행정법학과 행정학의 학제적 연구의 관점에서 ― (“Interdisciplinary Conversation between Public Administration and Administrative Law” Revisited — Focusing on the Interdisciplinary Approach —)

초록

‘통섭’과 ‘융합’의 시대를 맞아 융합 학문에 대한 관심이 높아지고 있고, 서로 다른 학문 사이의 학제적 연구(Interdisciplinary approach)도 강조되고 있다. 행정법학도 그 예외는 아니라고 할 수 있다. 우리 행정법학계에서도 융합과 통섭의 시대를 맞아 다양한 방법론적 논의가 진행되고 있으며, 특히 방법론적으로 다른 사회과학과의 협력을 강조하는 견해들이 제시되고 있다. 그리고 그 관심 대상은 주로 ‘행정’을 연구대상으로 하는 행정학이라고 할 수 있다. 우리 행정법학계에서 일찍부터 ‘행정법학과 행정학의 관계’에 대하여 관심을 가지고 연구해 온 대표적 학자로 故 서원우 교수님을 꼽을 수 있다. 본 연구에서는 ‘행정’을 연구대상으로 하는 두 학문인 행정법학과 행정학의 관계를 이해하기 위하여 서원우 교수님의 견해를 중심으로 하여, 두 학문 사이의 관계에 대한 학계의 논의를 정리하고, 앞으로의 방향을 제시하고자 하였다.
서원우 교수께서 일찍이 개별 행정법 분야에 대한 대응이 필요하다는 점, 법 해석뿐만 아니라 법정책적인 역할의 확대가 필요하다는 점, 그리고 이를 위해서는 인접한 사회과학과의 협동이 필요하다는 점을 역설하셨는데, 현재의 행정법과 행정학 양 학계의 논의에 비추어볼 때 여전히 중요하고 의미 있는 기준이 되고 있다고 생각된다. 각 학문의 전문화와 협조를 대안으로 제시한 것 역시도 의미 있는 방법론상의 지침이 되고 있다고 감히 평가할 수 있을 것이다.
최근 우리나라에서도 학문 간의 융합과 통섭이 활발하게 논의되고 있는데, 융합학문을 연구하는 학자들도 각각의 학문의 방법론의 고유성을 강조하고 있다는 점을 주목할 필요가 있다고 본다. 학제적 연구를 수행하더라도, 학제적 연구에 참여하는 다양한 학문들은 각각의 학문의 고유한 방법론을 가지고 있으므로 방법론의 고유성을 인정하여야 한다는 것이다. 이미 오래전부터 행정법학과 행정학의 대화와 협력을 주장하면서도, “(행정법학과 행정학이) 서로의 분야를 넘보는 것은 절대 반대이고, 하나의 문제를 여러 분야의 전문가들이 협조함으로 전문화하여야만 올바른 문제해결이 가능하다.”라고 하여 학문 간의 존중, 분업, 그리고 협력을 강조하였던 서원우 교수의 연구는 통섭과 융합이 강조되는 지금의 시기에도 여전히 큰 울림을 가지고 있다고 감히 평가할 수 있을 것이다.

영어초록

In the era of so-called ‘consilience’ and ‘convergence’, interest in convergence studies is increasing, and interdisciplinary approach between different disciplines is also emphasized. Administrative law is no exception. In our administrative law academy, there are various methodological discussions in the era of convergence and consensus, and suggestions emphasizing cooperation with other social sciences in particular methodology. And the subject of interest is mainly the administration which is studying ‘administration’. Professor Seo Won-woo is one of the representative scholars who had been interested in the interdisciplinary relationship between administrative law and public administration in the early part of our administrative law academy. In this study, to understand the relationship between administrative law and administration, which is the subject of ‘administration,’ I will summarize the discussions of academics about the relationship between the two disciplines.
Professor Seo Won-woo emphasized the necessity of responding to the individual administrative law fields early on, the need to expand the legal policy role as well as the interpretation of the law, and the necessity of collaboration with the adjacent social sciences. It is still important and meaningful in light of the discussions of the public administration academy. It would be appreciated that the presentation of the specialization and cooperation of each discipline as an alternative is also a meaningful methodological guideline.
In recent years, convergence and consensus among scholars has been actively discussed in Korea, and it should be noted that scholars studying convergence sciences emphasize the uniqueness of each methodology. Even if an interdisciplinary study is conducted, the diversity of disciplines participating in interdisciplinary research should have a unique methodology, so that the uniqueness of the methodology should be acknowledged. It has long been argued for dialogue and cooperation between administrative law and public administration, but it is absolutely against opposition to be able to solve the problem correctly if experts in various fields cooperate to specialize I think that Professor Seo Won-woo's theory that emphasized respect, division of labor, and cooperation among scholars still gives a good inspiration in the present times of emphasizing consent and convergence.
