초록

대판 2003.1.24, 2000다22850은 채권양도에서의 보상관계의 해제와 그에 따른 채무자의 부당이득반환청구의 상대방을 채권양수인이라 하고 있으므로, 지급의 단축을 위한 일련의 삼각관계형 부당이득과 관련된 판례의 논리와는 부합하지 않는다. 채권양도가 이루어지는 원인은 여러 가지가 있지만, 급부의 단축도 하나의 이유가 될 수 있다. 부당이득반환청구사안에서 실제로 재산을 출연한 자가 자신과 계약관계에 있지 않은 자와의 관계가 문제되는 점은 지시사례에서와 같다. 그러나 채권양도에서는 채권은 동일성을 상실하지 않고 양도되지만, 채권양수인은 단순한 수익자가 아니라 새로운 채권자라는 점이 다소 상이한 점이다. 계약관계의 청산은 계약당사자 사이에서 행하여져야 한다. 채권양도에 의하여 곧바로 채권양도인과 채무자의 계약관계가 소멸하는 것은 아니므로, 계약관계의 청산은 여전히 당사자 사이의 문제로 남게 되기 때문이다. 따라서 채무자의 관여 없이 행하여진 채권양도에 의해서 채무자가 계약상대방이 아닌 채권양수인의 무자력 위험을 부담하는 것은 타당하지 않다. 그 이유는 채권양도인이 채권양수인에게 채권양도를 한 것은 지시의 경우와 대비할 수 있으며, 채무자는 채권양도에 의하여 그의 지위가 불리해져서는 안 되기 때문이다. 따라서 채권이 양도된 후 보상관계가 해제된 경우 부당이득반환은 당해 계약의 당사자들인 양도인과 채무자간에 이루어져야 할 것이다.

A judicial judgment determines that the transferee of credit shall be the person with whom a claim for recapture of unjust enrichment is filed when a compensation relationship is terminated after the credit has been transferred. However, this is not coincident with the logic of a precedent about a number of triangle-type unjust enrichment cases for the curtailment of payment.
Credit may be transferred for various causes including the curtailment of benefits. The indicated case shows problems of a relationship between a person who has actually contributed his properties, and another who does not have a contract relationship with him; for example, in a case of a claim for recapture of unjust enrichment. However, the transferal of credit is somewhat different from a claim for recapture of unjust enrichment in that credit is transferred without losing its identity while the transferee of credit is not simply a beneficiary, but a new creditor.
A contract relationship should be settled between contract parties. A contract relationship between the transferor of credit and the debtor shall not be terminated as soon as credit is transferred, and the settlement of a contract relationship shall remain an issue to be tackled between the concerned parties. Consequently, it is not appropriate that the debtor shall take over an insolvency risk of not the party of a contract, but a credit transferee, due to the cession of an obligation that is not brought about by the debtor. It is because the indicated case is not comparable to the cession of an obligation implemented by the transferor of credit for the sake of the credit transferee, and because the status of a debtor shall not be disadvantaged by the transferee of credit.
Therefore, in a case where a compensation relationship is terminated after the credit has been transferred, the recapture of unjust enrichment shall be executed between the parties concerned of a contract, including the transferor and the debtor.
