초록

통신망 사업자가 제공하는 셋톱박스를 넘어서라는 어원을 가진 OTT(Over the top)는 구글의 유튜브 영향력의 증대와 맞물려 활기를 띠기 시작했다. 나아가 다국적기업인 넷플릭스가 국내 서비스를 2016년도 시작하면서 이에 대항 하기 위해 기존 방송3사가 만든 웨이브 등의 사업자가 우후죽순 생겨나며 그야말로 OTT 대전이 펼쳐지게 된다. 더군다나 코로나19로 말미암아 집에서 보내는 시간이 늘어남에 따라 OTT 서비스에 대한 수요는 폭발적으로 증가한다. 이에 OTT 콘텐츠에 대한 사전등급분류를 담당하는 영상물등급위원회의 과부하가 발생한다. OTT 업계에서 지속적으로 요청되었던 사업자가 콘텐츠에 대해 자체적으로 등급을 부여하는 자체등급분류제에 대한 논의가 이뤄졌고, 결국 「영화 및 비디오물의 진흥에 관한 법률」 개정으로 도입하게 된다.
자체등급분류제는 OTT 업계에 시의적절하게 제작한 콘텐츠를 적기에 제공할 수 있는 기회를 제공한다. 다만, 청소년 보호 관련해서 유해매체물에 대해 사전적으로 통제할 수 있는지가 관건이다. 법률안 개정 논의 단계에서부터 이에 대한 고민을 찾아볼 수 있다. 즉 OTT 서비스 제공업체의 자체등급분류 지정 및 재지정과 관련해서 일정한 요건만 갖추면 모두 허용하는 신고제가 아닌 요건을 갖춘 업체중에 문화체육관광부장관이 선택하는 지정제를 채택하였다. 물론 3년동안 지정제로 운영하고 운영 결과를 분석해 신고제로 변경할 수 있는 가능성이 존재한다.
이러한 자체등급분류의 대상은 온라인 비디오물이며, 제한관람가는 제외된다. 다만 이러한 제한관람가로 자체등급분류를 이행 할 사업자는 존재하지 않기 때문에 제한관람가를 제외한 것은 단순 선언적 규정에 지나지 않을 것으로 보인다. 자체등급분류를 거친 온라인 비디오물은 영상물등급위원회의 등급분류와 같은 동일한 효력을 지닌다. 다만, 서비스 제공 후 5영업일 이내에 관련 등급분류 결과를 영상물등급위원회에 통보해야 하는데 이를 토대로 영상물등급위원회는 자체등급분류의 적정성을 검증해서 직권으로 등급을 재분류 할 수 있다. 다만 서비스가 이미 제공된 후 적정성 검증이 이뤄지기 때문에 청소년 보호에 있어 서비스 제공전에 적정성 검증이 이뤄질 수 있도록 규정을 변경하는 것이 필요하다고 본다. 자체등급분류의 적정성을 제도적으로 뒷받침하기 위해 사후관리 차원에서 영상물등급위원회 내에 자체등급분류사후관리위원회와 자체등급분류지원분과위원회를 둘 수 있다. 이러한 위원회의 적극적인 활동이 자체등급분류제가 정착할 수 있는 토대가 될 것이라고 본다. 결국 자체등급분류제는 영상물등급위원회의 인력 및 예산의 한계로 도입된 측면이 크다고 본다. 따라서 기존에 사전등급분류를 통한 유해한 매체물의 청소년 유입을 사전적으로 차단하는데 있어 그 차단 정도가 낮아질 가능성이 크다고 여겨진다. 따라서 체계적인 시스템을 적용해서 자체등급분류제가 OTT 업계뿐만아니라 청소년보호에 있어서도 그 기능을 다할 수 있도록 영상물등급위원회의 역할이 필요하다.

영어초록

OTT (Over the top), which has the etymology to go beyond the set-top box provided by telecommunication network operators, has begun to become active in line with Google's growing influence on YouTube. Furthermore, as Netflix, a multinational company, started its domestic service in 2016, operators such as Wave created by the three existing broadcasting companies will emerge in a flurry to counter this, leading to an OTT battle. Furthermore, as the time spent at home increases due to COVID-19, the demand for OTT services explodes. As a result, the Video Rating Committee, which is in charge of pre-rating OTT content, is overloaded. Discussions were held on the self-rating classification system, in which operators, which had been continuously requested in the OTT industry, rated content on their own, and eventually introduced with the revision of the Act on the Promotion of Movies and Videos.
The self-rating classification system provides the OTT industry with an opportunity to provide timely and timely content. However, the key is whether harmful media can be controlled in advance in relation to youth protection. Concerns about this can be found from the stage of discussion on the revision of the bill. In other words, the Minister of Culture, Sports and Tourism adopted a designation system selected by the Minister of Culture, Sports and Tourism among companies that meet the requirements, not a reporting system that allows all if certain requirements are met. Of course, there is a possibility that it can be operated under a designated system for three years and changed to a reporting system by analyzing the operation results.
The subject of this self-rated classification is online video, and limited viewing prices are excluded. However, since there are no businesses to classify their own ratings with such limited viewing prices, excluding limited viewing prices is expected to be nothing more than a simple declarative regulation. Online videos that have undergone their own rating classification have the same effect as the rating classification of the Video Rating Committee. However, the video quality rating committee must be notified of the results of the related rating within five business days of service provision, and based on this, the video quality rating committee can verify the appropriateness of its own rating classification and reclassify it ex officio. However, since adequacy verification is carried out after the service is already provided, it is necessary to change the regulations so that adequacy verification can be carried out before the service is provided in youth protection. In order to systematically support the appropriateness of self-grade classification, a self-grade classification follow-up management committee and a self-grade classification support subcommittee may be established within the video quality rating committee.
I believe that the active activities of these committees will be the basis for the establishment of the self-rated classification system. In the end, the self-grade classification system is largely introduced due to the limitations of the manpower and budget of the Video Rating Committee. Therefore, it is believed that the degree of blocking is likely to be lowered in preventing the inflow of harmful media to adolescents through pre-grade classification. Therefore, it is necessary to play the role of the Video Rating Committee so that the self-rated classification system can fulfill its function not only in the OTT industry but also in youth protection by applying a systematic system.
