초록

본 논문은 2013년 별세한 Ronald Dworkin의 해석주의 법철학의 관점에서 본 국제법의 본질과 이를 바탕으로 한 조약 해석의 문제를 다룬다. 그의 유고논문인 “A New Philosophy for International Law”는 해석주의 국제법의 타당성에 관한 많은 논쟁을 낳았다. 정치적 자유주의 (political liberalism)에 기반을 둔 해석주의 법철학은 법실증주의와 자연법주의에 의한 국제법의 이해를 넘어설 것을 촉구한다. 해석주의는 기본적으로 형이상학적 전제를 기반으로 하는 법과 도덕의 구별을 거부하며 법은 정치적 도덕의 일부라고 이해한다. 법은 도덕의 일부이고 법과 개인 그리고 국가는 모두 도덕으로 연결되어 있다는 주장은 해석주의 국제법론의 핵심적 주장이다. 이는 또한 국제법의 준수와 발전이 국가만이 아닌 국제법관행에 참여하는 모든 행위자들의 엄중한 의무이자 과제라는 것을 말해준다.
국제법에 대한 이해는 법실증주의와 자연법주의가 주도하였지만 국제법에 대한 이 두 개의 주류적 이해 방식은 많은 부분에서 국제법 이해의 한계를 드러내고 있으며 일관성 있는 국제법 이해를 힘들게 만드는 것이 사실이다. 해석주의는 이런 국제법 이해의 한계를 넘어설 수 있는 가능성을 말해준다. 해석주의 국제법론의 전개는 앞으로 다양한 쟁점별 국제법 연구를 통해 보다 구체화되고 발전될 것이다.
해석주의는 법관행에 참여하는 행위자들의 계속적인 최고의 논거 제시와 반박을 통한 합의의 과정을 필연적으로 요구함으로써 공동체에서의 일정한 가치의 객관성을 ‘역사적으로’ 확보해 나간다. 국가와 구성원을 도덕적으로 연결시키는 각국의 국내법 질서는 구성원들의 도덕적 대리자로서의 국가들의 연대적 의무와 함께 국제법의 토대를 만든다. 그런 국제법 질서는 국제법관행에 대한 행위자들의 최고의 논거 제시를 통한 정당화의 과정을 거치면서 정치적 도덕으로서의 국제법을 심화 발전시킨다.
국제법의 주요 법원인 조약에 대한 해석도 결국은 조약 당사자들의 진의를 국제공동체의 헌법 원칙들과도 같은 국제법의 근본 원칙들에 비춰 이해하는 과정이며 조약 당사자들을 위시한 해당 법관행에 관계되는 참여자들의 계속적인 가치판단의 과정을 통해 조약문의 진화적 이해를 추구하는 과정이다. 따라서 조약 해석은 결코 재판소나 국가만의 독점물은 아니며 고정적인 일회성의 작업도 아니다. 조약 당사자들을 위시한 관련 국제법관행의 행위자들의 끊임없는 논거 제시와 반박을 통한 법관행의 정당화 과정을 밟아 나가면서 그 목적을 추구해 나가는 변화와 연속의 과정일 수밖에 없다.

영어초록

This article is concerned with the problems of the nature of international law and treaty interpretation from the perspective of interpretivism, developed by the great liberal legal philosopher, Ronald Dworkin, who died in 2013. Dworkin’s posthumously published article “A New Philosophy for International Law” has triggered diverse controversies about the plausibility of his interpretivist approach with regard to the nature of international law. Interpretivism based on political liberalism requires us to go beyond legal positivism and natural law theories with respect to the nature of international law. Interprevisim denies any metaphysical assumption of the existence of law and morality. It attacks any kinds of distinction between morality and law in order to understand the concept of law in a society, because such distinctions will make a coherent understanding of law very difficult. Rather, interpretivism accepts law as a part of political morality and all values, including politics, humanity, justice and others are intertwined and incorporated into a broadly defined general morality in a society, which is eventually about how human beings should live meaningfully and happily in a political community. Unity of value is also the core of interpretivism and a political community in the name of a statehood and its constitutive members are all interconnected though moral obligations and rights. These kinds of moral states comprise an international community.
Undoubtedly, legal positivism and natural law theories have been dominant theoretical trends for the understanding of the nature of international law. However, it is also true that these two schools of thought have contributed to an incomplete and inconsistent understanding of international law. In this regard, interpretivism shows us the possibility of overcoming such intellectual limitations caused by legal positivism and natural law theories, thereby broadening the academic horizon for proper understanding of international law.
Interpretivism tends to establish and develop the objectivity of value historically through the continuing process of providing potentially best arguments and rebuttals, with the goal of justifying the values of relevant law practices in question by all relevant participants in a community, which will encourage consensus and acceptance in a democratic fashion over time. Domestic legal orders that connect each state and its peoples provide moral bases of international law through solid associative obligations of states as moral agents of their peoples across borders. Such international legal order structured by moral states will develop and deepen the authority of international law as a political morality.
From the perspective of interpretivism, treaty interpretation is a process of determining the real intentions of contracting parties to a particular treaty ‘in light of’ the fundamental principles and values of international law as a sort of a constitutional law of the international community. It is also a process of reading the texts of relevant treaties in an evolutionary way through the constant making of ‘value judgments’ by all relevant participants, obviously including the contracting parties to those treaties, all of whom have been concerned and connected with the law practices in question. Therefore, treaty interpretation cannot be a one-off process with matters exclusively reserved only for courts and states. Rather, a proper treaty interpretation should be the process of ‘continuity’ and ‘change’ in which the constant provision of potentially best arguments and the justification for the values of relevant international law practices are essentially required.
