초록

온라인 플랫폼 규제에 대한 주요 국가의 정책방향은 다음과 같이 분류할 수 있다. 첫째, EU처럼 강력한 사전규제 입법을 추진하는 것이다. 둘째, 독일이나 영국처럼 사전규제 입법과 전통적 경쟁법 집행을 절충하는 것이다. 셋째, 일본처럼 사전규제 신규입법을 하되 적용대상과 규제범위를 한정하는 것이다. 넷째, 대만처럼 시장추이를 지켜보면서 플랫폼 사전규제 입법의 필요성을 검토하는 것이다. 다섯째, 최근 미국처럼 신규입법을 자제하고 기존 공정거래법 집행을 강화하는 것이다.
우리나라의 온라인 플랫폼 정책방향은 국내경제와 시장상황을 종합적으로 고려하여 수준과 범위의 적절성을 평가하고 결정되어야 한다. 현 시점에서 우리나라는 대만처럼 신중하게 국내외 상황을 지켜보는 것이 최선이다. 우리 플랫폼 시장의 상황, 글로벌 시장 진출, 규제오류 및 기존의 공정거래법의 효과적인 집행 상황 등을 고려해야 하기 때문이다. 그 결과 필요하다면 미국처럼 공정거래법 집행을 크게 강화하고 인적･물적자원 투입을 증가시키는 것이 바람직하다. 그럼에도 사전규제입법이 반드시 필요하다면 일본 방식이 바람직하다. 당장 규제가 시급한 서비스 분야와 적용대상 사업자를 최소한으로 정해야 하고, 글로벌 빅테크가 규제대상이 될 가능성이 클 것이다. 그러나 기존 경쟁법과 상충되는 측면과 집행오류의 가능성이 있으므로 사전규제 입법의 도입은 사회적 합의가 있어야 한다.
사전규제 신규입법을 하더라도 집행기관은 공정거래위원회가 되는 것이 자연스럽다. 주요국 추세와 일치하며 사전규제에 대해 상당한 경험과 능력을 갖고 있기 때문이다. 최근 공정거래위원회는 온라인 플랫폼법 제정 대신 기존 공정거래법을 개정하겠다고 발표하였다. 이는 독일식으로 공정거래법을 개정하여 DMA와 전통적 경쟁법 규율을 절충한 내용의, 기존 공정거래법보다 규제를 강화하겠다는 것으로 이해된다. 종전의 사전규제에 비하여는 크게 진전된 것이지만 여전히 과잉규제의 우려와 미국 빅테크와 비교하여 국내 플랫폼이 불리해지는 역차별의 우려가 있을 수 있다.
우리나라 온라인 플랫폼 정책은 글로벌 경쟁을 염두에 둔 정책적 고려가 함께 이루어져야 한다. 사전규제의 도입 여부는 경제정책 전반과 조화를 가져야 한다. 한편 신규입법의 필요 논거인 갑을관계 규제는 계속 관심의 대상이 되어야 한다. 규제방식은 기업 간의 순수한 자율규제가 우선 고려되어야 하지만, 동시에 그림자 규제로 변질되는 것을 경계할 필요가 있다.

영어초록

The regulatory approaches of major countries toward online platforms can be broadly categorized as follows: (i) adopting strong ex-ante rules, as seen in the EU; (ii) striking a balance between the enactment of ex-ante rules and the enforcement of traditional competition law, as adopted in Germany and the UK; (iii) introducing new ex-ante rules but limiting their scope and applicability, as in Japan; (iv) monitoring market trends and assessing the need for ex-ante regulations, as in Taiwan; and (v) refraining from enacting new ex-ante rules while reinforcing the enforcement of existing antitrust laws, a stance recently adopted by the United States.
Korea's regulatory policy direction for online platforms should be carefully considered based on the local economic and market context. At present, a prudent approach, akin to Taiwan's, of closely observing both domestic and international developments of market structure and competitive landscape appears optimal. It may proceed to follow the model of the United States to strengthen the enforcement of existing antitrust laws, increasing human and budget investment if necessary. This cautious stance takes into account the current status of the local platform market, the challenges of global market entry, the risk of false positives, and the effective enforcement of existing Korean competition law. If ex-ante legislation becomes imperative for any reasons stretching beyond a simple harms from a relevant market concentration e.g. threat to the general ecosystem of platform economy or democratic social system, the Japanese model is preferable. The legislation should be narrowly custom designed, targeting specific service areas to address serious competitive harms. Major Big-Techs may possibly be designated. Nonetheless, given potential conflicts with existing competition laws and the risk of over-enforcement errors, undermining efficiency, any move toward ex-ante legislation must be underpinned by broad social consensus.
If new ex-ante rules are to be enacted, it is logical for the Korea Fair Trade Commission (KFTC) to serve as the enforcement authority. This aligns with international trends and leverages the KFTC’s substantial experience and expertise in ex-ante regulation. The KFTC has recently announced plans to amend existing Korean competition law rather than enact a new law for online platforms, offering opportunities of showing efficiency after a presumption of dominance and anti-competitive effects. This amendment can be seen as a German-style adaptation, striking a compromise between the Digital Markets Act (DMA) and traditional competition law, and signaling a strengthening of regulatory measures compared to the current framework. While this represents significant progress over the previous proposal of ex-ante regulations, concerns remain. Despite the rigidity of regulations, it may disclose the reverse-discrimination eventually that may disadvantage local platforms.
Ultimately, modern Korea's online platform policy, faced with global competitive threat, needs to align with broader economic policies. Any decision to introduce ex-ante regulations should be consistent with the country’s overarching economic strategy. Meanwhile, issues related to power imbalances between platforms and SME transacting partners and consumers, which are often cited as justification for new legislation, should remain a topic of ongoing concern. Nevertheless, voluntary self-regulation among companies should be explored as a first option with a caution against being polluted toward shadow government regulations. In parallel, urgent consumer protection measures must be addressed, necessitating an expedited revision of the Korean Electronic Commerce Act.
