초록

기존 복잡하게 얽혀있는 정부의 물관리정책은 2019년 제정한 물관리기본법을 통하여 통합물관리라는 목표를 향하여 나아가고 있다. 물관리기본법은 통합물관리를 수행할 수 있는 주체로 물관리위원회에 권한을 부여하고 있다. 국가 최상위 규범을 가지고 있는 물관리기본법과 그 법률에 근거하여 탄생한 제1기 물관리위원회는 제1차 국가물관리기본법을 수립하여 통합물관리를 위한 기반을 다져놓았다. 하지만 법정기 한내 유역물관리종합계획을 수립하지 못하였으므로 절반의 성공이라 말 할 수 있을 것이다. 진정한 통합물관리 진행은 국가기본계획을 중심으로한 유역물관리종합계획 수립이후 진행될 것으로 예상하고 있다.
동법은 통합물관리를 위한 제도로 부합성심사제도를 규정하고 있다. 부합성심사제 도를 통하여 국가물관리위원회가 수립한 제1차 국가물관리기본계획의 내용이 현장 에서 물관리를 담당하고 있는 지방자치단체에게로 전달하는 역할을 기대하고 있다.
그렇게 하기 위해서는 유역물관리종합계획이 철저한 검증을 통하여 수립되어야 한다.
현재 정부는 매년 4대 유역위원회가 약200건 정도의 물관리종합계획을 각 유역물관 리위원회에서 심의하여 의결 절차가 진행 할 것으로 예상하고 있다.
하지만 통합물관리라는 국내외적인 필요성에도 불구하고 물관리위원회가 해결해 야할 숙제들이 산적한 것이 현실이다. 부합성심사제도를 통하여 물관리일원화 즉 통합물관리를 추진해야하는 물관리위원회의가 현재 다양한 논의에 직면하고 있다. 예컨대 물관리위원회의 법적 지위와 효력, 독립성과 객관성 확보 등 다양한 정치적 또는 법적 논쟁에 휩싸여 있다. 이 문제를 해결하지 못한다면 향후 물관리위원회가 추진하는 부합성심사제도가 참여자 뿐만 아니라 국민들에게도 불신의 눈빛으로 비쳐질 수가 있다.
현재 물관리위원회가 불완하고 모호한 법적 지위를 가지고 있는 것은 사실이다. 하지만 통합물관리를 위한 주체로서 필요성은 충분히 사전 검토를 통하여 확보하였다. 기후변화 등 앞으로 변화하는 환경에 대응하기 위한 물순환을 안정적으로 관리하기 위한 기구로서 기능을 강화하여야 할 것이다. 정책을 추진하기 위해서는 단기적으로 부합성심사제도를 통하여 제1차 국가물관리기본계획의 내용을 바탕으로 조속히 제1 차 유역물관리종합계획을 수립하여 지방자치단체들의 정책에 대한 부합성심사를 진행 하여야 할 것이다. 또한 장기적으로 법 개정을 통하여 위원회의 정부조직법 개정을 통하여 법적 독립성을 확보하고, 사무국 확보를 통한 전문성을 강화하며, 부합성심사를 통하여 준사법적기구로서 역할을 구현해 나아가야 할 것이다.

The govern ment bodys water management policies, which were previously complicated, are moving toward the goal of integrated water management through the Fundamental Water Management Law enacted in 2019. The Fundamental Water Management Law grants authority to the Water Management Commission as an entity capable of carrying out integrated water management. The Fundamental Water Management Law, which has the highest level of national standards, and the 1st Water Management Committee, which was created based on that law, established the 1st National Fundamental Water Management Framework Plan and laid the foundation for integrated water management. However, since the comprehensive basin management plan was not established within the statutory period, it can be said that it was a half success. It is expected that the progress of true integrated water management will proceed after the establishment of the comprehensive basin management plan centered on the national framework.
The law stipulates the Consistency System as a system for integrated water management. It is expected that the contents of the 1st National fundametal water framework established by the National Water Management Commission will be delivered to local governments in charge of water management in the field through the compatibility review system. To do so, a comprehensive water basin management plan must be established through thorough verification. Currently, the government anticipates that the four basin commission will review about 200 comprehensive water management plans each year and proceed with the resolution process.
Howe ver, despite t he domes t ic a nd i nter nat iona l neces sit y of integrated water management, the reality is that the water management commission has a lot of homework to solve. The water management com m ission meeting, which shou ld promote u nification of water ma nagement, that is, integrated water ma nagement, through the Consistency System, is currently facing various discussions. For example, it is embroiled in various political or legal controversies, such as the legal body status and effectiveness of the water management committee, and securing independence and objectivit y. If this problem is not resolved, the compatibility Consistency System promoted by the Water Management Commission in the future may be seen with distrust not only by the participants but also by the public.
It is true that the current water management commission has an incomplete and ambiguous legal status. However, as a subject for integrated water management, the necessit y was secured through sufficient prior review. As an organization to stably manage the water cycle to respond to the changing environment in the future, such as climate change, its function should be strengthened. In order to promote the policy, based on the contents of the 1st National fundametal water framework for Water Management through the short-term Consistency System, promptly establish the 1st Comprehensive Basin Management Plan and proceed with the conformity review for the policies of local governments. will have to In addition, in the long term, the Commission should secure legal independence through revisio, strengthen expertise through securing a secretariat, and implement its role as a quasi-judicial organization through conformity examination.
