대리모 출생아의 친자관계- 2018. 5. 18. 선고 서울가정법원 2018브15 결정을 중심으로 - (Filiation of a Baby Born through Surrogacy)

초록

2018. 5, 18. 서울가정법원은, 의뢰부모의 수정란으로 한국인 자궁대리모가 미국에서 출산한 아이의 한국 내 출생신고가 문제된 사안에서, 대리모계약의 효력과 우리 민법상 모의 결정기준에 대해 최초로 그리고 정면으로 판단하였다. 필자는, 우리 민법상 모자관계의 결정기준인 ‘모의 출산사실’이 대리모출산의 경우에도 그대로 적용되어야 한다는 점, 자궁대리모도 우리 법령의 해석상 허용되지 않고, 이러한 대리모 계약은 선량한 풍속 기타 사회질서에 위반하는 것으로써 민법 제103조에 반하여 무효이고, 난자를 제공한 사람은 민법상 ‘친양자 입양’을 통하여 법적 친자관계를 가질 수 있다고 판시한 본 판결의 결론과 논리에 대해 동의하고 환영한다. 다만, 아동의 최선의 이익보호라는 측면에서, 그리고 대리모 출산은 배우자가 아이를 출산한 경우가 아니어서 친생추정이 미치는 영역이 아님을 고려한다면, 유전적 부인 의뢰부의 출생신고를 인지신고로 보아 그 효력을 부여함으로써 부와의 친자관계를 성립시켜야 한다고 생각한다. 왜냐하면 대리모출산사실이 아동의 기본적 권리인 출생등록을 할 권리에 불이익하게 작용하거나 그 등록 시기를 지연시켜서는 안 되기 때문이다. 본 논문은, 위 결정을 계기로, 대리모제도에 관한 문제를 개관하고 외국의 입법례를 비교 분석하면서, 대리모를 보호하고 의뢰부모의 친자관계를 형성할 권리를 보호하고, 나아가 대리모를 통해 출생한 아이의 최선의 이익을 보장할 수 있는 방안을 모색하고자 한다.

영어초록

The legal status of child born through surrogacy is an immediate task which Korea face nowadays. On May 18, 2018, the Seoul Family Court ruled, for the first time, on the issue of the surrogate mother's contract and the standards of deciding mother through our civil law, in the case of the child born in the United States. According to the decision, in our civil law, the ‘fact of giving birth’, which is the standard of determining mother, should be applied to the issue of surrogate mother's birth, and when the birth report is filed under the Family Relations Registration Act, the child's birth certificate must be proved by the birth certificate attached to the birth report. In consideration of the legislative purpose of the Bioethics Act, the gestational surrogacy is not allowed in the interpretation of our laws, and such surrogate contract violates Article 103 of the Civil Code contrary to good customs and social order. I generally agree and welcome the conclusions and logic of this ruling which demands of adoption of intended mother for establishing legal maternity with the child through surrogacy. However, in view of the best interest of the child, and considering that the surrogate's birth is not the area of ​​the parental assumption because the spouse did not give birth to the child during marriage, the paternity should be made by recognition of the intended father as well as genetic father. The fact that the child is born through surrogate should not disadvantage or delay the registration of a child. In addition, it is reasonable to establish a legal maternity through the adoption of a ‘complete adoption’ system in the existing civil law, rather than introducing a new and separate lawsuit for deciding “legal mother.” In this paper, I review the surrogate mother system as a whole and consider the filiation with surrogate mothers abroad in consideration of the global trend of surrogate journey in surrogate-friendly countries.
