중국 영상저작물의 저작권 귀속에 관한 검토 (A Study on Copyright Attribution of Cinematographic Works in China)

초록

한국 영화산업은 규모와 내용면에서 급속하게 확대되고 있고 최근 한국과 중국 간의 영상물시장의 교류 양식은 완성된 영화의 수출보다는 자본과 인력의 국가 간 유동 및 연합의 경향이 두드러지고 있다. 따라서 중국 영화시장에서의 원활한 활동을 위해서는 중국 내 저작권법제와 영상저작물 관련 정책에 대한 이해가 필요하다.
영상저작물의 저작권 귀속과 관련하여 중국저작권법은 제작자중심주의를 취하고 있으며 영상저작물에 관한 제반 저작재산권과 저작인격권이 모두 원시적으로 영상제작자에게 귀속된다고 규정하고 있다. 반면, 한국저작권법은 영상저작물에 대한 원시적 저작권 취득 규정이 아닌 양도추정을 두고 영상제작자가 원시적으로 영상물의 저작자로서의 지위를 가질 수 있는지에 대해서는 규정하고 있지 않다는 점에서 중국법과 차이가 있다. 영상제작자의 범위와 관련하여 중국의 경우에는 영상제작자가 될 수 있는 자격이 사실상 법인으로 제한되지만, 한국의 경우에는 자연인도 영상제작자가 될 수 있다. 영상저작물의 제작과 관련하여 중국 내 강한 행정관여가 존재하므로 한국자본이 중국에서 영상저작물의 제작을 원하는 경우에는 중국현지 제작단위와 합력하거나 중국자본과 결합하여 공동으로 영상저작물을 제작하여야 한다. 특히 한국자본이 중국 측과 협력하여 중국에서 제작하는 영상저작물에 관한 저작권을 확보하기 위해서는 중국법에 따라 영상저작물에 대한 투자자라는 지위를 인정받는 것이 가장 중요하다고 보인다.
또한 이 논문에서는 영상저작물의 저작권 귀속과 관련한 중국법 규정의 검토를 바탕으로 개정 작업 단계에 있는 중국저작권법에 대한 몇 가지 개정안을 제안한다. 중국저작권법 내 제작자의 의미를 명시하고, 과학기술의 발전과 영상문화의 보급에 따라 개인 주도하에 창작된 영상저작물이 증가하고 있으므로 영상제작자의 범위에 법인과 함께 자연인도 포함되어야 한다고 제안한다. 그 밖에 영상저작물의 저작권 등록 강화와 영상저작물 저작자의 인격권 보호가 강화될 것을 제안한다.

영어초록

In the field of cinematographic composition, the exchange between Korea and China has changed. In the past, Korea and China simply exported to each other's market in the form of finished works, but recently, the two countries' manpower and capital enter the other's market and make cinematographic works there. In case the Korean workforce and capital enter the Chinese market and produce cinematographic works, the issue of copyrights related to the cinematographic production can arise. Thus, this article examines the copyright attribution related to the cinematographic works produced in China. This article examines the significance of cinematographic works, the copyright attribution system of cinematographic works under Copyright Law of the People’s Republic of China(heafter "China's Copyright Law"), reviews the draft revision of China's Copyright Law and finally suggests some ways to improve the Chinese legal system.
In relation to the copyright attribution of cinematographic works, China's Copyright law is different from Korea Copyright Act in that it takes author-centeredism and that all authoring rights and moral rights related to cinematographic works are attributed to cinematographic producers, while Korea Copyright Act does not prescribe whether a cinematographic producer can have a primitive position as a creator of a cinematographic work. Since there is a strong administrative involvement in the production of cinematographic works, it seems to be important that Korean or foreign cinematographic producers are recognized as investors in cinematographic works in order to secure copyrights for cinematographic works produced in China.
In addition, this article suggests some amendments to the China's Copyright Act, examining the Chinese legal provisions related to copyright ownership of cinematographic works. As the number of cinematographic works created under individual initiative is increasing due to the development of science and technology and the spread of visual culture, it is suggested that the scope of the film-maker should include the natural person along with the legal entity. In addition, it proposes that strengthened copyright registration of cinematographic works and protection of moral rights of authors of cinematographic works.
