소년범에 대한 부정기형과 불이익변경금지의 원칙 (Indeterminate Sentence on Juvenile Act And The Principle of Prohibition of Judgment Disadvantageous to Defendant)

초록

1심에서 부정기형을 선고받은 소년인 피고인이 항소심 선고 이전에 19세에 도달하여 제1심에서 선고한 부정기형을 파기하고 정기형을 선고할 경우 불이익변경금지 원칙 위반 여부를 판단하는 기준이 무엇인지가 대상판결의 쟁점이다. 다수의견은 책임주의 원칙, 불이익변경금지 원칙과 소년법이 부정기형 제도를 채택한 목적을 종합적으로 고려하면 부정기형의 장기와 단기의 중간형을 기준으로 삼아야 한다고 판시하였다.
본 논문에서는 다수의견이 주장하는 논거인 책임주의, 불이익변경금지 원칙, 소년법이 부정기형 제도를 채택한 목적을 검토하여 대상판결의 논거에 대해 반박하였다.
먼저 부정기형도 징역형으로 형벌이므로 책임주의에 부합해야 함은 당연한바, 책임주의에 부합하는 형이 단기형 또는 중간형이라는 견해는 단기형이나 중간형을 넘는 형은 책임주의를 상회하는 것이 되어 타당하지 않고, 전체를 기준으로 보는 견해는 어떤 기준으로 책임의 폭을 결정하는지에 대한 구체적 해답이 없어 타당하지 않다.
다음으로 불이익변경금지 원칙은 피고인의 상소권 보장을 위한 정책적 배려에서 나온 것으로서, 피고인이 중형으로의 변경 위험으로 인해 심리적으로 위축되어 상소제기를 단념하게 되는 사태를 방지한다는 소극적인 의미를 가질 뿐, 상소심으로 하여금 피고인에게 이익이 되도록 적극적으로 반영시킬 의무를 가지는 것은 아니다. 행형실무상 부정기형제도가 사실상 부정기형의 장기를 만기로 하는 정기형으로 운영되고 있는데, 소년수형자는 가석방이 되지 않는 이상 장기형이 만료되어야지만 석방되리라는 것을 충분히 예상할 수 있으며, 따라서 소년수형자의 입장에서 불이익의 기준은 부정기형에서의 장기형이 될 수밖에 없으므로, 장기형을 기준으로 불이익 여부를 판단하더라도 피고인의 상소권을 침해한다고 볼 수 없다.
마지막으로 소년법상 부정기형의 양형은 책임을 기반으로 장기를 정한 후, 처벌의 필요성 등에 크게 저촉되지 않는 범위 내에서 소극적으로 단기를 정하는 것으로 해석해야 하므로, 결국 부정기형에서 책임에 부합하는 본래의 형은 장기형이고, 형사정책적 고려에서 단기형을 마련해 둔 것이라고 봄이 타당하다.
결국 책임주의, 불이익변경금지 원칙의 취지, 부정기형 제도의 취지를 모두 고려하면 부정기형의 장기형과 정기형을 비교하여 불이익변경금지 원칙 위반 여부를 판단함이 타당한바, 장기와 단기의 중간형이 합리적인 기준이라고 본 대상판결은 단순히 장기설과 단기설의 타협안에 불과하다는 아쉬움이 남는다.

영어초록

The issue of the target judgment is whether the standard of violation of the principle of prohibition of judgment disadvantageous to defendant for a juvenile sentenced to indeterminate sentence in the first instance who reaches the age of 19 before the court of appeal, if the judicial panel reverse the indeterminate sentence to determinate sentence in the court of appeal. The majority opinion ruled that the principle of responsibility, prohibition of judgment disadvantageous to defendant, and the purpose of Juvenile Act of adoption of indeterminate sentence system in comprehensive consideration, the standard should be based on the intermediate between long-term and short-term indeterminate sentence.
In this article, the arguments of the target judgment were refuted by reviewing the majority opinion based on the principle of responsibility, prohibition of judgment disadvantageous to defendant, and the purpose of Juvenile Act of adoption of indeterminate sentence system.
First of all, it is natural that indeterminate sentence is imprisonment and should meet the principle of responsibility. The view that short-term or intermediate-term sentences meet the principle of responsibility is not valid because they exceed the principle, and the view based on the overall is not valid because there is no specific answer to what criteria determine the scope of responsibility.
Next, the principle of prohibition of judgment disadvantageous to defendant comes from policy consideration to guarantee the defendant's entitle to lodge appeal, and it does not have an obligation to actively reflect to the defendant in the court of appeal, but it has a passive meaning of preventing the defendant from psychologically shrinking due to the risk of change to the severe sentence. In practice, the indeterminate sentence system is operated as a determinate sentence with the expiration of its long-term sentence, and juvenile prisoners can fully expect to be released only after the long-term sentence expires unless they are released on parole. Therefore the standard of disadvantage must be a long-term sentence in the indeterminate sentence, so even if it is judged whether it is disadvantageous based on the long-term sentence, it cannot be considered as violating the defendant's entitle to lodge appeal from the standpoint of juvenile prisoners.
Finally, since the determination of punishment of indeterminate sentence under the Juvenile Act should be based on long-term sentence by responsibility and it is interpreted passively so that the short-term sentence should be decided within the scope of not significantly violating the necessity for punishment. In the end, it is reasonable to assume that the sentence that meets the responsibility in the indeterminate sentence is the long-term sentence, and that the short-term sentence has been prepared in criminal policy considerations.
Eventually, considering the principle of responsibility, the purpose of the principle of prohibition of judgment disadvantageous to defendant, and the purpose of the indeterminate sentence system, it is reasonable to compare the long-term and determinate sentence to determine whether violating the principle of prohibition of judgment disadvantageous to defendant, it is regrettable that the target judgment, which saw the intermediate-term between long and short-term sentences as a reasonable standard, is simply a compromise between long-term and short-term theories.
