초록

의사는 환자의 자기결정권을 보호하기 위하여 질환을 치료하기 위한 침습적 의료행위를 수행하기 전에 환자에 대하여 환자의 질환이 무엇인지, 치료방법이나 예후, 부작용이 무엇인지를 설명할 의무를 부담하고 있다. 그런데 의료현장에서는 환자가 종교적 신념이나 자신의 주관을 주장하며 의사의 의료행위를 거부하거나 지시에 불응하는 경우가 종종 발생하게 된다. 이러한 경우 의사가 침습적 의료행위에 관한 설명을 넘어 환자를 설득하여 의료행위를 수행받도록 하거나 혹은 불필요하거나 치료 목적에 부합하지 않는 의료행위를 받지 않도록 하여야 할 의무까지 부담해야 하는지가 임상현장에서 문제되고 있다. 이는 의사의 설명의무와 설득의무와 그 반대편에 놓인 환자의 진료협력의무 사이의 긴장관계에서 발생하는 국면으로 이해할 수 있다.
이들의 관계는 통상의 의료행위와 미용성형수술행위에 있어 다른 양상을 띄는 것으로 보인다. 즉, 통상의 의료행위의 경우 질환을 치료하기 위한 목적과 설명 및 의료행위 수행 과정에서 의사의 최선을 다한 노력이 존재하였는지를 고려하여 의사의 설명·설득의무와 환자의 진료협력의무의 관계가 논의되어야 한다. 반면 미용성형수술의 경우 질환의 치료가 아닌 주관적 심미관을 충족시키기 위한 것이고 숙고를 위한 시간을 충분히 부여할 수 있다는 점에서, 의사가 환자가 요구하는 결과를 발현하기 어렵다고 판단되는 경우에 환자에게 그러한 점을 설명하고 수술을 중단하거나 중단시켜야 할 의무까지 존재하는지가 환자의 진료협력과의 관계에서 문제될 수 있다.
본고에서는 전통적인 의사의 설명의무, 그 설명의무에 내포되어 있는 설득의무가 어떠한 관계에 있는지를 살펴보고, 환자의 진료협력의무는 어떠한 영향을 미칠 수 있는지를 점검해보고자 한다. 특히 통상의 의료행위에서 이들 관계의 발현 국면과 미용성형수술에서의 이들의 관계 발현 국면을 비교해 보고자 한다. 이를 위해 전통적인 의사의 설명의무·설득의무 및 환자의 진료협력의무의 법리 및 관련 현행법의 규정을 확인한 후, 실제 우리나라 판례의 사안에서 각각의 경우 문제되었던 경우를 점검하여 설명의무와 설득의무 그리고 진료협력의무와의 관계를 어떻게 설정할 것인지를 검토해보고자 한다.

영어초록

To protect a patient’s rights to self-determination, a physician has an obligation to provide patients with information on their diagnoses, the method of treatment or their prognosis and the side-effects thereof, prior to performing invasive medical practice for medical treatment. However, in the healthcare environment, patients occasionally refuse the physician’s treatment or disobey directions based on their religious beliefs or personal opinions. In this case, there are some questions in the clinical environment: whether physicians are responsible for persuading patients to either have medical treatment beyond explanations on invasive medical practice by physicians, or deny patients treatment that is unnecessary or inconsistent with medical purposes. This can be interpreted as a strained phase arising from relations between a physician's duty of explanation and persuasion and a patient's obligation to cooperate with the treatment.
Such relationships assume different forms in general medical practices and in cosmetic surgery. In other words, in the case of general medical practice, the priority is that the relations should be discussed between the duty of physicians’ explanation and persuasion and the obligation of patients’ cooperation with the treatment, given a physician’s effort to perform the purpose of treatment, its explanation and medical treatment. On the other hand, cosmetic surgery focuses on personal aesthetic satisfaction rather than on treatment. In that sufficient time is given for considerations, if it is deemed for a physician to be difficult to realize the results of a patient’s requirements, some questions may arise to a point where the physician provides the patient with information on such matters and is obliged to prevent surgery, thus leading to a possible problem with the obligation of patients’ cooperation with the treatment.
This article is designed to explore the relationship between the traditional duty of a physician's explanation and the duty of persuasion inherent in the duty of explanation, and to review the impact of a patient's obligations regarding treatment cooperation. In the article, particularly, a comparison of the relationships is made between the representing phase in the general medical practice and the one in cosmetic surgery. To do this, the article examines the legal principles and regulations of the related current acts of a conventional duty of physicians’ explanation and persuasion, and an obligation of patients’ treatment cooperation to check issuing cases respectively as for actual precedents in Korea ─ and to consider how to establish the relationships among the duty of explanation, the duty of persuasion, and the obligation of treatment cooperation.
