미성년자에 대한 성적 침해와 손해배상청구권의 소멸시효 (Sexual infringement against minors and extinctive prescription of the right to claim damages)

초록

한국은 2020년 민법 개정을 통해 성폭력 등 성적 침해로 인한 미성년자의 손해배상청구권에 대하여 성년이 될 때까지 소멸시효의 진행을 정지시키는 규정을 신설하였다. 이는 미성년자에 대한 성적 침해 사건의 특수성을 고려할 때 정당한 입법 조치이고 국제적 입법동향에도 부합하는 것이라고 평가할 수 있다. 또한 장기소멸시효의 기산점을 그 성적 침해로 인한 PTSD 등의 증상이 의사(醫師)에 의해 진단된 시점으로 완화한 것도 장기시효 기간이 상대적으로 짧게 규정되어 있는 우리 민법의 해석론상 불가피한 측면이 있다고 판단된다.
소멸시효제도가 법적 안정성을 기하는데 그 목적이 있다는 관점에서 보면 시효기간을지나치게 장기화하는 것은 그 제도적 취지에 반한다는 비판에 직면할 수 있다. 그러나 미성년자에 대한 성적 침해는 그 피해의 특수성을 고려하여 ‘성년이 될 때까지 그리고 가해자와의 공동생활이 종료될 때까지’ 시효의 진행을 정지시켜야 한다. 나아가 장기소멸시효기간도 크게 연장해야 한다. 그 기간을 20년으로 정할 것인지, 아니면 30년으로 정할 것인지는입법정책적 결단의 문제이지만, 시효의 기산점을 현재와 같이 완화하여 해석한다면 20년의기간의 정함으로도 충분한 권리보호가 가능할 것이다.

영어초록

Through the revision of the Civil Act in 2020, Korea has established a new regulation to suspend the progress of the extinctive prescription until adulthood for the right to claim damages of minors due to sexual violence and other sexual infringement.
Considering the specificity of sexual infringement cases against minors, this is not only a legitimate legislative measure but also a response to international legislative trends. In addition, I think it is inevitable in the interpretation of Korean civil law that the starting point of the long-term extinctive prescription was alleviated to the point when symptoms such as PTSD due to sexual infringement were diagnosed by a doctor.
As is well known, apart from the regulations on the suspension of prescription, BGB, Code Civil, and Japanese civil laws stipulate the following long-term extinctive prescription period. In principle, BGB has 30 years for the right to claim damages due to intentional infringement of sexual self-determination rights (short-term prescription regulations are deleted), and Code Civil has 20 years for the right to claim damages due to sexual infringement against minors. In this regard, legislative proposals to extend the extinctive prescription period to short-term 10 years and long-term 20 years (or 30 years) continue in Korea. Excessive prolongation of the extinctive prescription period may be criticized as contrary to the original purpose of the prescription system. However, sexual infringement of minors should stop the progress of the extinctive prescription "until adulthood and until the end of community life with the perpetrator" in consideration of the specificity of the damage. Furthermore, the long-term extinctive prescription period should be greatly extended. Whether to set the period to 20 years or 30 years is a matter of legislative policy judgment, but if the starting point of the prescription is interpreted by easing as it is, I think it is possible to protect the rights even with a 20-year period.
