중국의 폐기물 법제의 최근동향과 시사점 (Recent Trends and Implications of China’s Waste Legislation)

초록

중국은 세계에서 고체폐기물 발생량이 가장 많은 국가 있고, 2018년 이전에는 고체폐기물을 대량 수입하여 재활용 자원으로 이용하기도 하였다. 현재 중국의 고체폐기물 법제는 중국의 중요한 환경법률제도인데, 「고체폐기물오염예방퇴치법(1996년)」을 핵심으로 「청정생산촉진법(2002년)」 및 「순환경제촉진법(2008년)」 등이 고체폐기물 관리의 근거법률이다. 중국의 고체폐기물법제는 중국 내에서 대량의 고체폐기물 문제에 대응하는 효과적인 제도로서, 20여 년 동안 줄곧 핵심적인 역할을 해왔다. 그러나 급속성장과 사회변화 등의 과정을 거치면서 중국에서는 기존의 고체폐기물법제에 대한 한계가 부각되었고, 여러 분야에서 발생하는 폐기물문제에 효과적으로 대처할 수 없게 되었으므로 제도의 개선이 시급한 상황이다.
따라서 본 연구에서는 중국 고체폐기물 법제 연혁을 회고하면서 중국 고체폐기물법제가 전통적인 오염통제모델에서 순환 및 재사용 모델을 중심으로 변화해가는 과도기임을 명확히 하면서, 중국 고체폐기물 법제발전을 촉진하고자 하였다. 또한 중국의 고체폐기물법의 입법 목적, 입법 원칙, 고체폐기물 법제 연구의 동향과 폐기물처리의 원칙인 감량화ㆍ무해화ㆍ자원화를 도입한 소관부처별 다양한 고체폐기물(예를 들면 공업폐기물ㆍ농업폐기물ㆍ포장 등) 및 특수 고체폐기물(위험폐기물ㆍ전자제품ㆍ자동차 등)의 관련 제도와 규정을 등을 소개하고자 하였다. 그 중에서도 2018년 생태환경부의 고체폐기물환경오염방지법(개정초안의견)을 제출하고 2019년 말에 제13기 전국인민대표대회 상무위원회는 「고체폐기물환경오염방지법 (개정초안 2차심의안)」을 제출하였다. 고체폐기물환경오염방지법의 대규모적인 개정은 중국의 고체폐기물의 사업에 전면에 중대한 영향력을 가질 것이며, 심지어 세계적으로도 영향력을 가할 것으로 예상된다. 특히 「고체폐기물환경오염방지법(개정초안 2차심의안)」 의 연구를 통해 중국은 고체폐기물법제면에서 고체폐기물과 환경보호세제도를 접목하였는데, 고체폐기물의 수입 금지ㆍ생활폐기물의 분류배출ㆍ정보공개와 참여 강화 등 문제를 중점적으로 강조하였다. 기존의 법률조항과 2차심의안의 내용 중 부분적 내용과 중점내용 간의 차이점을 비교 시, 중국사회는 고체폐기물오염문제에 대하여 거대한 모순이 존재한다는 것을 알 수 있다. 그 중에서도 중국 고체폐기물법제의 체계 내에 존재하는 입법 목적의 불명확성, 농촌구역에서 농업폐기물 문제, 정부의 감독 관리 책임의 모호성, 「고체폐기물환경오염방치법」,「청정생산촉진법」,「순환경제촉진법」 등 3법의 상호관계와 법률적용 등에 대한 문제점과 쟁점이 있었다. 이 논문은 한국의 법학자들로 하여금 중국의 폐기물법제의 문제에 대한 관심 유도에 일조하기를 기대해본다.

영어초록

China is the country with the largest amount of solid waste in the world. Before 2018, China also imported solid waste as a resource for reuse. At present, China’s solid waste legal system is an important environmental legal system. The main content is based on the “Solid Waste Environmental Pollution Prevention and Control Law” (1996) as the core, including the “Cleaner Production Promotion Law” (2002) and the “Circular Economy Promotion Law” (2008) on solid waste. China’s solid waste legal system is an effective institutional means to deal with the large amount of solid waste generated in the country, and has played a key role for more than 20 years. However, in the process of rapid economic growth and social change, China’s existing solid waste legal system is unable to effectively respond to waste problems in many new fields, and the improvement of the system is imminent.
This study, by reviewing the evolution of China’s solid waste legal system, clarified the transition phase of China’s solid waste legal system from a traditional pollution control model to a new model centered on recycling and reuse, and promoted the thinking on the development context of China’s solid waste legal system. By introducing the legislative purpose and legislative principles with Chinese characteristics, the trend of China’s solid waste legal system is studied, and a variety of solid wastes (such as industrial waste, agricultural waste, packaging waste, etc.) are summarized under the principles of reduction, harmlessness, and resource utilization. And some special solid wastes (dangerous wastes, electronic products, and autos, etc.) related systems and regulations. In 2018, the Ministry of Ecology and Environment proposed a draft revision proposal of Solid Waste Environmental Pollution Prevention and Control Law. At the end of 2019, the National People’s Congress proposed a Second review of the draft amendment to the Solid Waste Environmental Pollution Prevention and Control Law. The large-scale revision of the Solid Waste Environmental Pollution Prevention and Control Law will have a comprehensive and profound effect on the prevention and control of environmental pollution by solid waste in China. The impact may even have an impact on the flow of solid waste worldwide. After studying the new draft amendment, China will focus on the connection between solid waste and the environmental protection tax system, prohibit the import of solid waste, establish a new domestic waste specify, strengthen information disclosure and participation. Comparing the differences between the original text of the article and some of the key points in the content of the draft amendment, we can see that there is a huge contradiction in Chinese society on the issue of solid waste pollution. By summarizing the existence of China’s solid waste legal system, such as unclear legislative purposes, major challenges facing solid wastes in rural areas, vague government supervision and management responsibilities, and the Solid Waste Environmental Pollution Prevention and Control Law, the Cleaner Production Promotion Law, the Circular Economy Promotion Law’s interrelated and applicable, analyze the problems and deficiencies of China’s solid waste legal system, discuss the current Chinese waste legal system. The paper also hopes that Korean scholars will pay attention to the impact of China’s waste legislation.
