온라인 대학교육의 공정경쟁을 위한 법정책적 논의 — 대학온라인교육통합에 따른 사이버대학의 차별을 중심으로 — (A Study on the Legal Policy for Fair Competition in Online University Education — Focusing on the Discrimination of Cyber Universities Due to the Integration of University Online Education —)

초록

코로나19 팬데믹 상황은 대학교육에 많은 변화를 가져왔다. 사이버대학 등 원격대학에서 주로 이루어졌던 온라인 교육은 전염병 확산 방지를 위한 비대면 수업의 확대로 인해 일반대학으로까지 확대되었다. 일반대학에서의 이러한 온라인 교육의 확대는 특히 사회･경제･건강 여건상 비대면으로 대학생활을 할 수밖에 없는 학생들에게는 강의 접근성과 편리성의 증대라는 이득을 가져다주었다. 2022년부터는 사이버대학 등의 원격대학에서 주로 제공하던 온라인 교육과정을 일반대학에서도 운영할 수 있게 되었다. 즉, 일반대학에서는 학위 취득과 자격증 취득이 연계된 전공이나 정원 관리가 필요한 전공(학과)은 온라인 학위과정으로 운영할 수 없으나 석사과정 및 국내대학과 외국대학이 공동으로 운영하는 (전문)학사과정은 운영할 수 있게 된 것이다. 문제는 사이버대학의 특수대학원은 오프라인대학(일반대학)의 특수대학원과 동일한 목적으로 설립･운영함에도 불구하고 인가절차에 관하여는 오프라인 특수대학원에 비해 상당히 엄격한 규제를 받고 있다는 것이다. 사이버대학 특수대학원의 설립기준과 오프라인대학 특수대학원의 설립기준에 관한 규정을 헌법상 교육평등권에 반하지 않고 목적을 실현하는 데 적합하도록 조정할 필요가 있다.
2022년부터 시행되고 있는 ‘디지털 기반의 원격교육 활성화 기본법’은 대학 등의 원격교육에 관한 기본적 사항과 원격교육 시 교육기관의 책무 및 이에 대한 국가 등의 지원에 관한 사항을 정함으로써 교육기관에서 양질의 원격교육이 제공되는 데 기여하려는 목적으로 제정되었다. 그러나 다양한 원격교육 기관들에 대한 통일적인 정책은 아직 마련되지 않았다. 온라인 대학교육의 통일적인 시행을 위해서는 무엇보다도 관련 규정의 일원화가 이루어져야 할 것이다. 온라인 대학교육규정이 일원화되면 관련 정책들도 일원화될 수 있고 관리감독기구 역시 함께 일원화될 수 있을 것으로 보인다.

The COVID-19 pandemic has brought about many changes in university education. Online education, which was mainly conducted in remote universities such as cyber universities, has expanded to general universities due to the expansion of non-face-to-face classes to prevent the spread of infectious diseases.
This expansion of online education in general universities has provided benefits of increasing lecture accessibility and convenience, especially for students who have no choice but to live non-face-to-face college life due to social, economic, and health conditions, to increase access to lectures and convenience. From 2022, general universities will be able to operate online curricula that were mainly provided by remote universities such as cyber universities. In general universities, major (department) that requires degree or qualification management cannot be operated as an online degree course, but master's courses and (professional) bachelor's courses jointly operated by domestic and foreign universities can be operated. The problem is that even though special graduate schools of cyber universities are established and operated for the same purpose as special graduate schools of offline universities (general universities), the approval process is quite strict compared to offline special graduate schools. It is necessary to adjust the regulations on the establishment standards of special graduate schools of cyber universities and special graduate schools of offline universities to be suitable for realizing the purpose without going against the right to educational equality under the Constitution.
The “Basic Act on Revitalizing Digital-Based Remote Education,” which has been in effect since 2022, aims to contribute to the provision of high-quality remote education in educational institutions by setting basic matters on remote education such as universities, responsibilities of educational institutions, and support. However, a unified policy for various remote education institutions has not yet been established. For the uniform implementation of online university education, above all, it is necessary to unify related regulations. If online university education regulations are unified, related policies will be unified, and management and supervisory organizations will also be unified.
