치매관리법 개정방안에 관한 연구 - 치매관리법상 주요쟁점을 중심으로 (A Study on the Revision Guideline for the Dementia Management Act Focusing on the Key Issues of the Dementia Management Act)

초록

본고는 치매국가책임제와 더불어 제4차 국가치매종합관리계획의 발표ㆍ시행에도 불구하고 치매관리법 제정 이후 현재까지도 큰 변화가 없다고 할 수 있는 치매관리법의 개정방안을 법의 목적, 국가 등의 의무와 치매관리계획의 수립, 치매관리사업수행기관, 치매관리사업, 치매정보시스템이라는 다섯 가지 측면에서 다루었다. 즉, 치매관리법의 개정방안은 법의 대상과 같은 측면에서 「노인복지법」이나 「노인장기요양보험법」과의 관계를 고려하여 이 법의 목적과 범위를 정해야 한다는 것, 국가 등 의무와 치매관리계획의 수립에 관해서도 치매국가책임제ㆍ치매종합관리계획 및 지역사회통합돌봄사업 등이 지니고 있는 취지나 내용이 충분히 포섭될 수 있도록 해야 한다는 것, 치매관리사업수행기관에서 중앙치매센터ㆍ광역치매센터ㆍ치매안심센터에 대한 기능과 범위를 보다 명확히 하고 치매안심병원이나 공립요양병원 등의 기준이 보다 현실에 적합하도록 하며 「노인복지법」 내지 「노인장기요양보험법」상 시설과의 연계를 통해 효율적인 전달체계를 구축하도록 할 필요가 있다는 점, 치매관리사업은 예방ㆍ인식개선, 검진과 진단, 치매파트너에 관한 사항, 일상생활 및 안전, 권리보호, 사회참여, 가족지원 및 이를 수행할 수 있는 전문인력에 관한 사항이 포함될 수 있도록 해야 한다는 것 및 치매정보시스템의 개선과 고도화를 통해 보다 체계적인 관리가 가능하도록 해야 한다는 것으로 요약할 수 있다.
치매는 이와 관련된 모든 영역에서의 지역사회 내 전달체계 및 자원에 관한 분석과 더불어, 지역밀착형의 대응이나 AIPㆍ커뮤니티 케어 등 이념을 고려하여 설계되는 것이 당연하다. 노인인구의 폭발적 증가와 이에 부수한 치매유병률의 상승은 당면한 우리 사회의 모습이며, 따라서 치매와 노인과 통합돌봄과 사회서비스원 등과 같은 이슈나 정책들이 하나로 맞물려 제 자리를 찾아 유기적으로 움직일 수 있도록 하는 것도 매우 중요한 의제가 된다고 할 것이다.
본고를 통해 치매 뿐 아니라 사회보장ㆍ사회복지에 관한 전반적인 체계와 문제점을 찾아내고 시스템 개선을 위한 초석으로 활용될 수 있기를 기대해 본다.

영어초록

This study has addressed the revision guideline for the Dementia Management Act for which no significant changes have been observed since enactment despite the announcement and implementation of the 4th National Comprehensive Dementia Management Plan along with the national dementia responsibility system. The approach is based on the five aspects: the purpose of the Act, the obligation of the nation, the establishment of the dementia management plans, agencies executing the dementia management projects, and the dementia information system. In other words, the revision guideline for the Dementia Management Act can be summarized as requiring the following: ● determining the purpose and scope of the act by considering its relation to the Welfare Law for the Elderly or the Long-Term Care Insurance for the Elderly from a legal perspective.
● completely embracing the intent or content contained in the national dementia responsibility system, national comprehensive dementia management plans, and community-integrated care projects concerning the obligation of the nation and the establishment of dementia management plans.
● having the agencies executing the dementia management projects further clarify the functions and scope of the central dementia center, metropolitan dementia centers, and dementia care centers; make the criteria of dementia care hospitals, public convalescent hospitals, etc. more suited to real-world needs; and build an effective delivery system through the links with facilities for the Welfare Law for the Elderly or the Long-Term Care Insurance for the Elderly.
● including the prevention and awareness improvement, examination and diagnosis, matters regarding dementia partners, everyday life and safety, protection of rights, social participation, family support, and matters regarding professional staff who can perform these in dementia management plans.
● enabling more systematic management through the improvement and advancement of the dementia information system.
In addition to the analysis of the delivery system and resources in the community throughout all areas related to dementia, it is natural that the revision guideline be designed by considering local-based responses or AIP(Aging in Place) and community care and other ideologies. Our society is currently experiencing an explosive growth of the aging population and the rise of concomitant dementia prevalence. Therefore, allowing the issues or policies, such as dementia, the elderly, integrated care, and social service resources, to move organically as one with each in its right position becomes an extremely critical agenda.
It is expected that this study could be utilized as the foundation for discovering the general system and problems and improving the system for not only dementia but also social security and welfare.
