집합건물법의 회고와 전망 (Act on Ownership and Management of Aggregate Buildings: Retrospect and Prospect)

초록

1985년 집합건물법 제정 및 시행 이후, 2013년 및 2021년의 두 번의 개정은 그간 일본 구분소유법을 답습하여 제정되었다는 비판을 받아왔던 집합건물법에 대해 그 기능과 작동의 관점에서 대단히 선진적인 규정 설계를 이루어냈다. 이는 집합건물법이 관련 비교법사적으로 유의의한 독자성 및 창의성을 확보했다는 의미를 가진다. 구분소유자에 대한 시공자의 법정 하자담보책임 인정, 임차인 등에게 공용부분 관리에 대한 의결권 부여, 구분점포의 구분소유권성 전면 인정, 공용부분 변경 결의율 완화 및 권리변동 있는 공용부분 변경 규정 등의 신설은 국내 집합건물의 유효성 있는 관리와 구분소유권의 자치성 있는 향유에 있어 매우 중요하게 역할을 할 것으로 보인다. 한편 집합건물법의 장래 개정에 있어 요청되는 이슈를 조금 더 살펴보면, 이 외에도 복합용도형 건물에서의 삼원적 관리단의 창설, 구분소유권 종료제도의 검토, 지진 등의 재난을 입은 집합건물에서의 구분소유권의 조정 등의 현안이 아직 남아있다. 또한, 집합건물법의 전망으로서, 그 이상(理想)은 집합건물법을 건물에 관한 법이 아닌 ‘권리’에 관한 법으로 인식하는 것, 집합건물법을 규정적으로 확장하는 것 등에 대한 요청의 실현에 있다고 보았다.

영어초록

Since the enactment and enforcement of the Act on Ownership and Management of Aggregate Buildings (hereinafter the “Act”) in 1985, the two amendments in 2013 and 2021 have accomplished a highly advanced regulatory design in terms of the functions and operation of the Act which has been criticized in that it was enacted by imitating Japan’s Building Partition Ownership Act. This indicates that the Act has secured significantly meaningful identity and originality in terms of related history of comparative law. The establishment of the provisions on recognition of the legislative warranty and liability for defects of the constructor to the sectional owners, grant of voting rights for the management of the section for common use to tenants, full recognition for sectional ownership of sectioned stores, mitigation of the determination rate to the change of the section for common use and the alteration in rights on the section for common use is expected to play a pivotal role in terms of effective management of domestic Aggregate buildings and autonomous enjoyment of sectional ownership. Furthermore, examining the issues requested in future revision of the Act, there are some other pending issues that need considerations such as the establishment of a triarchic management group in multi-use buildings, deliberation on the termination of sectional ownership, and coordination and adjustment of sectional ownership in Aggregate buildings affected by earthquakes and other disasters. In addition, in terms of the future prospect of the Act, the ideal implementation lies in the recognition of the Act as laws on “rights” rather than laws on “buildings” and the expanded regulatory application of the Act.
