재외한인의 무국적과 정책과제: 독립국가연합의 무국적 고려인에 대한 연구 (Statelessness of Overseas Koreans and Its Policy Agenda A Study on the Stateless Koreans in the CIS)

초록

본 연구의 목적은 무국적 고려인의 문제를 우크라이나의 크림 자치주와 러시아 남부 로스토프지역을 사례로 고찰하는 것이다. 연구방법으로서는 거시적 측면에서는 연구대상 관련 기존문헌을 이용하였고, 그 다음으로 현지조사에서는 인터뷰, 참여관찰 및 현지기록의 분석 등이 이용되었다.
현지조사의 대상지역은 무국적 고려인들이 많이 거주하고 있는 우크라이나의 크림자치주와 러시아의 로스토프주가 선정되었다. 크림 자치주와 로스토프주는 인접지역에 위치하면서 각각 우크라이나와 러시아라는 각기 상이한 국가에 속하고 있기 때문에 무국적 고려인 문제를 비교적으로 고찰하는 데 상당히 유리하다.
연구결과로서 첫째, 승계대상지역의 선행국 국민의 주권은 승계국의 국적으로 취득되는 것이 일반적이지만, 고려인들의 무국적의 경우 이러한 원칙이 이행되지 않는 실정이다. 이 경우 이들은 바로 ‘법률상의 무국적 상태’에 해당한다. 또한 고려인의 경우 금전(비용)문제, 처한 현재의 상황 또는 처벌의 두려움 또는 차별의 이유 등과 같은 실제적인 이유 때문에 자신의 국적을 주장할 수 없기 때문에 무국적 상태가 된 경우도 있기 때문에 이러한 경우에는 ‘사실상의 무국적자’자에 해당할 수도 있다.
둘째, 고려인과 상당히 유사한 우크라이나의 크림 따따르인들의 무국적 문제의 해결과정을 검토할 때 한국정부의 대책을 다양화 할 필요가 있다는 것을 알게 된다. 크림 따따르인들의 무국적 해결에는 국제난민기구(UNHCR)의 노력이 매우 중요하게 작용하였다. 따라서 무국적 고려인 문제와 관련하여 한국과 현지 당사국의 양자간의 노력 이외에도 이러한 문제를 주로 다루는 국제기구와의 공동노력이 매우 중요하다는 점을 인식할 필요가 있다. 이는 자칫 당사국간의 관계 경색으로 인하여 문제해결이 어려울 경우 당사국 대신 제3자인 국제기구가 개입하도록 함으로써 특히 문제해결에 유효한 방안이 될 수 있을 것이다.

영어초록

The goal of the study is to inquire into the problem of the stateless Koreans in the CIS, especially in Ukraine and the Rostov Oblast in the southern Russian region. According to a recent report, the number of the stateless Koreans is 50,000 persons, about 10 percent of the Soviet Koreans living in the CIS. These stateless Koreans have been subject to harsh discrimination in education of their children, their employment, and benefits of medical care.
Statelessness of the Soviet Koreans results from various factors, but the phenomenon is mainly due to fact that the Soviet Koreans, who struggled with ethnic and linguistic difficulties in Central Asia following the breakdown of the USSR in December, 1991, frequently migrated to Ukraine or to the southern Russian region.
Research method of the study consists not only of a literature review of existing documents, related articles or relevant studies, but of field survey, interviews with related people and participant observation. Among research sites of the study are the Crimean peninsula in Ukraine and the Rostov oblast, where the stateless Koreans are concentrated. The regions mentioned above are advantageous for a comparative study in that they belong to different countries, but are located not far away from each other.
This research, first of all, shows that the stateless Soviet Koreans are involved not only in de jure stateless, but in de facto stateless. It means that the Soviet Koreans became stateless because they could not claim or declare their nationality due to their fear for prosecution or for banishment from their current resident nation, in addition to the fact they are legally stateless.
Second, this research suggests that the Korean government needs to diversify its policies for the stateless Soviet Koreans. That is, the Korean government needs to make enormous efforts to cooperate with such international organization as UNHCR as in the case of the stateless Crimean Tatars. UNHCR played a crucial role in seeking the cooperation of the Uzbek government in granting necessary permission to the stateless Crimean Tatars from Uzbekistan, the former resident nation of the Crimean Tatars.
