우주공간의 사이버안보에 관한 국제법적 고찰 (International Legal Considerations for Cybersecurity in Outer Space)

초록

러시아의 우크라이나 침공 직전에 발생한 미국 기업 Viasat의 인터넷 통신 서비스차단은 우주 시스템의 사용자 세그먼트에 대한 성공적인 사이버공격의 한 예가 된다.
이 외에도 우주 시스템에 대한 크고 작은 사이버공격 사례는 많이 알려져 있고, 국가및 비국가 행위자는 우주 및 지상 기반 중요 인프라에 대한 사이버공격을 쉽게 실행할수 있다.
사이버공격은 “사이버공간에서 그리고 사이버공간을 통해” 수행되지만, 사실 사이버공간은 개인, 기업, 정부 등 우리 모두가 생활하고 일하는 플랫폼이다. 사이버공간과 우주 공간은 분리될 수 없고, 우주 공간에서의 사이버안보 없이는 우주 공간의평화와 안전을 보장할 수 없다. 이러한 점에서 우주 시스템에서 사이버안보 문제는특히 중요하고, 최근 느리지만 지속적으로 발전하고 있는 사이버안보 관련 국제 규범을 우주 시스템에 통합하여 적용해야 한다. 특히 지상 시스템에 적용되는 사이버안보에 관한 원칙은 우주 시스템에도 동일하게 적용될 수 있다.
다행히도 우주 공간에는 미국과 구소련이라는 두 초강대국이 우주 역량을 독점하던 시절에 체결된 우주조약 등 다양한 국제법 체계가 존재한다. 문제는 당시의 상황과지금의 상황이 매우 다르다는 점이다. 상업용 위성의 개발과 각국 정부의 민간 기업에대한 의존, 우주 공간과 사이버공간의 통합적 특성 등은 당시와 지금의 주요 차이점중 일부이다. 이러한 차이를 극복하기 위해서는 우주조약의 대대적인 개정이 필요하지만, 현재 미국 등 서방 강대국과 중국과 러시아 등 비서방 강대국 간의 정치, 경제, 군사적 대립으로 인해 이러한 국제법적 개선이 어려운 상황이다. 따라서 최근 국제안보와 관련된 분야에서 공통적으로 채택되고 있는 이른바 '책임 있는 국가 행동' 규범을 채택하고, 이러한 규범이 기존 우주조약에 현 상황을 반영하도록 정치적 합의를도출하는 것이 보다 현실적일 수 있다. 또한 기존 국제법을 우주 시스템에 어떻게적용해야 하는지에 대한 국제적 합의가 필요하다. 예를 들어, 무력 사용에 관한 국제법을 반우주 역량에 어떻게 적용할 것인지에 대한 합의가 필요하다. UN 등에서 사이버안보에 대한 규범적 진전이 이루어지고 있는 것은 우주 시스템에 적용되는 규범의개발과 개선에 도움이 된다. 이러한 국제규범의 논의는 이제 막 우주에 진출하기 시작한 한국에게 매우 중요하고, 이를 위해 국내 국제법 전문가들의 기여가 필요하다

영어초록

The blocking of internet communication services of the American company Viasat, which took place just before the Russian invasion of Ukraine, is an example of a successful cyberattack on a user segment in a space system. There are many other known examples of large and small cyberattacks against space systems, as States and non-state actors can easily launch cyberattacks against space and ground-based critical infrastructure.
While cyberattacks are conducted “in and through cyberspace,” cyberspace is in fact the platform on which we all live and work - individuals, businesses, and governments.
Cyberspace and outer space are inseparable, and without cybersecurity in space, the peace and security of outer space cannot be guaranteed. In this regard, the issue of cybersecurity is particularly important for space systems, and international norms related to cybersecurity, which have been developing slowly but continuously in recent years, should be integrated and applied to space systems. In particular, cybersecurity principles that apply to terrestrial systems also apply to space systems.
Fortunately, outer space has a diverse international legal framework, including the Outer Space Treaty, which was signed when space capabilities were monopolized by two superpowers, the United States and the former Soviet Union. The problem is that the situation then is very different from the situation now. The development of commercial satellites and governments' reliance on commercial enterprises, as well as the integrated nature of outer space and cyberspace, are some of the key differences between now and then. To overcome these differences, a major revision of the Outer Space Treaty is needed, but the current political, economic, and military confrontations between Western powers, such as the United States, and non-Western powers, such as China and Russia, make such an improvement in international law difficult.
Therefore, it may be more realistic to adopt so-called norms for “responsible State behavior,” which have been commonly adopted in recent years in the areas related to international security, and to build a political consensus to ensure that these norms reflect the current situation in the existing Outer Space Treaty. There is also a need for international agreement on how existing international law should be applied to space systems. For example, there needs to be agreement on how international law on the use of force applies to anti-space capabilities. The progress being made in cybersecurity at the United Nations and elsewhere is instructive in the development and refinement of the norms applicable to space systems. This discussion of international norms is important for the Republic of Korea, which is just beginning to enter outer space, and the contribution of Korean international law experts is needed in this regard.
