초록

하늘을 나는 택시 소위 ‘에어택시’를 경험할 수 있는 날이 멀지 않았다. 국토교통부 등 관련부처에서는 2020년 『한국형 도심항공교통(K-UAM) 로드맵』을 발표하며 상용화에 박차를 가하고 있다. 에어택시는 기존의 드론운영체계와는 달리 조종자가 탑승하는 방식으로 운용될 예정이다.
드론택시 또는 에어택시를 이용한 유상운송사업을 위해서는 무엇보다 소관부처의 운송면허 허가의 법적근거 마련이 중요하다.
향후 에어택시는 정기노선이 아닌 비정기운항으로 헬리콥터의 비행고도 내에서 운용될 계획이다. 현재 헬리콥터의 여객 또는 화물의 전세운송은 항공사업법상의 소형항공기운송사업 면허의 취득으로 이루어지고 있다.
기체의 능력 차이는 있지만, 운용방법에 있어서는 헬리콥터가 큰 차이가 없으므로 항공사업법 상의 소형항공기운송사업면허 요건에 에어택시를 적용할 수 있는지 검토해보았다.
현재 개발되어 상용화를 준비중인 에어택시의 기종에 국내 현행 항공사업법을 적용하기에는 몇몇의 문제점이 있다. 대표적으로 최대이륙중량으로 항공기체를 분류하고 있는 현행법상의 분류기준에 맞지 않기 때문이다.
나아가 자율시스템을 활용한 여객 및 화물운송에 있어 항공사업법 및 드론법은 자율주행자동차법과 달리 각 운송사업의 면허기준, 기체 안전기준, 지능형교통체계 및 상용화에 따른 손해배상 준용규정등을 두고 있지 않다.
에어택시 운용에 앞서 항공사업법 상의 소형항공기운송사업면허에 개정과 동시에 자율주행자동차법과 같이 운송사업에 필요한 다양한 법률적 근거 마련이 필요하다.

영어초록

The day on which you can experience the so-called “Air-Taxi” is not far away. Delegates from ‘the Ministry of Land, Infrastructure and Transport’ are creating UAM-roadmaps and promoting commercialization. In contrast to the existing drone operating system, air taxis would be operated and driven by pilots For a commercial transport company with drone taxi or air taxi, the most important thing is to prepare a legal basis for approval of the transport by the relevant department. Air taxis will function similarly to helicopters in many ways. Like helicopters, it would be operated within a specific flight altitude, and in addition non-scheduled flights, route by air taxi.
Currently, the chartered transportation of passengers or cargo by helicopter is done through the acquisition of a small aircraft transportation license in accordance with the Aviation Business Act.
Although the aircraft capacities differ, there is no significant difference between the helicopters in terms of the method of operation. Therefore, it is investigated whether air taxis can be applied to the license requirements for small aircraft transport under the Aviation Companies Act.
There are some problems with the application of the current domestic Aviation Business Act regarding the types of air taxis that have now been developed and are preparing for commercialization.
This is because, for example, it does not meet the classification criteria of the current law, which classifies aircraft according to the maximum take-off weight.
In addition, in contrast to the autonomous driving law, the Aviation Business Act and the Drone Act do not contain rules for licensing standards, aircraft safety standards, intelligent transport systems and the commercialization of transport companies in the transport of people and cargo with autonomous systems.
Before operating the air taxi, it is urgently necessary to revise the small aircraft transport permit in accordance with the Aviation Business Act and to prepare various legal bases required for the transport business such as the law on autonomous vehicles.
