기초질서사범의 지속적 단속을 통한 강력범죄 감소 대책 필요성에 관한 연구 - 미국의 Zero Tolerance에 대한 시사점을 중심으로- (A Study on the Reduction Countermeasure of the Serious Offense through the continuous Crackdown of the Minor Infractions - Focused on Zero Tolerance in the United States -)

초록

최근 우리사회는 강력범죄의 발생이 잦았었다. 이를 예방하기 위해 법적으로는 형법상 유기징역형의 상한기준을 올려 강력하게 처벌하고 있고, 제도적으로는 성범죄자에 대한 위치추적전자장치 부착제도, 성범죄자 신상정보공개 등 다양한 형사법적인 대응책이 마련되고 있다. 하지만 이러한 사회적인 개선노력에도 불구하고 매년 심각한 범죄(serious crime)라 불리는 강력범죄의 발생율이 전체범죄의 약 1.5%, 발생건수가 약 25,000건으로 감소하지 않고 일정수준을 유지하는 것은 근본적인 관점에서 대응방안을 다시 마련할 수 있도록 형사사법체계 내에서 재검토가 필요하다는 것을 반증하는 결과라고 볼 수 있다.
이 연구에서는 상기에서 언급된 것과 같은 강력범죄에 대한 직접적인 접근방법을 간접적이면서 근원적인 시각에서 다시 접근해 보고자 한다. 이를 위해 기존에 이루어진 미국의 Zero Tolerance(이하 ‘무관용 원칙’)에 대하여 살펴보고 정책적 효과성을 되새겨보고자 한다. 즉, 강력범죄를 감소시키기 위해서 발생하고 있는 강력범죄 자체에만 집중해서 대응방안을 제시하는 것 외에 사소한 범법행위에도 관용을 베풀지 않고 엄격히 법집행을 하는 경찰활동을 통해 강력범죄 예방효과가 확산될 수 있는지에 대해 살펴보고 범죄예방 및 대응방안에 대한 시사점을 도출해보고자 한다. 물론 다양한 선행연구에서도 언급되고 있듯이 미국의 무관용 원칙을 그대로 받아들일 수는 없다. 우리의 현실에 접목한다면 어떠한 방향으로 융화될 수 있는지 또한 범죄예방에 있어 어떤 효과를 기대할 수 있는지에 대해 고민해야 한다.

영어초록

Today, the number of serious crimes cases is increasing. In order to prevent serious crimes from occurring again, such criminal restrictions as the probation system, the community service order, the probation office order, the personal information disclosure, the electronic monitoring system for the positioning of sex offenders, and the anti-sexual drug treatment are currently being applied. However, Those policies may not help to cut crime.
Therefore, we give an eye to zero tolerance policing. Zero tolerance policing is defined being tough on crimes, non-discretionary law enforcement. Zero tolerance policing based on the broken window theory. If minor incivilities are ignored, an atmosphere of lawlessness and social decay develops. This is a broken window theory.
Zero-tolerance policing is based on three ideas. One is the simple principle, ‘nip things in the bud’. Prevent anti-social elements developing the feeling that they are in charge. Prevent a broken-down and ugly environment of neglect becoming a breeding ground for crime and disorder. The second idea is that, in comparison with serious offences, low-intensity, humane, good-natured control—in those senses 'tolerant’ control—of these smaller challenges to the give-and take of decent social intercourse is a tactic open to the police officer. The third follows from the first two. At this low level of control,Zero-tolerance policing can make a distinct difference, directly by reducing petty crime, vandalism, graffiti and low-level disorder, and indirectly by creating an environment less hospitable to more serious criminals.
This study describes the approaches to the minor infractions focused on the broken window theory. Actually, NYPD has adopted zero tolerance policing on the basis of broken window theory in 1990s.
So, we examine zero tolerance policing in the United Stated and look for suggestion about zero tolerance or zero tolerance policing. In other words, this study provides an overview of the main issues relevant to a consideration of zero tolerance policing is an appropriate strategy for the South Korea. In so doing a clear definition of zero tolerance policing is outlined and the evidence for its effectiveness or otherwise in reducing crime is presented.
