테러방지법상 테러단체의 정의조항 개정방안 : 테러단체 지정권에 착안하여 (A Study on the Amendment on Definition of Terrorist Groups under the Korean Counterterrorism Act : With an Eye on the Right to Designate a Terrorist Organization)

초록

우리나라 테러방지법상 테러단체의 정의는 매우 이례적인 것이다. 이 점은 비교법적 분석․검토에 의해서도 확인된다. 현재의 테러단체 정의는 테러방지를 위한 입법이 시급한 상황에서 논란이 적은 것을 택한 결과였다. 하지만 테러단체 지정권이라는 국가주권을 포기한 측면이 있고, 즉각적․효율적인 대테러 대응의 면에서 문제를 초래할 가능성이 상존한다. 따라서 가능한 한 빠른 시일 내에 개정을 추진해야 한다.
테러단체 정의조항에 대한 대안을 모색함에 있어서는 두 가지 고려가 필요하다. 첫째, 불명확하거나 자의적 적용 가능성이 있는 용어는 피해야 한다. 둘째, 대한민국의 테러단체 지정권이라는 주권의 회복을 통해 적시에 대처할 수 있는 메카니즘을 확보하는 것이어야 한다. 이러한 시각에서 필자는 수용가능한 대안으로 첫째, ‘UN 또는 EU가 선정한 테러단체와 국가테러대책위원회가 지정한 테러단체로 정의하는 방안’과 둘째, ‘국가테러대책위원회가 지정한 테러단체로 정의하는 방안’을 제시하였다. 두 번째 안이 더욱 바람직한 것이지만, 한국적 현실에서 당장 채택되기는 어려워 보인다. 무엇보다도 인권단체 등의 강력한 반대에 부딪힐 것으로 예상되는 까닭이다. 따라서 우선 첫 번째 안으로의 개정을 추진하고, 두 번째 안은 중․장기적인 차원에서 접근하는 것이 타당하다.
개정안에서 보듯이 테러단체 지정의 권한은 우리나라 테러방지법 체계 내에서 최고의결기구인 ‘국가테러대책위원회’가 갖도록 하는 것이 적절하다. 다만, 테러단체의 지정과 관련해서 우려되는 권한 남용의 방지 또는 인권과 대테러활동 간의 조화를 기하는 차원에서 테러단체 지정과 관련해 합법적 통제장치를 마련하는 것이 바람직하다. 예컨대, 국회 보고 및 민주적 통제, 인권보호관의 테러단체 지정 절차에의 개입이 그러한 예라고 할 수 있다.

영어초록

The definition of “terrorist groups” under the Counterterrorism Act of the Republic of Korea(ROK or South Korea) is quite exceptional. This point is confirmed by analysis in comparative law perspective. The current definition of “terrorist groups” was a result of choosing a less controversial one at a time when legislation for the prevention and suppression of terrorism was urgently needed. However, in some aspects, South Korea renounces her national sovereignty, especially a power to designate a terrorist organization. Moreover, there is a possibility that the choice will cause problems in terms of immediate and efficient counterterrorism response. Therefore, some amendment of “terrorist groups” definition clause should be pursued as soon as possible.
Several considerations should be taken in seeking alternatives to the present “terrorist groups” definition. First of all, words that are unclear or likely to be applied arbitrarily should be avoided. In addition, it could establish a mechanism to cope with terrorist activities in a timely manner if the country restores a sovereign right to designate terrorist organizations. In this viewpoint, I proposed two acceptable alternatives. One is a plan to define terrorist groups as “terrorist organizations selected by the UN or the EU and those ones designated by the National Counterterrorism Commission of ROK. The other is a plan to define terrorist groups as “terrorist organizations designated by the National Counterterrorism Commission.” The second proposal is more desirable, but it seems difficult to be adopted immediately in Korean reality. That is why it is expected to face strong opposition from human rights NGOs. Therefore, it is reasonable to promote the first proposal at this time, and to approach the second proposal at the mid- to long-term level.
As seen in the two proposed amendments, it is appropriate to give a power to designate terrorist organizations to the "National Counterterrorism Committee," the highest decision-making body within the Korean counterterrorism law system. In such case, it is desirable to set up certain control systems in order to prevent abuse of power in the process of designation or to harmonize human rights and counterterrorism activities. We could present governmental reporting to National Assembly and human rights protection officers' intervention in the designation process as good examples of lawful control.
