초록

현행범인 체포는 구속과 유사하지만 영장없이 누구나 체포할 수 있어 인권침해의 가능성이 높다. 최근 우리 대법원은 현행범인 체포의 요건으로 체포필요성을 요구하고 있으며, 주로 증거인멸 염려와 도주우려를 기준으로 판단한다. 체포필요성 인정여부에 따라 체포의 적법성이 결정되기 때문에 체포필요성 요건과 판단기준을 수사실무상 매우 중요하다.
대상판결에서 대법원은 현행범인 체포에서 체포필요성을 요구하는 기존의 입장을 유지하였다. 현행범인에 대한 조건없는 체포를 허용하는 것보다는 체포필요성 요건을 통해서 체포권 남용을 억제하는 것이 타당하다. 또한 대법원은 하급심과 달리 체포필요성이 없다고 단정적으로 판단할 수 없다고 보아 현장경찰관의 판단을 지지하였다. 다만 체포필요성의 판단기준으로 증거인멸 염려와 도주우려를 제시할 뿐 구체적인 기준을 제시하지 못하고 있다.
영국의 경찰과 형사증거법(PACE)은 경찰관과 일반 사인의 현행범인 체포를 구분하여 규정하면서 체포필요성 기준을 구체적으로 제시하고 있다. 향후 영국의 입법례 등을 참고하여 체포필요성 판단 기준을 형사소송법이나 수사준칙에 구체화하는 것을 고려할 필요가 있다.
형사절차상 체포필요성 등 체포의 적법성을 확보할 때 경찰의 법집행에 대한 신뢰도가 제고될 것이다. 체포필요성에 대한 구체적인 법제화 이전이라도 경찰에서는 체포필요성에 대한 교육과 판단기준을 마련하여 현장에서 경찰관들이 용이하게 체포필요성을 판단할 수 있도록 하는 것이 요구된다.

영어초록

Arrests of current offenders are similar to arrest, but there is a high possibility of human rights violations as anyone can be arrested without a warrant. Recently, the Supreme Court of Korea has demanded the necessity of arrest as a requirement for arrest of current offenders, and mainly judges based on concerns about destruction of evidence and flight. Since the legality of an arrest is determined by the recognition of the need for arrest, the requirements for arrest and the criteria for judgment are very important in investigation practice.


In the target judgment, the Supreme Court maintained the existing position calling for the need for arrest in the arrest of current offenders. It is more reasonable to suppress the abuse of the arrest right through the requirement for arrest rather than allowing unconditional arrest of current offenders. In addition, the Supreme Court supported the judgment of the field police officer, as it could not conclusively judge that there was no need for arrest, unlike the lower court. However, it only presents concerns about the destruction of evidence and concerns about flight as the criteria for determining the necessity of arrest, but fails to present specific criteria.


The UK's Police and Criminal Evidence Act (PACE) separately stipulates arrests of police officers and ordinary people, and specifically presents standards for the necessity of arrest. In the future, it is necessary to consider specifying the criteria for determining the necessity of arrest in the Criminal Procedure Act or investigation rules by referring to British legislation.
When securing the legality of arrest, such as the need for arrest in criminal proceedings, the reliability of the police's law enforcement will be improved. Even before specific legislation on the necessity of arrest, it is required that the police establish education and judgment criteria for the necessity of arrest so that officers can easily judge the necessity of arrest on the spot.
