정상회담 선물과 대통령기록물 (Gifts from the Summit and Presidential Archives -Focusing on the Management of Gifts for Living Animals and Plants-)

초록

미국 건국의 아버지들은 250년 전 미국정부 관료들이 유럽 귀족들로부터 값비싼 선물을 받고 그들의 회유에 넘어갈 것을 우려해 연방헌법에 외국인으로부터 값나가는 선물 받는 일을 불법으로 규정했다. 1966년 미국의회는 미국 정부 고위관리가 받을 수 있는 선물의 가치를 규정한 법을 통과시켰고, 행정부는 매년 해외에서 받은 선물 목록과 감정가격을 공개하도록 했다. 외국에서 415달러 이상의 선물을 받을 경우, 이를 정부에 제출 이관하거나 그 선물 가액에 상응하는 금전적 대가를 지불한 후에 개인적으로 소유하도록 규정한 것이다. 우리「공직자윤리법」도 ‘선물신고’규정을 명문화 하여 대통령을 비롯한 공직자들이 외국 정부 등으로부터 받은 선물의 신고를 통하여 선물로 인한 여러 가지 문제를 사전에 차단하고 있다. 국가원수간 정상회담(頂上會談)에는 외교적인 관례로 선물을 주고받는다. 문재인 전 대통령은 2018년 9월 남북정상회담을 위해 방북했을 당시, 풍산개 한 쌍을 개인이 아닌 ‘국가 원수 자격’으로 북한 김정은 국무위원장으로 부터 선물 받았다.「대통령기록물 관리에 관한 법률」은 대통령이 재임 기간 중 받은 선물은 대통령기록물로 분류하고 있으며, 국가가 소유하도록 규정하고 있다. 이에 따라 풍산개도 대통령기록물로 분류된다. 윤석열 대통령은 당선자 시절 문재인 대통령과의 면담에서 청와대에서 기르던 풍산개들을 문재인 대통령이 퇴임 후에도 직접 키우는 게 좋겠다는 뜻을 밝혔다. 그러나 신임 대통령의 이런 양해에도 불구하고, 관련 법률에 퇴임한 문재인 전 대통령에게 풍산개를 위탁할 법적 근거가 명문화되어 있지 않아서 당시 대통령기록관은 문재인 대통령과 ‘사육 및 관리에 필요한 물품 및 비용을 예산의 범위 내에서 지급할 수 있다’는 내용의 위탁계약을 맺었고, 나중에「대통령기록물 관리에 관한 법률 시행령」을 개정해 법적 근거를 마련하려 했다. 문재인 전 대통령은 퇴임 이후에 풍산개를 자택으로 데려가 키워 왔다. 2022년 11월 문재인 전 대통령이 집에서 키우던 풍산개를 정부에 반환한 것을 두고 여․야 정치권에 논란이 되고 있다. 본고에서는 대통령의 직무수행 중 받은 선물과 관련한 특히, 살아있는 생명체 선물의 관리 처분 등의 쟁점사항을 중심으로 논구(論究)해 보고자 한다.

영어초록

The Founding Fathers of the United States made it illegal for U.S. government officials to receive expensive gifts from European aristocrats and valuable gifts from foreigners for fear of being corrupted by bribery. In 1966, the U.S. Congress passed a law that stipulated the value of gifts that a senior U.S. government official could receive, requiring the administration to disclose a list of gifts and appraisal prices received abroad every year. It stipulates that if they receive gifts worth more than $415 from a foreign country, they should hand them over to the government or pay the equivalent amount of money before owning them. The Public Service Ethics Act of Korea also stipulates the "Gifts Reporting" regulation, blocking various problems caused by gifts in advance by the President and other public officials through reporting gifts received from foreign governments. When former President Moon Jae-in visited North Korea for the inter-Korean summit in September 2018, he received a pair of Pungsan dogs as a gift from North Korean leader Kim Jong Un, not as an individual, but as a "qualified head of state." Act on the Management of Presidential Archives classifies gifts received by the President during his/her tenure as presidential records and stipulates that the state owns them. Accordingly, Pungsan dogs are also classified as a presidential record. In a meeting with President Moon Jae-in when he was elected, President Yoon Suk Yeol expressed his opinion that it would be better for President Moon Jae-in to raise the Pungsan dogs that Moon raised at Cheong Wa Dae even after he left office. However, despite the new President's understanding, the law did not stipulate the legal basis for entrusting Pungsan dogs to retired former President Moon Jae-in. So, the Presidential Archives first signed a consignment contract with President Moon and later revised the Enforcement Decree of Act on the Management of Presidential Archives to provide the legal ground. It is controversial that former President Moon Jae-in returned his home-grown Pungsan dogs to the government in November 2022. This paper discusses issues such as the management and disposal of living animal and plant gifts, especially related to gifts received during the performance of the President's duties.
